Boise State Facing Free Speech Trial After Ousting Pro-Police Coffee Shop

In 2020, Boise State ousted Sara Fendley’s coffee shop from campus after students complained about her support for law enforcement.
Fendley said the school violated her free speech rights. Now they’re going to trial. From The College Fix:
She was forced to close Big City Coffee on Boise State University’s campus in October 2020, as previously reported by The College Fix. She stumbled upon meeting minutes from the Inclusive Excellence Student Council on BSU’s website, where her business was labeled as “anti-Black” and a threat to the safety of students of color.
“Her support of Thin Blue Line began in 2016 when her police officer partner was shot five times in an altercation with an escaped prisoner, causing the loss of his leg and binding him to a wheelchair,” The Fix previously reported. Since then, Fendley has prominently displayed Thin Blue Line flags at her other coffee shop locations, passionately standing by the work of first responders.
“We have survived three motions to dismiss and one for summary judgment from the BSU defense team and they just filed…a motion for reconsideration, and an alternative motion for permissive appeal,” Fendley told The Fix in an email statement recently.
“My hope is that we actually get to trial,” she said. “My legal team has paved a brick road of top-notch legal work to get us this far, and we plan on getting to trial.”
Fendley told The Fix that the upcoming trial will focus on her “First Amendment retaliation claim against Boise state.” The trial is scheduled for this Wednesday, but if it doesn’t proceed, Fendley plans to appeal to the Idaho Supreme Court.

If supporting the police, the folks who enforce the laws their representatives put in place, is “anti-black”, does it mean enforcing the law is anti-black, and that to be “pro-black” one must oppose enforcing laws, letting people run wild?
Do black people in Idaho like not having laws enforced? This could lead people to think that black people violate the law and do not want to be held responsible for the result of that behavior.

Support for police is automatically anti-black, because policemen routinely go around shooting black people for sport, donchaknow, because they think black lives don’t matter. If you pay attention to the news, as reported by the news industry, you are surely aware of that. If you do that you’re also surely aware that parents of black children, no matter how well-behaved they may be, find it necessary to have “the talk” with them, about how when peacefully going about their business they must always fear policemen, and not give them the slightest excuse to beat or kill them, not that they need an excuse anyway. Why, the streets are positively littered with the bodies of innocent black men, all “unarmed”, gunned down by policemen just for looking at them funny. Black people are constantly attending funerals for such victims, which is why they have no time for sports and hobbies and other things white people have the luxury to engage in. Or something like that. It must be true, because the TV people are constantly telling us it. Mustn’t it?

They were told to fear policemen?! That policemen are always looking for an excuse to beat them?!
Or was this “talk” merely that if you should happen for any reason to get in trouble with a cop don’t resist, don’t fight, and definitely don’t reach into your pocket or make sudden movements? That’s surely all the talk any teenager needs, no matter what color he is.
I’m confused. My big city police department does a great job of hiring cops that reflect the racial/gender/etc makeup of the community.

Some people use the term “police” as if it’s an offshoot of the KKK. The black, Asian, Hispanic and gay cops in my city would be very surprised by that claim.

Hatred of the police does not take precedence over the individual’s right to free speech under the Constitution. Let’s hope she receives a huge settlement from Boise State.
