The FBI has sent over some of the classified documents and notes from their untaped interview for their Hillary Clinton investigation to the House Oversight Committee in order to understand why Director James Comey did not recommend charges against her. However, Oversight Chairman Jason Chaffetz said the FBI heavily redacted the majority of the documents:
“As the chairman of the chief investigative body in the House, it is significant I can’t even read these documents in their entirety,” Rep. Jason Chaffetz of Utah told Fox News. “This shows how dangerous it was to have this intelligence, highly classified to this day, on the former secretary’s unsecured personal server where it was vulnerable.”
The committee will tightly control possession of the documents since the government has labeled them as secret or classified. They confirmed they received the documents:
“The FBI has turned over a ‘number of documents’ related to their investigation of former Secretary Clinton’s use of a personal email server. Committee staff is currently reviewing the information that is classified SECRET. There are no further details at this time,” said an Oversight spokesman.The committee is currently reviewing the information in them, which was classified as “secret.”
But the redactions and secrecy with the documents contradict Clinton’s claims that she did not mishandle classified and secret information. The delivery “includes an investigative summary from the FBI’s probe of Clinton; reports known as ‘302s’ containing interviews with the Democratic presidential nominee and others; and classified emails found on her private server.” The FBI did confirm that Clinton sent and received 113 classified emails and they categorized over 2,000 as “classified after the fact.” From Fox News:
“This information being highly classified according to the FBI is in direct conflict with what the State Department and Ms. Clinton have said is on the server. You could not have it both ways,” former military intelligence officer Tony Shaffer said. “You cannot say one day this is unclassified ‘nothing to see here’ and the next day, only certain people can see this and you must not be able to take it outside of a secure facility.”
Yet documents sent to Senate Judiciary Committee Chair Charles E. Grassley (R-IA) did not have many redactions:
But Grassley (R-Iowa) said in a statement “it seems that much of the material given to the Senate today, other than copies of the large number of emails on Secretary Clinton’s server containing classified information, is marked ‘unclassified/for official use.’”“The FBI should make as much of the material available as possible,” Grassley said. “The public’s business ought to be public, with few exceptions. The people’s interest would be served in seeing the documents that are unclassified. The FBI has made public statements in describing its handling of the case, so sharing documents in support of those statements wherever appropriate would make sense. Right now, the public is at a disadvantage and has only part of the story.”
The FBI said:
“The FBI is providing certain relevant materials to appropriate congressional committees to assist them in their oversight responsibilities in this matter,” said FBI spokeswoman Carol Cratty. “The material contains classified and other sensitive information and is being provided with the expectation it will not be disseminated or disclosed” unless the agency agrees.
In July, the FBI recommended the Department of Justice not press charges against Hillary even though they found her and her staff were “extremely careless” using her private server:
Comey said that “no reasonable prosecutor” would bring such a case despite “evidence of of potential violations of the statutes regarding the handling of classified information.” He added that Clinton and her staffers were “extremely careless” in their “handling of very sensitive, highly classified information.”
Judicial Watch has also announced the State Department will hand over to them “all emails sent or received by former Secretary of State Hillary Clinton that were uncovered by the FBI in its investigation.” Clinton did not provide this entire disc of documents to the State in December 2014, but the FBI managed to unearth them. The emails fall between February 2, 2009 to January 13, 2013.
