Texas AG Paxton Announces Final Victory On Court Order Forcing Biden to Finish Southern Border Wall

Biden’s administration had 60 days to appeal the final injunction issued in May, which it never did, securing the victory for Texas.

Texas Attorney General Ken Paxton announced a court order for President Kamala Harris Joe Biden’s administration to finish the border wall.

Biden issued an executive order to stop the border wall and told DHS to find a way to redirect the $1.4 billion Congress allotted for the wall.

Paxton sued the administration “under the Administrative Procedure Act, arguing that Biden violated the Consolidated Appropriations Act.”

In May, Paxton received a final injunction from Judge Drew Tipton of the United States District Court Southern District of Texas McAllen Division.

Biden’s administration had 60 days to appeal, which it never did, securing the victory for Texas.

“For the reasons stated in this Court’s Memorandum Opinion and Order granting Plaintiffs’ Motion for Preliminary Injunction in part, (Dkt. No. 128), the Court concludes that Plaintiffs have demonstrated success on the merits of their claims brought under the Administrative Procedure Act for violation of the Consolidated Appropriations Act,” Judge Drew Tipton wrote. “Accordingly, the Court concludes that entry of a permanent injunction is appropriate.”

The order told the administration it could not implement any plan to divert funds from their original purpose.

The funds must go to “construction of physical barriers, such as additional walls, fencing, buoys, etc.”

Paxton said: “This is a final victory against Biden’s attempt to defund the border wall. His Administration illegally sought to prevent the construction of the border wall and illegally attempted to repurpose the money allocated for American safety and sovereignty, working instead to keep the border open. I sued and won to stop their unlawful scheme. Now, the Administration has thrown in the towel by declining to appeal their defeat and will be legally required to build the wall.”

In 2021, Texas Gov. Greg Abbott allocated $250 million to build its own wall.

Abbott even demanded Biden return all Texas land the government took for the government wall and give it back to the citizens.

        “Motor voter” laws do not allow for the registration of aliens, let alone illegal ones. Now in too many cases that happens anyway, because people ignore the restriction or claim not to have understood it; the same thing happens in normal registration too. So some aliens, including some illegal ones, do register to vote and are never caught, and if caught usually get away with it because they claim they didn’t understand. But it’s ridiculous to claim that “virtually all” of them make this “mistake” and get away with it.

        The idea that the border was opened with the intent of registering millions of new voters for this election is too ridiculous for words. If the intent was to register people illegally, and have them vote illegally, then why would they bother with actual people at all? It would be far easier to just invent people and register them, and have them send off for postal votes. That way all the ballots come to you, and you have control over the operation.

        No, if there’s an electoral purpose to the open border, it’s long-term. The Democrats are gambling that these people’s future children, when they grow up and register to vote, will vote D. They also plan one day to give these people themselves a “path to citizenship”, which will allow them to register legally and loyally vote D since they’ll remember that the Rs tried to have them deported and are therefore their enemies.

        The impact from this, if it succeeds, will not be seen for at least another 10-15 years, and realistically not for 25 years. And there’s no guarantee it will work out the Ds hope. But as far as this election it’s ridiculous. There is definitely some illegal voting happening, but not on that scale. It’s something Rs should investigate and take to court wherever they can, but keep a sense of proportion.

          Illegal aliens are included in the census, and are helped to determine how congressional seats are allocated. Since electoral college votes are determined by congressional and senate seats, states that encourage illegal aliens to live there are overrepresented in the electoral college.

          #1. Partisan DMV hacks sign them up for it without even telling them. After all, all they have to do is make a check in a box, they don’t need the “registrant’s” participation at all.
          #2. Someone who isn’t even the illegal fills out the forms in the illegal’s name (same way someone who is a campaign worker makes Democrat donations in a random but real citizen’s name).

          I learned this firsthand in 1996, when I registered my wife’s cat as a voter in Cook County, Ill., Norfolk County, Mass., and Cuyahoga County, Ohio, and then requested absentee ballots from all three venues. My purpose wasn’t to cast illegal multiple votes — I think I’ve still got those absentee ballots saved in a file somewhere — but to demonstrate how vulnerable to manipulation America’s election system had become.

          It was a simple scam to pull off. “Under the National Voter Registration Act — the ‘Motor Voter law’ — states are required to accept voter registrations by mail,” I wrote at the time. “No longer can citizens be asked to make a trip to town hall or the county office. No longer do they have to provide proof of residence or citizenship. In fact, they don’t have to exist. Motor Voter obliges election officials to add to the voter list any name mailed in on a properly filled-out registration form. Anyone so registered can then request an absentee ballot — by mail, of course. The system is not only open to manipulation, it invites it.” …

          How fouled up are the voter rolls? So fouled up that in some cities there are more registered voters than there are adults. So fouled up that when the Indianapolis Star investigated Indiana’s records a few years ago, it discovered that hundreds of thousands of names — as many as one-fifth of the total — were “bogus” since the individuals named had moved, died, or gone to prison. So fouled up that when a Louisiana paper filed 25 phony voter-registration forms signed only with an “X,” 21 were approved and added to the voter list.

          Indeed, but that’s not at all the same as the allegation we’re discussing, that those people will be voting.

          And if Republican states are worried about it they can simply encourage infiltrators to move there before the next census. It’s up to them to decide whether this is worth it.

          At any rate even this will have no effect until the 2030 census. And remember that counting them is required by the constitution, so there’s no use complaining about it. Just try to get as many of them as possible deported before 2030. (Bonus: If on census day they’re in ICE camps awaiting deportation, they would count for the states where the camps are, which would presumably be near the border. Bonus for those states!)

          Sure it wouldn’t be legal. Neither is illegal immigration nor harboring them nor running a voter registration process so riddled with holes as to allow for registration of large numbers of folks with fraudulent or impermissible registration. Nor refusing to ‘maintain’ a clean voter registration list by searching for and removing names of those improperly registered.

          This is the problem when we start with X party does Y illegal action then demanding everyone else find a lawful remedy while simultaneously erecting barriers to support such remedy or simply refusing to follow the current statutes. Eventually other folks become cynical, give up on reluctant bureaucracy and ignore those who cry for ‘lawful means’ but have refused to fix the problem. These folks decide to come up with equally creative and equally unlawful answers and fix the problem using means many may not be comfortable with. Not there quite yet but sooner or later the day will come when folks take action. We should all work in good faith to avoid that unpleasant end.

          This makes no sense, and therefore is not happening. As I wrote above, if you want to create fictitious voter registrations, you use fictitious voters. There is no advantage to using people who exist but are ineligible to vote, and have no idea that their names are being used.

          The only reason to use real people in such a scheme is if they are eligible to vote. Then it makes sense to register them without their knowledge, and vote in their names. If anyone ever checks the rolls, they will find nothing untoward, and if the person ever sends in a genuine registration it will just replace the fake one and they will never know that they were already registered.

          It requires no proof, but it does require a sworn statement that the person is a citizen.

          I don’t believe this claim. The writer presents no evidence for it, and I am calling him a liar. To get a driver’s license you need ID, which will generally also show citizenship, so there’s no need to “get inquisitive”. And the form explicitly says only citizens can register.

          No, it would absolutely not. Asking about citizenship is required, and thus cannot be regarded as intimidation.

          Yes, it is easy. But this has nothing to do with motor voter. The cat in question did not have a driver’s license! In fact this demonstrates my point above: if you want to put in fake registrations, you either use fictitious people, or real people who are eligible to vote.           So does any voter registration! It’s got nothing to do with motor voter. And it does not lead to aliens (legal or illegal) being registered en masse. Some aliens do register, but there’s no reason to suppose that they do so in large numbers, and illegal ones are even less likely to register, since they’re trying to hide. It make no sense for there to be an organized Democrat effort to register aliens, especially to register them without their knowledge and vote in their names, therefore that is not happening.

          Henrybowman, indeed immigration laws don’t allow illegal immigration. On the contrary, illegal immigration is illegal precisely because it violates those laws! So you can’t blame illegal immigration on those laws.

          Likewise you can’t blame illegal voter registrations on the motor voter law.

          And remember we are discussing the allegation that the motor voter law is somehow being used to register illegal aliens, in wholesale quantities, so they can all vote in the coming election. That is utterly divorced from any kind of reality. It is just not happening.

      They are receiving voter registration info in some states, so you can’t really say it’s not true apart from having it “mailed” since they don’t have addresses. But go to DMV? No problem.

        Everyone receives info. But they can’t legally register, and the motor voter law doesn’t help them register. Some are undoubtedly registering, but not in huge numbers, and they’re certainly not all registering.

In addition, Abbott also won his court battle against the left’s attempt to stop shipping illegals to sanctuary cities. Our “do-nothing” governor (according to certain know-nothings) has single-handedly brought the whole sanctuary movement to its knees.

      What statute explicitly prohibits it? States can run their elections how they want for the most part. The Federal govt can piggyback on State run elections for Federal office but they gotta go along with State rules on a State by State basis. Alternatively the Feds can set up a separate nationwide election apparatus for Federal offices and run them how Congress directs.

        Federal statute explicitly forbids it. States are required to accept the federal generic voter registration form, as well as the military form, neither of which require proof of citizenship. And they are required to provide voting by mail.

        Both of these are things that the next Congress should fix.

Maybe so, but not on any strict timeframe, and the order conspicuously omits any standard by which it must be built. A flimsy barrier that couldn’t stop a five year old would, albeit maliciously, comply with it.
