(b)Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

    That is exactly the point about “cooler heads”. They already know where voters are going with this attempted communist takeover. This is just making free elections THE major threat to them even worse so you can bet they will take down their opposition and rig/cancel elections. They already know which bloggers and websites are the enemy. This isn’t about bloggers and their commenters. Besides, our leaders are right out there in the open risking it all and they are being effective because they represent people. They represent US. And we have to cower in fear of upsetting the enemy?     If we are heading into a civil war, it will start at some time and it will be incidents like this that will trigger it. Are we going to wait until they start assassinating people? Isn’t that their next move with Trump and DeSantis and their growing following?

First of all, as Elias himself points out, this law cannot apply to the presidency, vice presidency, or to congress, because Congress has no authority to make any law disqualifying anyone from those positions.

Second, even on the statute’s own terms, it says “office under the United States”. That term is taken directly from the constitution itself, where it means only appointed office, not elected office. The presidency, vice presidency, and congress are not “offices under the united states”. Any provision that uses that term does not apply to them.

As for Trump having to litigate to get on the ballots, in most states that he would expect to carry he wouldn’t have to litigate. His team would simply point this out to the state boards of election, and they’d put him on the ballot. In most of the states where the boards of election would resist, and litigation would be needed, he might as well not bother; if he can’t win a state anyway, there’s no reason to be on the ballot there. Let California and Maryland leave him off the ballot; it wouldn’t cost him any electors, so why fight? He will either win without them or not at all.

    Yes, we expect Trump to lose California and New York, and win Texas and West Virginia. Enough states are toss ups to be concerned. Trump won in Wisconsin in 2016, and the 2020 loss looks suspicious. Too many ballots in illegal drop boxes. The swing states are crucial. The Marxist, leftist, democrats didn’t need to cheat everywhere. Detroit, Atlanta, Milwaukee, Maricopa County, and Philadelphia were enough. The fight on the margins is crucial.

    And whose Constitution are you basing this litigation on? Armed thugs and armies move faster than lawyers and their courts.

Remember me, in the run-up to the 2016 election, talking about how the Democrat media, with it’s over-the-top lying would only strengthen Trump?

I’ll say it now: I think the Democrats just lost the next Presidential election, if Trump runs.

    This seems very short sighted, high risk high reward. If they find a smoking gun in their fishing expedition all well and good. Don’t find it though….folks are upset, big time.

    They better hope DJT was as foolish or arrogant as they believe and actually has unclassified docs which he didn’t declassify as the unitary executive. DJT has been around the block and I doubt he was foolish enough in the wake of Jan 6 and the aftermath not to have proof and plan and all his ducks in a row with copies of exculpatory evidence stored off-site just in case of this exact scenario.

        I just don’t see the point. First if this turns out to be a BS technical violation v any real substance they are pushing folks towards backing DJT. Let’s say they make a charge stick, a substantial one and that knocks DJT out of contention. Then what? Biden is still way underwater, inflation rampant and DeSantis is the 2024 opponent.

        What is the payoff? Unless they think the populist right movement is dependent on DJT and that simply isn’t so. DeSantis takes Florida policies to DC and the d/prog will howl very loudly as they are instituted. The bureaucracy will fight DeSantis just as hard as DJT so both have equal motivation to defang and declaw them. Especially now.

My unsolicited advice to Governor Ron DeSantis: Sir, you’ve already spoken on this issue and about how it’s a terrible thing. Go one step further. Come out and publicly state that you support Donald Trump 100% to be the 47th President of the United States because it’s clear the left is out of control and needs to be stopped. Ask all others on the right and the liberals who’ve been abandoned by the Democratic Party to join together to end the progressives who are destroying America.

Civil War is in my humble opinion just a couple blocks down the road. We have one last chance to stop and turn away.

    Been saying that for years. The Deep State’s war on Trump isn’t about Trump. Its purpose is to demonstrate to others what they can do to people like Trump, and what they can do to anyone who works for or with such a person. It’s an attempt to preclude the return of Trump, or the rise of someone in his place. Liz Cheney is already talking about how bad DeSantis could be for the country. She understands that the campaign against Trump hasn’t been because of mean tweets, it’s been about keeping monkey wrenches out of “the Plan.”

I am envisioning a DeSamtis presidency with DJT as a key advisor to the President.
In the mean time, the House can de-fund the FIB and a good share of the Department of Justice. Oh, and re-size the funding for the IRS to the previous size or less. Re-write House rules to fit.

    At this point, we don’t have any realistic alternative to nominating Trump. We have to do our best not to allow this sort of tactic to succeed, because it’s clear this is the future of elections. I’m a big DeSantis fan, but his time is not now and may never come if this is allowed to stand.

Legal or not, constitutional or not, it all doesn’t matter. This, just like the Jan 6th ‘hearings’ is just another scene in the democrat’s play. Keep the hype going strong in the base, and when the 2024 election draws near, get the AG’s in several deep blue states to declare Trump in ineligible to be on the ballot. Watch.

    In “deep blue” states it doesn’t matter whether he’s on the ballot. Any state that he can’t win, there is no harm in leaving him off the ballot. And the fact that he’s been forced off it in those states will drive more people to support him in states he can win.
