It appears that rumors of Trump’s imminent arrest may have been greatly exaggerated.
On Saturday, Trump posted the following to his Truth Social account:
However, his attorney has confirmed that Trump’s legal team has received no word from the DA regarding an arrest, let alone a specific day for the arrest.
Donald Trump said he expects to turn himself in on Tuesday in the Manhattan district attorney’s hush-money case — a date his own lead defense attorney could not confirm.
Lead defense attorney Susan Necheles said the Trump defense team had received no information from the DA’s office that Trump would be “arrested” — his word — on Tuesday or on any other specific day, though she was careful not to directly contradict her clients’ Truth Social post.
“President Trump is basing this on press reports,” Necheles told Insider of the Tuesday date.
“This is a political prosecution and the DA leaks things to the press instead of communicating to the lawyers as they should,” Necheles said.
Necheles did not specify which “press report” Trump might be looking at. There has been no reporting of a specific date for Trump to surrender to Manhattan authorities.
She could not confirm if Trump was referring to a Fox News report from Friday. The report said that the district attorney’s office ‘asked for a meeting’ with law enforcement, in order to plan for an indictment that a court source told Fox “they are anticipating” next week.
Apparently, the DA is not in regular contact with Trump’s team, which she notes is abnormal.

“In normal, run-of-the-mill cases, they’ll be talking to us about what date they expect to turn in an indictment. They’ll be saying ‘we’ll let you know,'” she added. “That’s the normal conversation you would have with prosecutors.”
There may be a reason for this silence (in addition to the partisan one):
The Manhattan grand jury has been hearing witness testimony since mid-January, including on Monday and Wednesday from Trump’s ex-lawyer Michael Cohen, a star witness in the prosecution’s case.
But there are no credible accounts to emerge publicly that the grand jury has voted to indict Trump or anyone else, a necessary first step that would then lead the DA to contact Trump’s attorneys and negotiate his surrender and arraignment.

Even if there is an indictment, there will be no arrest, no dawn raid, no CNN cameras, no perp walk. Trump’s legal team has stated that he will surrender to face charges.
Former President Donald Trump will surrender to face criminal charges if indicted by a Manhattan grand jury, his lawyer said Friday evening.
The lawyer, Joseph Tacopina, spoke on the heels of a report by WNBC that federal, state and local law enforcement agencies are preparing security arrangements for the possibility that Trump will be indicted as early as next week.
“Will follow normal procedures if it gets to that point,” Tacopina told CNBC when asked what Trump would do if that possibility becomes reality.
Arresting a former president, particularly one who is currently a candidate for his party’s nomination, is a huge break from precedent and is absolutely politically motivated (not to mention, in this specific case, “legally pathetic“). It’s also a can of worms that Democrats will regret opening if an indictment does occur.

Those were the two things at the top of the list of campaign promises from Trump in ’16. We didn’t get either of those things delivered as promised. Many reasons why, some in Trump’s power and some purely external to his ability to control.
For all the good things he did in office, and there is plenty to be complementary of, he did not deliver those two promises. To suggest otherwise is unserious and hurts your advocacy for him.

I think more on point is how the present article is yet another example of a deranged never-Trump ranting (although maybe that’s redundant). I didn’t react to the substance of Trump’s response yesterday because indicting him for paying Stormy Daniels (not illegal) to not reveal he did something that was perfectly legal is outrageous and I don’t know how I would react to that kind of thing happening to me.
However his calls for protests were not welcome to me, go protest in NY and end up facing a decade in prison being physically and sexually abused like the Jan 6 protestors.
It is extremely rare but sometimes grand juries do the right thing when handed a joke case (remember that refusal to indict officer Wilson after he defended himself from a 3oo pound kid attacking him?).
Whatever chance of this not happening ended with Trump’s tweets.

There almost certainly will be an indictment, but the Grand Jury hasn’t even finished hearing witnesses yet, let alone made a recommendation. And if there is an indictment, Trump will just surrender himself to NY authorities (per his own attorneys), be more popular than ever, and have an even greater chance of winning the GOP nomination (not the general, though, he can’t win that).
You have it backwards. Trump pulled the Tuesday arrest story out of his intestines. He created a potential for violence, and thus caused the DA to have to make contingency plans for that violence, if it should eventuate.

It may be that the Communists (I no longer use the obsolete “D” word) were hoping for a dramatic shocker of an arrest and that Trump sought to take the element of surprise from them and co-opt it for himself, while generating a groundswell of public sentiment opposed to such an arrest.

It’s painful to watch this conversation about Trump v DeSantis. I have been reading Legal Insurrection for over 4 years and it has been comforting to be with like-minded people in these troubling times. I love the work that this blog has done on bravely calling out things that get people cancelled.
But if we’re going to have this conversation, let me say this. I voted for Trump twice and I will do it again in 2024. Much of the criticism of Trump just sounds whiny to me.
My big point in all of this is that the folks supporting DeSantis to my way of looking at things have come out of nowhere and have been trying to cram him down our throats. I won’t vote for him even if he gets the nomination, and there are lots more like me.

With the threats to the SCOTUS to invade their homes and kill them, the language of Nancy Pelosi, Maxine Waters, and Elizabeth Warren, and the example of Hillary Clinton giggling over the murder of a foreign head of State, we know there is a certain tolerance of murderous violence toward their political enemies. From the example of Jeffrey Epstein, we know that –whoops!– no police custody or prison is secure.
