Massachusetts Court Gives Haitian Illegal Alien Accused of Child Rape $500 Bond

A judge gave a Haitian illegal alien, who came to the U.S. lawfully, accused of raping a 15-year-old girl at a migrant hotel $500 bond.

Not kidding:

Bail for Cory Alvarez was set at $500. If it’s posted, he would be restricted to home confinement with a GPS monitor, his court-appointed lawyer, Brian Kelley, said after a dangerousness hearing Tuesday in Brockton Superior Court.

Alvarez, 26, has been in jail since his arrest March 13. He was indicted by a Superior Court grand jury May 21 and arraigned May 31. He has pleaded not guilty to one count each of aggravated rape of a child with a 10-year age difference and rape of a child by force. Authorities say the alleged crimes occurred at a hotel used as migrant housing in Rockland.

Plymouth County prosecutor Shanan Buckingham said Alvarez should be deemed dangerous and remain in jail. Buckingham suggested a $10,000 cash bail due to the seriousness of the charges with several conditions, including home confinement and a GPS monitor.

To make matters worse, the Massachusetts sanctuary law keeps Alvarez safe from ICE. The court ignored the agency’s request to detain him.

If Alvarez posts the bond and gets a GPS monitor, the state and local officials cannot give ICE any information due to those sanctuary laws.

For some weird reason, Sullivan agreed with Alvarez’s lawyers at the hearings. She cited “his lack of criminal record and the low likelihood he would be able to flee.”

She said the state had not met the “clearand convincing” legal threshold required to deny his bail request.

She agreed with Kelley that there are discrepancies in testimony from witnesses in the case and surveillance video. That includes video showing the 15-year-old entering Alvarez’s room without visible coercion and leaving 8 minutes later with her clothing, hair and demeanor appearing to be the same as when she went into his room.

A rape kit processed at South Shore Hospital the night of police call showed male DNA. Prosecutors plan to seek a DNA sample from Alvarez to be compared with the sample collected from the accuser.

Alvarez came to the country through the CHNV parole program in June 2023.

Bill Melugin reported that Alvarez “flew directly into JFK airport – and was supposed to be with a sponsor in New Jersey, but somehow ended up in a migrant hotel in Rockland, MA, where he was arrested for the rape of the teen girl was and indicted by a grand jury in May.”

The only way of stopping this – short of replacing every elected politician in MA with someone who’s not a retard – is for Congress to pass some kind of legislation that strips personal immunity from civil officers/servants who refuse to cooperate with ICE. If victims like this girl could sue these MA bureaucrats personally, this would eventually stop. I have no idea if what I’m suggesting is even possible, legally. But, I can’t think of anything else that could work.

    Or put in a stipulation to the future funding authorization of every federal program/grant to require cooperation with ICE. A simple majority in Congress and POTUS willing to sign on is all that is really needed. Some university doesn’t want to play nicely…OK no federal grant $, no student loan eligibility at your University. Same for local and State govt.

    It can’t do that.

    Or put in a stipulation to the future funding authorization of every federal program/grant to require cooperation with ICE. A simple majority in Congress and POTUS willing to sign on is all that is really needed.

    It can’t do that either. It can cut funding only if the cut is small enough that it’s not coercive, i.e. if the state can afford to absorb the cut and continue to refuse cooperation. If the cut is so big that the state is compelled to cooperate, it’s unconstitutional.

    Each of us only truly posses the rights we are able to enforce and defend for ourselves….everything else relies on the competence and benevolence of others to enforce and defend them on our behalf.

    Australia maybe a bust if you are looking for liberty, they had some extraordinarily harsh Covid policies for those who didn’t wish to participate in the ‘jab’ cosplay.

    “Fact checking” isn’t really about facts, it’s about echoing leftist propaganda.
    Same as “gun safety” is gun prohibition, “women’s health” is babies’ death, and “equity” is racial and sexual discrimination.

This seems like a crazy process. He was in jail for over two months before anyone but the arresting officers evaluated the evidence? And the first judge to see that evidence lets him out on low bail?

Those can’t both be reasonable.

Either the evidence is crappy and he just spent 79 days in jail on a bad arrest before he finally got in front of a judge, or the evidence is solid and a dangerous criminal is back on the street for low enough bail to guarantee he flees and becomes some other state’s problem.

Not really. It just means local authorities won’t cooperate or hold him for ICE. ICE can still snatch him up if they know where he is. Hopefully they’ll do that at some point.

No, it doesn’t. Nothing prevents ICE from coming and getting him, if it likes. The sanctuary law merely means MA refuses to help. As is its undisputed constitutional right. But it has no right to obstruct ICE, and it doesn’t.
