Joy Behar: Trump Will Use ICE Protests to Declare Martial Law, Cancel Midterms

Yesterday on The View, Joy Behar suggested that she is worried that Trump is planning to use the ICE protests in Minneapolis and elsewhere to declare martial law and cancel the 2026 midterm elections.
Stop and consider this for a moment. She is saying that Trump will override local jurisdictions, put the military in charge, and then cancel elections. It is pure BlueAnon lunacy.
Now seems like a good time to remind everyone that The View falls under the ABC ‘News’ division.

“The View” co-host Joy Behar said Tuesday that President Donald Trump was hoping for protests to cause chaos so that he could declare martial law and cancel the 2026 midterm elections.
“I worry that Trump is looking for this kind of pandemonium to go on, like you just described, so he can declare martial law and also cancel the midterms,” Behar said as the co-hosts discussed protests against Immigration and Customs Enforcement (ICE) across the country.
The co-hosts discussed the ongoing protests against ICE in cities such as Minneapolis following the fatal shooting of Renee Good in the city.
“Watch out for this guy!” Behar said. “Because he’s worried — he even said, ‘If the Democrats take Congress next time, I will be impeached,’ which means that he could be convicted and sent to jail. He does not want that to happen.”
Co-host Whoopi Goldberg told viewers to know their rights while protesting.

An empty suggestion if there ever was one. You don’t have a right to obstruct law enforcement and you don’t have the right to hit a police officer with your car. The police, however, are fully within their authority to use deadly force if necessary. If you don’t like the law, change the law. But once something is law, expect it to be enforced even if it’s over your objections.
They’re not even police…they are federal agents and they aren’t stopping you, you are stopping them then acting violent and angry.
They are police. They have the same authority as any policeman to arrest someone without a warrant for any crime they observe. (I think that is only federal crimes; I don’t think federal police can arrest someone for a state crime.)

OMG, I have been hearing exactly the same narrative before every election since at least 2002, always from supporter of whichever party is not in the White House. It’s always the same impossible nonsense.
For the millionth time, the US constitution does not allow martial law in the USA, ever.
The Supreme Court has carved out one narrow exception to that: if an emergency makes it impossible for the civilian courts to function in an entire county, then the military may step in and administer the law until the courts are able to function again. The moment a court opens its doors in the county, martial law automatically becomes illegal, and anything the military government does after that point is invalid.
The reason SCOTUS gave for this exception was simply that someone has to administer the law, so if the courts whose job it is can’t do it then the military has no option but to step in. Thus it can only step in for as long as there is no alternative; as soon as it’s possible for it to stop, it must do so.
Thus the “martial law” that FDR purported to impose in Hawaii for the duration of WW2 was invalid, and every single act those military tribunals had taken was overturned.

Lincoln declared martial law in counties where the courts were operating, and the Supreme Court struck it down. All actions taken under that unlawful rule were invalid and had to be reversed.

Oh, and if elections are canceled, that does not extend the terms of the people whose offices were to have been filled. On Jan-3-2027 the entire current House and 1/3 of the current senators will be out of office, unless they are reelected this year. Canceling the election would simply leave those seats vacant. Likewise if a presidential election is canceled then on Jan-20 the presidency and vice-presidency become vacant; the incumbents do not and cannot stay on.
So there’s no point in canceling elections, even if whoever’s in office could do so.
Huh? Isn’t she missing a step there? An impeachment and conviction would remove him from office. It could not possibly send him to jail. That would require a criminal trial, prosecuted by a Vance-led DOJ, which obviously would refuse to do so.
