Oregon Sues Trump Over National Guard Deployment
President Donald Trump directed DHS and the Defense Department to send in the troops to protect federal property “from attack[s] by Antifa and other domestic terrorists.”
Oregon filed a federal lawsuit against the Trump administration over its deployment of the National Guard to Portland.

Defendants’ deployment of troops to Oregon is patently unlawful. Because their stated basis for federalizing members of Oregon’s National Guard is patently pretextual and baseless, Defendants cannot satisfy any of the three perquisites for involuntarily federalizing a state’s National Guard under 10 U.S.C. § 12406. Defendants’ purpose in federalizing those troops—to integrate them into federal law enforcement activities in Portland—also violates the Posse Comitatus Act.
Additionally, Defendants’ actions violate the Tenth Amendment’s guarantee that the police power—including the authority to promote safety at protests and deter violent crime—resides with the states, not the federal government. And by singling out a particular disfavored jurisdiction for political retribution, these actions also eviscerate the constitutional principle that the states’ sovereignty should be treated equally.
Yes, Oregon invoked the Posse Comitatus Act, which other states and D.C have used.
Congress passed the Posse Comitatus Act in 1878, preventing the government from using the military to enforce domestic law.
“Oregon communities are stable, and our local officials have been clear: we have the capacity to manage public safety without federal interference,” stated Oregon Attorney General Dan Rayfield. “Sending in 200 National Guard troops to guard a single building is not normal.”
Rayfield also claimed the deployment is “about the President flexing political muscle under the guise of law and order.”
The politicians filed the lawsuit after Defense Secretary Pete Hegseth told them that National Guard troops would protect federal property only “where protests are occurring or likely to occur.”
Trump announced on Saturday:
At the request of Secretary of Homeland Security, Kristi Noem, I am directing Secretary of War, Pete Hegseth, to provide all necessary Troops to protect War ravaged Portland, and any of our ICE Facilities under siege from attack by Antifa, and other domestic terrorists. I am also authorizing Full Force, if necessary. Thank you for your attention to this matter!

If the Gov of Oregon and Mayor of Portland deploy 200 LEO to create a sufficient outer cordon 24/7/365 then the Feds won’t need additional support from the NG to secure the Federal Facilities. They’ve had plenty of opportunity and haven’t yet, so no whining out them. What they need are Mark 19 firing off CS and rubber projectiles. Every person with an ‘umbrella’, sign, and bullhorn targeted then a surge of LEO to surround and arrest them.

When we first started, before we got the rubber projectiles, we used what we called “hickory nuts”; a half dozen inch and a half long sections of 4o mm hardwood dowels per round. Neither is allowing 100+ consecutive days of rioting, but that’s what occurred in Portland a few years ago. Portland also happens to be a place where there is an obvious and increased risk to federal facilities, the likes of which is uncommon elsewhere. Portland is not “disfavored jurisdiction,” it is a jurisdiction in which there is an unusually high threat to to federal property.

The president is responsible for protecting federal facilities and employees, a judge is not.
Actually a surplus of resources. I think it’s a team of 30 at most. I don’t think the the NG is an effective police force, but DC might have proven otherwise.
A team of 10 can arrest 10-20 per night.
A team of 10 to transport to another federal facility- far from Portland.
A team of 10 to review recent footage, book/charge.
The charging team should be augmented to gather all the crap those arrested have done over the duration.

You need the larger number, 200, to have a rotation. If you do 12 hours on and 12 hours off with shift change at noon and midnight that’s only 100 per shift. Internally within the shift you’d break it down further with maybe five teams of 20 each. With one team designated ‘off’ every fifth day, one team as external QRF to potentially deploy with ICE outside of the Facility, one team as with 1/2 as internal QRF and 1/2 as overwatch on roofs and two teams of 20 to move out and secure a cordon for ingress/egress of vehicles and to confront/push back the mob.
These guys are gonna be used to secure the under siege Federal Facility and on order to move external into the City to protect ICE from some mob situation at an arrest/sweep site. They’re there to be a extra bodies to deal with crowd control, which is a NG function, not to be LEO.
I’m not a lawyer but it seems like the state should present some evidence to support their side, not just multiple versions of, “Trump Bad! No Want!”

You may have the capacity but you don’t have the will and we’ve seen that repeatedly for the last 5 years. Either the state protects federal facilities and federal employees or the fed will do it their own way.

I am a monthly visitor to Portland for practical reasons and am 100% for sending the Nat’l Guard to protect federal facilities. But as bad as downtown and some neighborhoods are, Portland is not a war-ravaged hellscape. Will Trump ever quit going over the top?

I just wish Trump wasn’t playing Dennis the Menace all the time. He’d be more effective if he would play it straighter, especially on this particular thing.
Trump is clearly maneuvering Portland and Oregon lefties into a no-win corner. If he sends in troops and they don’t do anything, they’ll look weak and ineffectual. If there’s violent resistance from Antifa, in particular, it’ll give Trump all the justification he needs to invoke the Insurrection Act to go in and crush them once and for all.

It seems like Oregon’s argument boils down to only we have the legal right to protect federal property, we also have the right to deny them protection, and since we hate the fed, Trump’s people have the choice of evacuating the state or getting fired on by very fine and mostly peaceful people.
