Supreme Court Denies Trump’s Request to Halt Hush Money Sentencing

Chief Justice John Roberts and Justice Amy Coney-Barrett joined the three Democratic appointees.

President-elect Donald Trump’s sentencing in the New York City hush money case will go forward on Friday since the Supreme Court won’t block it.

The ruling was 5-4. Chief Justice John Roberts and Justice Amy Coney-Barrett voted with Justices Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson.

From the order:

The application for stay presented to Justice Sotomayor and by her referred to the Court is denied for, inter alia, the following reasons. First, the alleged evidentiary violations at President-Elect Trump’s state-court trial can be addressed in the ordinary course on appeal. Second, the burden that sentencing will impose on the President-Elect’s responsibilities is relatively insubstantial in light of the trial court’s stated intent to impose a sentence of “unconditional discharge” after a brief virtual hearing.

A jury found Trump guilty of 34 felony counts for falsifying business records to pay off Stormy Daniels to keep quiet about their alleged affair.

Judge Juan Merchan refused to throw out the guilty verdict, scheduling the sentencing for January 10, ten days before the inauguration.

However, Merchan hinted that Trump won’t face any punishment.

Merchan said it’s “proper at this juncture” to inform everyone that it’s the “Court’s inclination to not impose any sentence of incarceration, a sentence authorized by the conviction but one the People concede they no longer view as a practicable recommendation.”

“As such; in balancing the aforementioned considerations in conjunction with the underlying concerns of the Presidential immunity doctrine, a sentence of an unconditional discharge appears to be the most viable solution to ensure finality and allow Defendant to pursue his appellate options,” Merchan added.

The lawyers asked Merchan to stay the sentencing because Trump appealed the judge’s decision.

Trump’s lawyers claimed the appeal automatically triggers a stay.

When Merchan and an appeals court said no, Trump went to the Supreme Court.

So Merchan will sentence Trump. Even if he doesn’t receive punishment, he’ll be a felon.

My money is on Merchan gleefully giggling inside as he solemnly proclaims Trump guilty, guilty, guilty 34 times in a row, then charges him something like a million (or a thousand) dollars in fines per offense. Then he happily takes his multi-million dollar bribe/book advance and goes on to the loud cries of joy from the Left as they screech “Convicted felon!” every time they say Trump’s name from now to eternity.

1) A court’s intent is not binding, Merchan can change his mind up to the time he imposes sentences.
2) Robert’s disdain for Trump has been evident since 2017
3) At the time that Barrett was nominated, I posted here that she was a snake in the grass and that Trump would rue the day that he nominated her…..that got me 13 down votes.
4) SCOTUS screwed up when it took it upon itself to amend the Constitution with its presidential immunity decision,..now every corrupt federal judge can rule that any action by a president is not “official” hamstringing a president until the multi-year appeals process takes place

    IMO ACB is not a conservative, but just dressed up in anti-abortion clothing; and Trump fell for it. In ten years she could evolve into RBG, whose seat she took. Trump made a lot of bad appointments in his first term, with this having the longest lasting effect.

    I am with you on ACB always seemed like a centrist pick, eg no spine and risky.

    I was nervous then and still nervous now that she could continue to evolve left over time.

    Elena Kagan is the evil one constantly working to pull the others left. The other two are much too weak in their legal argument skills to command much respect from their peers. They just vote the progressive line.

      ACB reminds me of the kiss ass goddy two shoes from elementary school, you remember the one that tried to be the teacher’s pet? She is playing that role with Roberts

    Merchan could but SCOTUS’s ruling was partially based on Merchan saying he wasn’t going to impose jail time. If he backs out of that now I doubt SCOTUS will react nicely.

Living a farce they call law when ALL of them know the episode is unlawful. This is not like a fumble where the refs let it play out. This is a dark day for law.

Just another scene of how Trump gets on Rushmore, assuming he pulls it off in spite of them.

They could have stayed the matter. There are no other issues, in truth.

Maybe Merchan will stay imposition of sentence pending appeal. But he, like others, are too bent on ruining law out of deranged hatered, even after the people have repudiated their efforts, and the Supremes are allowing THAT to happen.

    Barrett is lost. Roberts was lost before TDS.

    Last time I felt like this was Obama care decision.

    Roberts either intellectually or criminally compromised.

      Me guess is the latter,..the adoption of his two children is suspicious,..a sister, if I remember correctly, claimed they were acquired in a “private adoption” in Central America, where blonde haired blue eyed orphans are a rarity,…Roberts had property interests in Ireland and traveled there but Ireland has a law that only Irish citizens can adopt Irish orphans. If Roberts got his two Irish orphans in Centra; America, the he was involved in human trafficking. I still believe that the fear of that coming out is what pressured him to switch his Obamacare vote,..remember he reportedly wrote what ended up being the dissent, initially as the majority opinion

Something tells me that the sentence will be to rob him of a big chunk of his money.

The Supreme Court can’t in principle fix what in fact depends on conventions not being broken. The law can’t be its own foundation.

If it tries, it sets an illegal precedent, screwing up future law.

The case is a farce to be sure but I think the ruling was the correct one. Trump can and will appeal. In all likely hood win, too

I can actually understand the above statement, when we have a sane judiciary not weaponised by hatred and Democrats.

However the case itself was never an example of a sane case to begin with and in an actual sane world would never have seen the right of day.

And I think this is the problem with AMB and Roberts in their reasoning…what they are saying is absolutely right but that only applies in a justice system that has not been corrupted by Democrats and their hatred of Trump.

We sadly do not live in the world but these two dont want to see that.

The outcome will be weaponised by the left in their attempts at undermining Trump and his administration at every turn these next 4 years.

Justice Roberts often favors procedure of substance. While that may be an admirable quality in lower court judge, the Supreme Court is tasked with making substantive decisions on law.

If Justice Roberts had been Chief Justice in 2000, Al Gore would have become President of the United States.

I say don’t show and put NY on the raider for what they done. Make them pay by cutting funding. We should have a class action suit against NY for hurting our country with this Civil Rights Violation. Maybe $100 fine for Civil Right Violation per Trump Voter. It can be used to fund taking down lawfare.

This is the same court that is unable to identify the abortion case leaker. There is absolutely no way that the leaker is not only known, but provably guilty beyond any doubt. This fairytale was propagated to protect the reputation of the court because one or more justices is complicit.
