California Anti-Israel Protester Only Gets One-Year Sentence in Death of Elderly Man

Following the October 7th attacks in Israel in 2023, an elderly man in California was killed when an anti-Israel protester hit him in the head with a megaphone. The victim fell to the ground and hit his head. It’s a horrible story from every angle.

The protester who was charged with the man’s death was just allowed to plead guilty to involuntary manslaughter in exchange for a ridiculous plea deal that includes a sentence of one year in prison followed by probation.

Moorpark man changes plea in case of protester’s death

Two years after a pro-Palestine rally in Thousand Oaks made international headlines with the death of a counter-protester, the man accused in the death has pleaded guilty to involuntary manslaughter and battery with serious bodily injury.

Paul Kessler, a 69-year-old Thousand Oaks resident and pro-Israel protester, died less than a day after he was injured in a Nov. 5, 2023 confrontation with Loay Alnaji, a 54-year-old Moorpark resident.

Alnaji had joined other pro-Palestinian protesters at the corner of Thousand Oaks and Westlake boulevards, which had become a regular site for rallies in the weeks after Hamas’ deadly attack on Israel and Israel’s deadly response.

Alnaji initially pleaded not guilty to the two charges, and his jury trial was scheduled for May 14.

On May 5, however, Ventura County Superior Court Judge Derek Malan offered the defendant probation if he changed his plea. Alnaji now faces a maximum sentence of one year in jail followed by three years on probation.

Defense attorney Ron Bamieh said the offer came after several meetings with Malan and recalled that the judge determined “two old guys had a dispute and and an accident happened.”

“In light of the potential consequences entering a trial and what could happen, we decided that the best course of action is to accept a probation offer and plead guilty today,” Bamieh told The Star outside of the courtroom.

Senior Deputy District Attorney David Russell said both the Ventura County District Attorney’s Office and Kessler’s family opposed the judge’s offer and instead requested the maximum possible sentence of four years in state prison.

“This is over the people’s objection,” Russell told Malan.

Bamieh said that during the protest, Kessler aggressively put his cell phone in Alnaji’s face and when Alnaji swatted the phone away, he unintentionally hit Kessler’s face with a megaphone. Bamieh said Kessler had a brain tumor, which exacerbated the injuries when he fell.

Jennifer Van Laar of RedState adds this:

Loay Alnaji has pled guilty to 1 count of involuntary manslaughter, 1 felony count of battery causing serious bodily injury in the death of Paul Kessler, w/serious felony enhancement and aggravating factors of weapons use and vulnerable victim for both counts.

Alnaji, a Muslim community college professor in Ventura County, CA, killed Kessler, a Jewish man, during protests/counterprotests immediately following Hamas’ October 7 attacks.

Alnaji, a naturalized citizen from Jordan, was set to go to trial on May 14, but appeared this morning in Ventura County Superior Court to plead guilty to all charges.

    This ultimately becomes the more powerful form of deterrence when fear of the legal system disappears. While everyone claims distaste of vigilante justice, many still believe that at least it is justice.

      Civil courts in California, to be kind about it, are as big a joke as the criminal courts.

    I believe the prosecuting attorney was prepared to go to trial and the judge offered the plea, not the DA. The DA was opposed to the plea.

    As we have seen in Minnesota and elsewhere it is the judges that are the issue.

What is 1 Jew’s life worth in CA? Well now we know. At the most 1 year in jail and probably not even that.

I wonder if I walked up to this guy on the street and bludgeoned him to death what my sentence would be? I suspect CA would either bring back the death penalty just to execute me or allow me to be extradited to the muslim’s home country (yes I know extradition is federal not state).

Who am I kidding. if I bludgeoned this muslim I’d be held without bail and likely shanked in jail.

That seems incredibly weak. Not sure about CA but in Alabama we have specific statutes to ‘protect’ the elderly, women and children. There’s a legal presumption that they are more ‘vulnerable’ than adult men. This would seem to fit (at minimum) our 2nd degree felony for ‘elder abuse’ intentionally/recklessly harm elder causing serious injury sentence is 2 to 20 years. If they brought 1st degree charges he’d face 10 years to life.

      It’s not even so much “on the right side” as “requiring work from prosecutors if he doesn’t accept.” I think most plea deals are more laziness/avoiding overwork then they are ideological.

Was this perp’s sentence within the normal range?

Was it outrageously short when compared to others?

Here (according to Brave AI) is the sentencing for involuntary manslaughter:

Under California Penal Code § 192(a), voluntary manslaughter is a felony punishable by 3, 6, or 11 years in state prison. Alternatively, the court may grant probation with up to 1 year in county jail.

    If I were ‘king’ we’d resolve the issues of repeat offenders by setting not just mandatory minimum but requiring the remainder of max sentence range that wasn’t imposed be ‘suspended’ and served as probation. Example get a conviction for a crime with a 2 to 20 year range with a sentence of 5 years incarceration. Dude gonna do five that years and then serve probation for the remaining 15 of the potential 20 years but as a ‘suspended’ sentence which in effect would mean any parole violation sends him immediately back to prison for 15 years plus any additional time for whatever new crime he committed.

I believe this article is mistitled. Alnaji has not gotten a 1 year sentence, rather he avoided 4 years in state prison for his crimes by offering a plea deal, and while he does risk the possibility of up to 1 year in jail, it’s entirely possible he’ll skate with probation being the only real ‘punishment’.

Some are asking what the judge’s response would’ve been had it been a Jewish man who accidentally killed a Muslim.

I believe the final sentencing is in late June no?

As I understand it this has not happened yet. He suddenly changed his plea to guilty, and his lawyer said the judge had offered the deal, while the prosecutor said he was blindsided by it and did not agree. That doesn’t seem lawful to me, so I suspect there’s more going on than was reported. In any case the sentencing hasn’t happened yet, and the news reports seem to be based just on what the defense lawyer claims.
