Michigan Supreme Court Throws Out Order Saying Barber Karl Manke had to Close Shop
“It is incumbent on the courts to ensure decisions are made according to the rule of law, not hysteria.”
The Michigan Supreme Court threw out the order forcing barber Karl Manke to close during the Wuhan coronavirus pandemic.
Michigan Gov. Gretchen Whitmer threw down her iron fist and shut down basically everything in the state.
Manke, 77, needed to work to make a living. He reopened his shop on May 4 but almost immediately faced a backlash from the government.
The Court of Appeals voted 2-1 to shutdown Manke “had to cease his operations.” Then the majority of the court ordered a Shiawassee County circuit court judge to tell Manke to close his business, who agreed Manke’s shop “shall be locked and closed.”
The government even suspended Manke’s license.
The court claimed “the state appeals court made mistakes in its decision to shut down” Manke’s barbershop:
The appeals decision was not unanimous and did not afford Manke oral arguments to defend himself, the court said.

Manke participated in a haircut protest on the steps of the capital in Lansing. Many people showed up to the event.
People have blasted those at the protest because they just wanted haircuts. No, they were there to show support for the stylists who just wanted to open their business and work.

No, they didn’t rule against Whitmer. Nor does this ruling have anything to do with the merits. They ruled only against the court of appeals, saying WTF are you doing, guys, you can’t make a peremptory reversal order unless you’re unanimous, you can’t decide constitutional issues of first impression without a proper hearing and giving this guy and others a chance to be heard, and you can’t let the government argue these points when they didn’t address them in the trial court.
Oh, and you also can’t order the trial court to issue this guy an order on threat of contempt while he’s got an appeal going in front of us. Not without our say-so.
Meanwhile all the brave, brave (so brave) barbers here in Pennsylvania listen to wolf and are all still closed.
Are there any grounds to challenge his order? The issues in Michigan are mostly questions of state law, and this order doesn’t even address those. This is purely a procedural order.
In Michigan, she allowed dentist to reopen but delay salons for 2 weeks. Talk about arbitrary. Oh wait, her current husband is a dentist.

What right does she have telling barbers and hairstylists that they have to starve and lose their businesses, while she’s out breaking all her own rules to do her political virtue-signaling?
Either she was wrong to close down all those businesses, or she was wrong to encourage the protests. She can’t have it both ways.

She did my hair cut that day. Heard the news on my way to his shop the appeals idiots had ruled with the usual democrat stupidity. So I sped a little faster so if the state cops showed up they could arrest me too.
Karl had a couple guys protecting the ladies back there, but they had grit and tons of courage. Kudos ladies, you were great also.
