Trump Declares Fentanyl a Weapon of Mass Destruction

I missed this yesterday. Whoops!
President Donald Trump declared fentanyl a weapon of mass destruction during a press conference to award military men and women who played a prominent role in defending our border.
That’s why today I’m taking one more step to protect Americans from the scourge of deadly fentanyl flooding into our country with this historic executive order I will sign today.
We’re formally classifying fentanyl as a weapon of mass destruction, which is what it is.

A tiny amount of fentanyl can kill numerous people.
“The manufacture and distribution of fentanyl, primarily performed by organized criminal networks, threatens our national security and fuels lawlessness in our hemisphere and at our borders,” according to the executive order. “The production and sale of fentanyl by Foreign Terrorist Organizations and cartels fund these entities’ operations — which include assassinations, terrorist acts, and insurgencies around the world — and allow these entities to erode our domestic security and the well-being of our Nation.”
The EO pointed out that two cartels bear the most responsibility for pushing fentanyl into America. Their competing against each other leads to “large-scale violence and death that go beyond the immediate threat of fentanyl itself.”
The possibility of weaponizing fentanyl “for concentrated, large-scale terror attacks by organized adversaries is a serious threat to the United States.”
A DEA 2024 National Drug Threat Assessment found that the Sinaloa and Jalisco cartels are at the center of the fentanyl crisis.
“They rely on chemical companies and pill press companies in China to supply the precursor chemicals and pill presses needed to manufacture the drugs,” the DEA wrote in the report. “They operate clandestine labs in Mexico where they manufacture these drugs, and then utilize their vast distribution networks to transport the drugs into the United States.”
The cartels use Chinese Money Laundering Organizations to move the money from America back to Mexico.
I wrote about that process in June 2024.
At that time, the DOJ indicted the Los Angeles-based members of Mexico’s Sinaloa drug cartel in connection with a massive drug money laundering scheme totaling over $50 million linked to Chinese organized crime.

What will be done about legitimate uses of the drug? Fentanyl is used often by anesthesiologists during surgery.

IF there are legitimate uses for the drug then I suspect those uses will continue to be covered via the existing routes for procuring the drug.

I just had a relative ambulanced out of a multiple car crash. A dozen broken bones, concussion, cuts, blood. Fentanyl was administered during the transport. Thank heavens they had it.
Hey, have we already forgotten the s*-show that occurred among chronic pain patients when the federal government decided to practice medicine without a license, and penalized pain management doctors for “overprescribing” opiates whether the medical need was valid or not?
And that was just a schedule II drug. Now imagine having to prescribe a “weapon of mass destruction.”

What Trump just did is 100% equivalent to banning a gun instead of convicting a criminal. It’s a classic Democrat move. It’s no different than his stupid bump-stock unforced error.

Not only that but the WMD designation creates a policy problem. The US has a no first strike/first use policy for WMD but has consistently made clear that use of WMD against the USA would result in retaliation up to and including use of our WMD. Since we only admit to having nukes…who are we gonna pop with one or more and when? If not a nuke then what combination of conventional munitions to approximate use of a nuke? The problem with bluffing/hyperbole is that people ignore the bluster after a certain point. This is just dumb unless we’re really gonna start carpet bombing Caracas, Mexico City, Beijing or whatever other target which IMO would be even more dumb.
Eh. I think this is whole declaration thing is stupid.
But WMD and fentanyl are in pretty analogous situations. Both are illegal for the general public to possess. They are both only allowed to be used or possessed by a relatively small portion of the population licensed (doctors) or authorized (the military/CDC/Dept of Energy/etc.) by the government. Use of either is not bad in and of itself (use against enemies or for deterrence for WMD and legitimate pain mitigation for fentanyl), but if misused can have catastrophic consequences.
At the end of the day, I don’t think this declaration means anything, nor do I think that current laws regulating WMDs should apply to controlled substances. And I can’t see a judge letting it happen, beyond some type of crazy scenario with something like someone dumping a few kilos of fentanyl into an air handling unit of a building or subway for something like that.
Terrorist language is used to move all sorts of things under the sway of modern legislation.
When there’s no terror in the first place.
Except for those under its influence or suffering the consequence of its usage.
The only example of terror, about the only one, is peaceful blacks cowed into silence by their fellows burning down the city they live in. Agree or die.
The Executive Order designates “illicit fentanyl” and its core precursor chemicals as Weapons of Mass Destruction.
Legal experts and public health officials noted that the order does not change existing laws concerning fentanyl and its necessary use by medical professionals.

But the outright physician harassment over plain old opiates already shows you exactly how it’s going to be enforced in practice. How many times should we make the same mistake?
I find this declaration fascinating…. is there a legally binding definition of what constitutes a “weapon of mass destruction?” I bet not. Who has (any actual) power to disagree with the President’s determination?
While his declaration is unusual who says a WMD must be dropped from a plane, shot from a gun, or sprayed as a gas or liquid?

In Pennsylvania, there’s actually a criminal charge for possession or use of weapons of mass destruction.

(i) Definitions.–As used in this section, the following words and phrases shall have the meanings given to them in this subsection:
“Biological agent.” A natural or genetically engineered pathogen, toxin, virus, bacteria, prion, fungus or microorganism which causes infections, disease or bodily harm.
“Bomb.” An explosive device used for unlawful purposes.
“Chemical agent.” Any of the following:
(1) A nerve agent, including tabun (GA), sarin (GB), soman (GD), GF and VX.
(2) A choking agent, including phosgene (CG) and diphosgene (DP).
(3) A blood agent, including hydrogen cyanide (AC), cyanogen chloride (CK) and arsine (SA).
(4) A blister agent. This paragraph includes:
(i) Mustard (H).
(ii) Sulfur mustard (HD).
(iii) HN-1.
(iv) HN-2.
(v) Nitrogen mustard (HN-3).
(vi) An arsenical, such as lewisite (L).
(vii) An urticant, such as CX.
(viii) An incapacitating agent, such as B2.

I imagine there’s a similar federal statute and probably for most states as well.
It’s clearly not meant to cover controlled substances. But you could maybe, maybe include something like fentanyl under (i)(5). But I would imagine it would have to be something like dumping a large amount of fentanyl into an air handling system with the intent to kill everyone in a building or something like that.
It’s a bullshit term — like “assault weapon” — that gets used t ban anything anybody wants to ban.

(2) the term “weapon of mass destruction” means— (A) any destructive device as defined in section 921 of this title ; (B) any weapon that is designed or intended to cause death or serious bodily injury through the release, dissemination, or impact of toxic or poisonous chemicals, or their precursors; (C) any weapon involving a biological agent, toxin, or vector (as those terms are defined in section 178 of this title ); or (D) any weapon that is designed to release radiation or radioactivity at a level dangerous to human life; and
“any weapon that is designed or intended to cause death or serious bodily injury through the release, dissemination, or impact of toxic or poisonous chemicals”
Makes more sense — a WEAPON designed to release a poison… NOT the poison.
The toxin or poison is in lauded through section 178 of the same title
Now watch the Dems come out in favor of making Fentanyl over-the-counter.

So Trump is taking a page out of the democrat’s playbook. My Blue governor declared firearms a public health emergency and tried to restrict rights based on her proclamation. I don’t see Trump going that far but it should be a tactic the left is familiar with.
