Zombie Impeachment: Rand Paul Declares Trump Senate Trial “Dead On Arrival” After 45 Senators Vote It’s Unconstitutional
The trial will take place, but with 45 Republican Senators voting it’s illegitimate, there’s no chance of the two-thirds conviction needed.
Senator Rand Paul brought a motion today declaring that the upcoming trial of former president Donald Trump was unconstitutional, because the Senate has no constitutional authority to try a former president.
Paul is completely correct, for reasons we have explained in detail before:

Quite predictably, the motion failed, because Mitt Romney already announced he viewed the trial as constitutional. So Democrats had their 51 votes. Romney was joined in voting against the motion by Collings, Murkowski, Sasse, and Toomey. Mitch McConnell voted with Paul and against the trial.

In this seeming defeat, which is being celebrated by Democrats and the media, Paul actually saw victory because if 45 Republican Senators view the trial as unconstitutional, Democrats cannot get the two-thirds vote they need. They need 17 Republicans, and they have 5.

8:03 AM: The architect of the Capitol declares a watermain break and the building must be evacuated. Leahy declares voting is suspended until the next morning.
3:10 AM following morning: 233,549 votes to convict are added to the tally.
9:00 AM: Leahy declares Trump is convicted with a final vote of 233,489 votes to convict, and 1 to acquit.
9:01 AM: Republicans dispute the results, pointing out there are only 100 members of the US Senate.

Trump in 4 years will have aged 2 years. He’ll still have energy of a man 10 years younger. It’s just in his genes.
This is a question that can only be answered as 2024 approaches. As of now, he has more vigor and energy in his 70s than I had in my 30s. There’s no way of knowing how well he will hold up — I’ve known people in their 90s who (though a bit physically run down) were still operating at full strength mentally, and quite capable of doing the job. As long as Trump is functional, he’s the man.
I don’t believe he would attempt it if he declines enough not to be able to perform at a high level. I don’t see him doing a Biden — he wouldn’t want to be in the position unless he was the driving force.
So far no down votes. I was thinking the same thing, Trump has tremendous energy compared to an age-peer like Biden, but we’ve all seen how quickly that can leave a man.

Chief Justice Roberts will NOT be participating in this sham.

Even were it not Un-Constitutional to impeach a private citizen, the fact that the Chief Justice will not be presiding at this “trial” makes the entire proceeding blatantly Un-Constitutional.

Question: Since the Left, abetted by 5 Republican turncoats, are ignoring the plain text of the Constitution by going forward with this “impeachment” what’s to prevent them from declaring that only a majority vote is required to convict Trump. They will surely find a slew of legal scholars to support that position. Welcome to the Twilight Zone.

The Senate has no authority to impose any kind of punishment even if they did get 2/3’s of the votes beyond removal from office, so what they’ll do is make some kind of meaningless proclamation. Biden could try to get his DOJ to prosecute Trump for “insurrection” in hopes of getting a conviction – and causing a real insurrection (which is a government term for revolution) by doing so.
Republicans should reinforce the sham nature of this by minimal participation in the process. When it is their time to speak or to levy questions, they shield say “I do not yield back my time (for Democrat use), but I discharge it without comment.” This would halve the process and get to the vote. Trump should not have anyone there, no lawyers, no presence at all. Leave it as what it obviously is: an unconstitutional, partisan, shell of a trial.
The only positive things I see in this farce is while they are wasting time on this they are not doing something worse legislatively and they are showing the voters what asses they are.
