Habba Charges NJ Democrat Congresswoman With Assault After ICE Facility Confrontation
Body camera appeared to show Rep. LaMonica McIver (D-NJ) shoving an ICE agent.

Alina Habba, the interim U.S. attorney for the District of New Jersey, announced charges against Rep. LaMonica McIver (D-NJ) for violating Title 18, United States Code, Section 111(a)(1) for assaulting, impeding, and interfering with law enforcement.

Reps. Rob Menendez Jr., Bonnie Watson Coleman, McIver, and Newark Mayor Ras Baraka stormed the ICE detention facility in Newark, NJ, on May 9.
The facility holds alleged violent criminals, such as MS-13 gang members and child rapists.
The representatives claimed they had a duty to inspect and have oversight of the facility.
Coleman tried to deny the representatives did anything but remain calm, cool, and collected.
DHS fired back, “Let’s check the tape.”

charges against Newark mayor dropped. Pity. I would have liked to have seen him charged because he said they were targeting him.
Seems like charges against the other 2 congressmen were dropped but I’m not positive. The angry black fat woman congressman charged was the one that got violent with the guards. Perhaps that’s why she was one the one charged.
Why was the misdemeanor charge against the mayor dropped?
You’re a prosecutor. Which would you prefer? Some loser mayor on a misdemeanor charge or some big fat congress critter on multiple felony charges?
Both.
Because he is a black Democrat. We all know that there is a two tiered justice system, even under the Trump Administration. His choices of Bondi, Patel, and Bongino for the top level law enforcement are similar to his choice of AG during his last administration.
This wait and see attitude and the constant drum beat of drawn out investigations is horrid.
Democrats are given a free pass while conservatives languished in jail for years.
I heard he was inside and shouldn’t have been inside, but when told to leave he peacefully left with no BS. Not much there. To be honest from what I see, the other charge is weak too.
Actually it was racism. (Nay as we’ll get that out of the way…)
The mayor is very angry the charges were dropped as he was hoping to ride the publicity into the Governor’s office. Look for him to be in front of cameras demanding to be charged and following the cops around with his hands behind his back like AOC
The charges against McIver will also be dropped
Or “plea bargained” down to a week’s probation.

Well, well. Will wonders never cease.
The mayor should have been charged too, but this is at least a start.
She’ll probably plead out, but I would love to see her perp walked and convicted of a felony.
But she will not be run out of Congress like republicans are.
And that has nothing to do with Bondi, Patel, or Trump. As you should be honest enough to acknowledge.
Take that one up with Congress.
It does have something to do with our top tier law enforcement.
Obama and Biden’s group didn’t hesitate to persecute, incarcerate and harass conservatives, yet the current group sits on their hands and promises the never ending “we’re working on it, just wait and see.” We’ve seen and heard that time and again.
I hope for their success to do the right thing, and I hope that the same level of accountability goes toward the left. But I haven’t seen it as of yet.
It doesn’t even have anything to do with the Republicans in Congress. They don’t have the power to expel her without at least a third of the Democrats, and they’ll all vote against it. To them she’s a hero. Unless she’s convicted, maybe then there’d be the votes to expel her.
Oversight does not require pushing and shoving. The mayor and congress critters just had to request a walk through and it would easily have been arranged. These folks were just looking to make a splash. FAFO, I hope!
The mayor was not entitled to visit that facility. Members of congress, yes, in their oversight capacity as well as members of their staff if pre-arranged. They don’t allow admittance to the General Public and the mayor of Newark holds no importance that anyone at ice gives a crap about. In fact, he’s kind of the enemy
The ultimate schadenfreude FAFO is when idiots think they are somehow above the law in a physical sense.
Far better to cooperate even on questionable interactions with LEO. The old saying that ‘you might be beat the charge but you can’t beat the ride’ (to jail) still holds true for most part. Once a LEO says someone is going to jail they are gonna do whatever it takes to make that happen.
In a just world, politicos who assault LEO should receive jail time, harsh fines, and expulsion from congress, but this is not a just world.
More than likely, Rep. Bish(D) will receive a strongly worded letter, then use this incident to fund raise, and be re-elected.
The voters are the problem.
Another camera shows her straight up punching an agent in the face.
And meanwhile that weak loser Johnson is still ‘evaluating’ whether they should ‘censure’ her.
Johnson won’t censure or schedule a vote to remove her from Congress until she is convicted of a crime or pleads to one.
He won’t do it even then
I’d put money on it.
Yes, he will. If she’s convicted and doesn’t resign, there might even be enough Democrats voting to expel her.
Not a chance, and you know it. (D), Black, Female (of size). I would bet not much more than half the GOP would have the spine and zero Democrats.
Never come to a vote.
I wish I could smoke some of that hopeium you got there, Mil, but I can’t; too jaded.
The far-left want a pretext to riot, this could be it
I like the “I dinna do nuthin” defense when there is tape and then insisting the tape is fake or something.
It seems pretty darn clear and if so, she should be thrown out of Congress. Since she has been charged with a crime for assaulting a federal officer she should immediately be suspended from all Congressional duties and removed from any committee’s pending the outcome.
This is why I was strongly in support of body cams for officers. Many complained that it would hinder officers work. The left demanded it, as they had demanded DNA evidence in the past. Both forms of evidence would “free” falsely convicted folks. But it convicted MANY more as does the body cams.
Seems to be legit charge for Rep McIver. As th Mayor was being arrested she and Rep Coleman can be seen to grab/hug the Mayor in an attempt to prevent LEO from placing him into cuffs. McIver then uses her body to push into LEO then shove and strike multiple LEO as they move the Mayor inside the fence and away from the mob outside. Very common tactic of the wokiestas when trying to impede/obstruct an arrest. She had to be physically restrained by Rep Menendez as he grabbed her from behind in a hug and seems to have lifted.her off the ground to stop her assaults. These actions are not protected speech nor serve any lawful purpose and sure as heck ain’t ‘oversight’.
It is reported that the NY Giants are looking to sign her up to bolster their defensive line.
if you leave all the oversight/secure facility/serving congress members, etc out of it and just view the video evidence, this was an assault on federal officers–ray charles could have seen that she’s guilty–no question
defense:
its a cultural thing
and you cant understand
and its your white patriarchal system that demands civility
anyone else remember the african american statement put out 4 years back where being ambitious and proper etc was deened racist!!??
I keep thinking that looks like disorderly conduct, a misdemeanor not a felony. But times have changed.
Absolutely 1000% this level of forceful contact would have resulted in a felony Sec. 111(a) charge in connection with Jan6 defendants.
That is “assault” on a federal officer under the definition of “assault” used by the Biden DOJ.
Convictions of hundreds of J6 defendants were based on nothing more than video evidence just like this.
There is no question but that this must be charged.
It could be “aggravated assault” in that it was committed with the intent to commit another crime — entry into the ICE facility. Depending on the facts, it is possible that is a separate felony.
If so, she will be facing 3-5 years in federal prison.
Play stupid games, win stupid prizes.
There is NO justification for not charging her.
The “justification” is that the Left and their allies consider themselves above the law and so far have gotten away with it with the aid of the GOPe.

No, she has a legal right to enter the facility whenever she likes, at any time of day or night, with no advance notice, so long as she says the magic word “oversight”. And as I understand it she and the other congressmen were being admitted without incident, but the mayor was not, and that’s what the fight was about.
So she was trying to break the mayor in to the facility, so maybe you can use that as the “other crime”, but she herself had the right to enter. She did not have the right to hit anyone, except in self-defense or defense of others. And since the mayor had no right of entry, the officers were entitled to use reasonable force to prevent his entry, and so long as the force they used was reasonable she had no right to “come to his defense”.
I guess so. We have become an uncivil society and we should stop pretending otherwise. We did not start this war, but it is a war.
In the old days, what I saw in the pictures would maybe be “disorderly conduct”.
The case against McIver looks weak by traditional standards to me. For one thing it’s an information not an indictment. They probably could not obtain an indictment.
Look at the photos. She pushed a little. I was at Rockefeller Center in the Christmas crowd, and I saw shoving about like that. She might have just been off-balance. Maybe there’s more in testimony to come. That’s presumably why they allow charges based on an information with no indictment.
(Actually I don’t understand this process. George Zimmerman was charged with Murder 1 on an information since all they could possibly get from a GJ was Murder 2, and maybe not that from any actual GJ. If you can indict a ham sandwich, for an information you don’t even need the ham or one of the pieces of bread.)
I guess we can fight back with the same sort of garbage they threw at the J6 people. Not sure how I feel about it, but since if they get back in power they won’t improve, we might as well go for their people too.
