New Georgia Prosecutor for Trump Election Case Moves to Drop All Charges
Who could forget the drama around the case?!
Peter Skandalakis, who took over for Fani Willis, moved to dismiss all charges against President Donald Trump and 14 defendants in the Fulton County election interference case.
“Given the complexity of the legal issues at hand — ranging from constitutional questions and the Supremacy Clause to immunity, jurisdiction, venue, speedy-trial concerns, and access to federal records — and even assuming each of these issues were resolved in the State’s favor, bringing this case before a jury in 2029, 2030, or even 2031 would be nothing short of a remarkable feat,” Skandalakis wrote in his filing.
My goodness. Who could forget the drama?
In December, the Georgia Court of Appeals disqualified Fulton County DA Fani Willis from the case due to her relationship with former special prosecutor Nathan Wade.
“The remedy crafted by the trial court to prevent an ongoing appearance of impropriety did nothing to address the appearance of impropriety that existed at times when DA Willis was exercising her broad pretrial discretion about who to prosecute and what charges to bring,” wrote the court.
The nonpartisan Prosecuting Attorneys’ Council of Georgia had to find a new prosecutor for the case.
Skandalakis serves as the organization’s executive director.
Skandalakis appointed himself as prosecutor when he could not find someone who wanted the role.

The only question remaining is why Fani is still practicing any type of law.

The burden of leadership… when you have to take one for the team.
The burden of leadership… realizing that your subordinates have no desire to take on a case that was constructed out of thin air, with little evidence other than persecution.
Pretty much nails the ecological niche Fani filled, doesn’t it.
I said at the time that Skandalakis being unable to find any prosecutor willing to take on the case was a sure sign of how bad it was in the first place.
Over a year ago, I posted this comment (slightly revised here for clarity) at another site to a story about the election interference case:
The Constitution doesn’t limit the right to petition government to a judicial process (such as that pursued by Gore in his election challenge in Florida). A “petition” is also a request to an elected official, an agency, or any other government office, asking for a specific action or grant. Trump, while POTUS, still has the ability to act as a citizen (SCOTUS agreed by commanding the prosecution to separate Trump’s “official” from his “personal” acts), and his contacts with Pence, the GA AG, and others, concerning the election almost certainly (if they aren’t “official”) fall into the category of “petitioning government”, asking for action from the parties he petitioned.
Did Trump request criminal acts from those he petitioned? If so, so what? A citizen can’t be required to know the law when petitioning government. Such a requirement would chill the exercise of the right (by creating a fear of criminal liability for merely asking for something from the government – remember, “petitioning” is a constitutionally-protected act and the exercise of a right can’t be converted into a crime). It’s up to those petitioned to reply, “I can’t do that, it’s illegal,” or, “I can’t do that, it’s not within my authority.”
The prosecution of this case was DOA.
Exactly. At worst, the defendants in this case were merely misinformed. There was no reasonable case to be made that they were criminal.
It seemed to me that one of the main arguments all of these out of control Democrat prosecutors was that when your elected President you surrender all your rights under The Constitution among which is the right to petition the government. That didn’t sound right to me.
No, that wasn’t one of their arguments. Their argument was basically that Biden won the election, everyone including Trump knew that, and the entire “stop the steal” movement was about a conscious effort to steal the election. They did not and still don’t accept that anyone could possibly ever have doubted the result. All protests about what happened were cynical lies.
To Dems that was and is an article of faith, exactly as it is an article of faith among some Reps that the election was stolen and that clear and convincing evidence of this existed but was deliberately ignored.
Both of these dogmas are false. The truth is that we will never know who “really” won in 2020, and to what extent the Dem cheating affected the result. All the Rep stories of blatant and obvious cheating turned out to be false, but that doesn’t change all the non-blatant and unobvious cheating, whose cumulative effect may or may not have been enough to swing the election.
