You misread Lynch. She didn’t question that incendiary speech is protected by the first amendment, but she warned that violent actions are not protected, and will be prosecuted, even if they were motivated by protected speech.
Nakoula Basseley Nakoula might be inclined to disagree with that assertion.
Nakoula’s speech was protected. His use of a computer in violation of his parole conditions was not. The only objectionable aspect of what happened to him is that the DOJ shouldn’t have been looking for whomever made the film in the first place, so they shouldn’t have found out that he did it.
In any case, I have no sympathy for him, since he first pretended to be a Jew, and then a Copt, in order to throw the blame on them.
Nonetheless, Lynch spoke as if Americans were guilty of the crime of Islamophobia and had to prove they are innocent…the very opposite of what we should want in an Attorney General of the United States. She has earned whatever First Amendment protected derision we choose to give her.
