WI Judge Hannah Dugan Convicted Of Helping Illegal Evade ICE Denied New Trial

Wisconsin state court Judge Hannah Dugan was charged with helping an illegal alien Eduardo Flores-Ruiz evade ICE by directing him out a back exit from her courtroom.
We have covered the case extensively since the beginning.
She was convicted by a jury in federal court and awaits sentencing. Dugan filed post-verdict motions, including for a judgment of acquittal or alternatively a new trial
In an Order today federal court judge Lynn Adelman (a Clinton nominee) denied the motions, The judge rejected various legal arguments most of which already had been ruled upon in pre-trial motions (such as Judge Dugan’s supposed immunity):
After surveying the caselaw, I concluded that there is no general rule of criminal immunity for judges, nor was there a basis for granting immunity simply because some of the allegations in the indictment described conduct that could be considered “part of a judge’s job.” (R. 48 at 21.)….
As I had noted in denying defendant’s motion to dismiss, there was no basis for granting immunity simply because some of the allegations in the indictment describe conduct that could be considered part of a judge’s job. (R. 72 at 13.)
The judge found the evidence sufficient to support the verdict:
Viewing “the totality of the evidence that the government presented in this case, it is sufficient to provide a rational basis upon which a jury could find guilt beyond a reasonable doubt.” United States v. Tinsley, 62 F.4th 376, 388 (7th Cir. 2023) (cleaned up). The government demonstrated that on April 18, 2025, agents arrived at the Milwaukee County Courthouse to arrest Flores-Ruiz pursuant to an administrative warrant (Tr. at 54, 245, 247-48, 12315, 355, 398, 533), a step in his pending removal proceeding (Tr. at 210-23, 414-18, 525-27).7 The government further demonstrated that defendant was made aware of ICE’s presence and the administrative warrant. (Tr. at 403, 450-51, 456; Ex. 42.) The government showed that defendant then engaged in a course of conduct that had the natural and probable effect of wrongfully obstructing the proceeding, including clearing the agents from the public hallway (Tr. at 105, 259, 322, 365, 368), stating that they needed a judicial warrant to make the arrest (Tr. at 457),8 rushing Flores-Ruiz’s case through while the agents were in the chief judge’s office (Tr. at 540; Ex. 42), and ushering him out the jury door into the restricted hallway with the apparent intention that he go “down the stairs” to the fifth floor, rather than out the “wrong door” into the public hallway where the agents were (Tr. at 118, 762-67).9 Finally, the government presented evidence that defendant acted wrongfully, including her statements that “I’ll do it. I’ll get the heat” (Tr. at 119, 765), and “I’m in the doghouse with Carl for trying to help that guy.(Tr. at 474-75).10
Of course, Dugan plans to appeal, according to her lawyers:
“We continue to maintain that Hannah Dugan acted lawfully and within her independent authority as a judge. The inconsistent jury verdicts demonstrate that the trial proceedings were flawed, and we plan to appeal.”

A welcome, but still admittedly rare occasion when the Dhimmi-crat Party membership card didn’t confer special treatment and leniency, upon its bearer.
She was too obvious in her actions. It sullied the rest of her fellow black gowned travelers.

And, even if she ultimately exhausts all appeals and still loses, she likely won’t spend a single day in jail.
On the plus side she will never be a judge again.
One can hope. She is only a (D) pardon away.
That would be because helping criminals elude law enforcement is no part of any judges job.
Yes, but the conduct itself could, under other circumstances, be considered part of her job, so she argued that she had absolute immunity for any such conduct, whether or not it actually was part of her job in this instance. That’s the argument the judge rejected.

Jail? For a Judge? Nah. I think about 48 months of community service in downtown Detroit would be good. I mean, it’s not that I really believe that a death-sentence is warranted here, But… hey, close enough.

If it had been the judge’s job to take defendants to Diary Queen and the judge did so, but did so with the purpose of helping the subject evade law enforcement, that’s illegal. Illegal acts shouldn’t be excused for merely appearing identical to official acts. State of mind (guilt) and intent matters. The totality of the government’s case against the judge demonstrated these factors were in play.

It will be interesting to see how her lawyers frame her ordering ICE agents in a public hallway to get a judicial warrant which they don’t need in order to send them on a wild goose chase and then instructing the illegal alien to use the back door to escape as part of her lawful and official duties as a judge. The fact she told someone else she would take the heat for her actions tells me she knew what she did wasn’t on the up and up.

She never intended to ACTUALLY ‘take the heat’.
When she said that, she thought ‘the heat’ was going to be her laughing at the stupid feds that thought they could enforce the law from behind the safety of her sacred black robe.
If she actually believed for one second she was going to be convicted she wouldn’t have done it.
No different from the AWFLs screaming in the faces of ICE agents. They don’t actually believe for ONE SECOND they are in real danger.

IMHO, her actions (and those of many other politicos) fall under the category of insurrection against the USA. And I have it on good authority that being insurrection-y against the USA is bad.
It’s insurrection by reason of giving aid & comfort, conspiracy to commit, aiding & abetting millions of foreigners who invaded our nation.
LE is attempting to hurl back this invasion by using tools given to them by a congress duly elected by we the people, and signed into law by a potus duly elected by we the people.
If those insurrection-y politicos (and their army of street thugs) don’t like those laws, they should work to change them.
But ignoring them, or subverting them, or conspiring against them in order to harrass, interfere, or attack LE is insurrection, and should be punished accordingly.

Highly doubtful. Adelman is a known libby, 20 years as a demorat in the WI legislature.
Appointed judge in 1997 (he’s 86).
In 2011 he tired to take down WI’s voter ID law. Was scolded beautifully by an appeals court.
However, it is very surprising that he could not find a weasel way to let Dugan off scott-free.
This will impact her modeling career for sure.
