President-elect Donald Trump picked Todd Blanche to serve as Deputy Attorney General.
Blanche represented Trump during his “hush money” case in New York.

Unfortunately, the hush money case led to a guilty verdict for Trump.
Blanche, a realist, said that the team expected guilty verdicts. Anyone with a brain could not take that case seriously at all.

18 U.S. Code § 2387 – Activities affecting armed forces generally
(a)Whoever, with intent to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States:
(1) advises, counsels, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States;
Shall be fined under this title or imprisoned not more than ten years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.
As written, that’s unconstitutional. The courts would take care to read it in a more limited manner in order to preserve its constitutionality. Arresting Bash for what he said (even if he had advocated that they disobey lawful orders, which he didn’t) would definitely be illegal.
Nope. It’s entirely Constitutional and is spelled out in Article 3 Section 3.
“Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the testimony of two Witnesses to the same overt Act, or on Confession in open Court.”
In writing this section The Founding Fathers explicitly relied on the English definition from 1351 given by King Edward III (this is also one of the oldest statutes still in force in England). As A.J. SCOTUS Joseph Story explained in “Commentaries on The Constitution of the United States”:
“…they have adopted the very words of the Statute of Treason of Edward the Third; and thus by implication, in order to cut off at once all chances of arbitrary constructions, they have recognized the well-settled interpretation of these phrases in the administration of criminal law, which has prevailed for ages.”
In the language of that time “…levying war…” meant not only actual war, aiding and comforting the enemy etc… but also attempting to influence others from following the law. As Commander in Chief of the Armed Forces, Trumps word or orders are “law” to the military. Refusing to follow them or inciting others to disobey lawful orders, slow walk them or just ignore them is Treason.
Wrong. Levying war means what it says. It cannot involve mere speech. In addition, conviction requires witnesses to an overt act, so if there is no overt act you can’t have witnesses to it.
Remember the treason clause is also subject to the first amendment.
Even urging a soldier to desert is protected speech, as Lincoln complained bitterly, that he must hang the young deserter but can’t touch the adult who gave him the idea.
What he said was that the military should disobey illegal orders, which is in fact their duty. So no surprise there; of course they would do so, if they got an illegal order, but of course they won’t.
And he said that if Trump tries to politicize the CIA (ha, ha!) then the CIA officers should resist. That’s much more problematic, besides the fact that it can’t get any more political than it already is; the CIA is part of the executive branch, and thus has no authority other than that of the president. Its officers have no independent authority to anything, no matter how much they may honestly believe it to be in the USA’s interest. If they get concerned about their orders (as they should have been concerned over the last 8 years and more that they’ve operated as a tool of the Dem party), then they should resign and blow the whistle.

Every member of the military is trained to know that he has a duty to refuse illegal orders. If he believes an order to be illegal he should get legal advice. Trump’s election hasn’t changed that.
