President Donald Trump pardoned 23 pro-life protesters who allegedly violated the Freedom of Access to Clinic Entrances (FACE) Act.
Trump said they should not have been prosecuted:
WILL SCHARF, ASSISTANT TO THE PRESIDENT AND WHITE HOUSE STAFF SECRETARY: A set of pardons for peaceful pro-life protesters who were prosecuted by the Biden administration for exercising their First Amendment Rights.
TRUMP: Do you know how many?
SCHARF: I believe it’s 23, Sir.
TRUMP: 23 people were prosecuted. They should not have been prosecuted. Many of them are elderly people. They should not have been prosecuted.

Those who were imprisoned over the D.C. protest include Lauren Handy (57 months in prison), John Hinshaw (21 months), William Goodman (27 months), Jonathan Darnell (34 months), Herb Geraghty (27 months), Jean Marshall (24 months), Joan Bell (27 months), Paulette Harlow (24 months), and Heather Idoni (24 months).
In Tennessee, a group of pro-life Christians gathered in a hall outside the Carafem Health Center in Mt. Juliet where they sang hymns, prayed, and urged women not to get abortion in March 2021. Calvin Zastrow, 63, is currently serving a six month prison sentence over the protest and 75-year-old Chester Gallagher was sentenced to 16 months though he has not had to report to prison yet.
In New York, Bevelyn Beatty Williams was sentenced to serve 41 months in prison after she was convicted of violating the FACE Act after she blocked the entrance to an abortion facility in Manhattan.

Good thing it isn’t actually up to the Judges. A pardon means it never existed, so there is nothing for them to apply that opinion.
Yes, but they were not pardoned. Therefore the crime still exists, and a future administration may decide to prosecute them, so long as the statute has not run.
This is why a couple of weeks ago I wrote that Trump should direct his pardon at everyone involved in the event, known or unknown, except those who were employed in any capacity by the FBI, CIA, or Capitol Police, and except those who were present at any riot between 2017 and 2020. That would have included these defendants.
This is an opportunity to remind people that Judges don’t have to commit a crime to get Impeached. Instead, they only hold their offices during ‘periods of good behavior.’ I don’t think you can find worse behavior than Ignoring duly-enacted presidential pardons . The House should Impeach these deadbeats today.

If you mean judges Howell and Chutkan, they are both entitled to act as they have done. They dismissed the charges, as the prosecution requested. They are not required to do so with prejudice, and they are entitled to pontificate from the bench and express their private opinions, no matter how wrong they are. Indeed that is one of the great privileges of a judge; you can give a speech to a captive audience, and they must listen with respect even if they think you’re saying the most ridiculous nonsense.

Regarding the actual topic of this post, the people pardoned were not prosecuted for exercising their first amendment rights. There is no right to block access to someone’s property, no matter how strongly you object to what is going on there. It doesn’t matter whether you’re a union picketer blocking the entrance to a work site, an antifa protester blocking a highway, or a segregationist blocking the school doors. The first amendment protects your right to express your opinion, but not to block traffic while doing so.
If I were the judge in these people’s cases I would have sentenced them to spend the rest of the day in the courthouse lockup, and a few months of community service, which they could serve at a pro-life pregnancy center, or at a church.
Question for the attorneys on this site. Is there any protection for Federal Judges from state prosecutions. For instance, say a DA in Florida found evidence of financial fraud, kiddie porn, or illegal drug possession (more than a small quantity of pain pills with no prescription) while the judge is vacationing in that state. Would there be any barrier to prosecution or incarceration if found guilty?
If there is no barrier then red state law enforcement and DAs should closely monitor any sign of illegal activity engaged in by any of these judges that vacation or own properties in their states.
Why would you suspect that they’re doing anything wrong?
