Illegal Aliens Could Face Death Penalty After Test Shows Murdered 12-Year-Old was Sexually Assaulted

Harris County DA Kim Ogg has also received backlash after she blamed America’s broken immigration system.

The Houston Forensic Center confirmed Jocelyn Nungaray, 12, had been sexually assaulted.

Two illegal aliens face murder charges after Nungaray’s body was found in a creek in north Houston:

Johan Jose Martinez Rangel, 22, and Franklin Jose Pena Ramos, 26, are charged with capital murder in Jocelyn’s death. The girl was strangled.

Both men have been arrested, and at last check, remain in jail on $10 million bond.

According to Texas law, because of Jocelyn’s age, both men were not eligible for the death penalty.

However, Harris County District Attorney Kim Ogg said last week that if sexual assault were found, that would make the case death penalty eligible, and the state would then be able to ask for no bond.

Ogg has also received backlash after she blamed America’s broken immigration system.

“They should have never been released when they crossed over into El Paso, but we have a broken system and Jocelyn’s death resulted. And it’s just hard when you know something could have been prevented like a child’s death,” Ogg told KPRC.

Well, state Rep. Briscoe Cain (R-TX) told Fox News that Harris County has become a sanctuary county:

Meanwhile, crime in the county has become a concern for elected local and state officials.

“Harris County has become a sanctuary for criminals, and the blame is not just on the Biden administration, but it’s on the DA’s office,” Texas state Rep. Briscoe Cain, a Republican who lives in Harris County, told Fox News Digital.

Cain also cited local criminal court judges “who have let the world know that Harris County is a safe place for criminals, illegal or legal or otherwise.”

    Yes. In Texas there are nine criteria that make a murder eligible for capital punishment, one of which is that “the person murders an individual under 10 years of age”. Since this victim was 12, the murder was not eligible under that heading.

    But another criterion is that the murder was committed “in the course of committing or attempting to commit kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat”. So now that we know they didn’t just kill her but also raped her, they can be charged with a capital offense.

    (Murder of a victim between 10 and 15 is a special category that counts as “capital murder” for rhetorical purposes but is specifically excluded from an actual capital sentence..

Murdering a 12 year old girl should be quite enough, all by itself, to warrant the death penalty. In fact, any murderer deserves the death penalty. Reciprocity is the foundation of the notion of “fairness”. A murderer forfeits his right to live.

Those who unleashed this animal on us also bear responsibility for this murder. They are accomplices to the crime.

        and the Speaker before him was also super squishy. Always amazing to see Republican super-majorities decide to “power-share” with the Democrats and even let them chair committees. Dems never do that. Not just Texas but states like Louisiana and Missouri too

They will never be executed by the State of Texas. Better a life sentence, no one will bother with endless appeals and being in the general prison population; child rapists and murders will be dead with=in two years.

    agreed … a death sentence is automatically appealed at tax payer expense .. life without parole …
    is just that … and since there has been much press prob on TV as well … they will be well known.
    unless TX ships them to another state to do their time … the population will take care of things.

    You can’t mess with Texas, but Texas alone decides what constitutes a capital crime. Texas law sets out the criteria, and one of them is that the victim is under ten. That alone, with no other factors, makes it eligible for capital punishment. If the victim is over ten then the age alone is not enough and there must be other factors.

They’re eligible for the death penalty even if there is no sexual assault. It’s capital murder either way.
