Education Department Ends Postsecondary Education Grants for Illegal Aliens

“Postsecondary education programs funded by the federal government should benefit American citizens, not illegal aliens.”

Education Secretary Linda McMahon announced the department has ended grants for illegal aliens to attend career, technical, and adult education programs.

“Postsecondary education programs funded by the federal government should benefit American citizens, not illegal aliens,” stated McMahon. “Under President Trump’s leadership, hardworking American taxpayers will no longer foot the bill for illegal aliens to participate in our career, technical, or adult education programs or activities. The Department will ensure that taxpayer funds are reserved for citizens and individuals who have entered our country through legal means who meet federal eligibility criteria.”

The decision stems from the 1996 Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) and the 1997 Dear Colleague letter from then-President Bill Clinton:

Title IV of the Personal Responsibility and Work Opportunity Reconciliation Act generally limits eligibility for “federal public benefits” to U.S. citizens, permanent residents, and certain categories of “qualified aliens.” PRWORA defines federal public benefits to include any retirement, welfare, health, disability, public or assisted housing, postsecondary education, food assistance, unemployment benefits, or any similar benefits for which payments or assistance are provided to an individual, household, or family eligibility unit.

In 1997, the Clinton Administration issued a Dear Colleague Letter that erroneously exempted career, technical, and adult education programs from being subject to PRWORA. In doing so, the Department’s interpretation mischaracterized the law by creating artificial distinctions between federal benefit programs based upon the method of assistance. Congress made no such distinction in PRWORA.

President Donald Trump promised to take action within the Education Department, once calling it “a big con job.”

Trump’s administration has already sued states that allow illegal aliens to pay in-state tuition.

Schools have also gone out of their way to protect their illegal alien students and educators, repeating the same old sob stories.

thats great on the fed level though I think the scotus addressed that years back and said

WE MUST,BY LAW SUPPORT their education b/c we cant pick and choose as we support their healthcare etc

I think this should be a local issue and of course any state that votes to do so ..should be given no fed tax money that will end up being co-mingled into their schemes

    You probably mean Plyler v. Doe, which took a case of a disabled US citizen boy suing for the right to education, and used it to give rights to education and healthcare to any living human bodies living in a school district, and the school district or hospital must pay for it.

    That really needs to be reversed. A lot of weird incentives would end.

    For school age kids, free K-12 education is required by SCOTUS decision Plyler v. Doe. They need to reverse that.

      Free K-12 education for all is a good thing, but it should only be available to citizens and those here legally. If an illegal immigrant tries to register their illegal kid, that should be an instant call to ICE to come pick everyone up.

        How about reformulation as ‘funding for a K-12 education’? At least this way the funding can go to the ED entity public, private, secular, parochial, homeschool, pod class or combo selected by the Parent/Guardian of the Student that best fits the individual educational needs of their Child.

      While I’m not convinced that will be the issue next year that you might, I agree the handling of this issue has been a giant self-own by Trump. He (and Bondi) took a bad issue and made it exponentially worse…and I wasn’t really someone who was invested in the topic before this week. If you have nothing to hide don’t act like you’re hiding something. This should be a guiding principle in politics.

      I don’t think so. It was 3 days ago. The midterms are 500 days from now. And I’d still vote for Republicans, because the alternative would be Democrats, or the “America” party that might exist to throw elections to Democrats.

First, it’s outrageous this was happening. Second, it will probably be weeks, days or maybe even hours before some federal district court judge says this is unconstitutional, probably citing Plyler v. Doe…which creates an even bigger impetus to reverse Plyler. No, the Constitution does NOT mandate that we pay for the education of Illegal Aliens.

      My point is that Plyler v Doe, a case that was decided 5-4 with Burger, White, O’Connor, Rehnquist in dissent, must be reversed by the Court. It was insane to hold that the US Constitution obligates the US taxpayer to provide an education to illegal aliens.

        Agree. It was a ridiculously over-broad ruling. The kid wasn’t an illegal alien but a US citizen as I remember. Why was it broadened to illegal aliens? Likely the international NGO’s were advising that decision with the coming migration agenda in mind.

          In that case, ‘the kid’ – John Doe – was imaginary, a construct of the lawyers who brought the action on behalf of children who were in the country illegally in exactly the same way that they’re using the class action lawsuit for the birth right citizenship cases.

    This is for post-secondary. Plyler is for K-12, and healthcare. I don’t think it’s at risk from Plyler.

      It shouldn’t be cited. But, I suspect when a federal district judge of their choosing enjoins the Trump Administration, Plyler will definitely be cited. They’ll say: If you’re giving education grants to US citizens, you’re obligated to give education grants to illegals…because Plyler (and probably other insane reasons as well).
