Jen Psaki Blames Texas When Asked About Death of National Guardsman at the Border

A Texas National Guardsman named Bishop E. Evans died last week, presumably by drowning when he tried to rescue two illegal border crossers who turned out to be drug mules.
White House Press Secretary Jen Psaki was asked about this on Monday and shifted the blame to the state of Texas.
Of course, the Texas National Guard wouldn’t even be involved in protecting the border if the federal government was doing its job under Joe Biden.
But remember, the Democrats are the people who care.

Kicking off Monday’s press briefing by laughing while declaring “there’s nothing happening in the world today I hear,” the death of Texas National Guard SPC Bishop E. Evans while fighting Biden’s border crisis apparently couldn’t have mattered less to White House Press Secretary Jen Psaki.
At the top of her briefing, Psaki failed to offer any comment on the tragic death of SPC Evans until she was asked point-blank if the White House had anything to say about the incident that saw the heroic guardsman dive into the Rio Grande River to save flailing illegal border crossers who were allegedly drug smugglers, losing his own life as a result.
After waiting some four days to offer any statement from the White House or the President of the United States, Ken Psaki — again, only when pressed — finally commented the death of SPC Evans…
“Of course we are mourning the loss of his life and we are grateful for the work of every national guardsman,” Psaki began before immediately blaming someone else — conveniently the red state of Texas. “I would note that the National Guard work for the states and so he is an employee of the Texas National Guard and his efforts and his operation were directed by there, not by the federal government in this effort- in this apparatus,” Psaki claimed.

I have to admit, even by my jaded standards that’s a hell of a stance for Raggedy Jen to take.
Well, personally I need a little more information on this whole incident. (Which I’m certain CID and the IG most probably are doing). I understand silence for the investigation and know better than to take anything the media reports at face value or true.
Perhaps he will be recommended for the Soldier’s Medal.
But as a Sr. NCO who has done over a dozen “disasters” ranging from hurricanes, civil disturbance, S&R and floods- something isn’t adding up here. ( at least in what’s reported so far and it could be innocent and innocuous). The bottom line is a soldier DIED in a LOD incident- that MANDATES answers to the following:
The soldier was a Spec-4 (E-4) so he was working under a section/platoon/squad and an NCO somewhere- not alone by himself.
What was his job and what was his team doing? (his rescue might have been a violation of orders in the first place)
Did he have proper PPE/Equipment for waterborne operations? ( did the unit have it?)
Was he engaged in something else and this just happened?
Was this personal initiative or was he ordered to rescue?
Who communicated this where and when?
That’s just for starters.
The UCMJ is NOT civilian law and there is not much leeway for a reason. There is a chain of command- op orders and regs for a reason and the individual soldier des not have individual liberty or authority to interpret them even in a crisis. (for example- had this soldier been on a guard post and left it without proper relief- he would have committed an unlawful act)
As heroic as his actions were- they also can be equally illegal/unlawful/against regs and possibly cost dependent’s his SGLI and other benefits.
I have done operations like this so I want to see the totality of the situation because right now I see this as a needless and totally avoidable situation resulting in the death of a soldier.
Please translate the following:
S&R- Search and Rescue
LOD- Line of Duty- specifically in things like this is when a soldier is injured/killed (non combat related) while conducting official duties as opposed to say driving home after work while on active duty but “off duty”.
Political influences aside- depending on the specifics of the situation and the event line of actions, there could be all kinds of ramifications for this. (positive and negative)
Personally, I have done hundreds of ops in and around water ( training and real world) and the details here raise some concerns (or the lack of in this case)

I have a small quibble, having spent 13 years on active duty (I did the planned 10 years but was recalled to active duty after 9/11 and apparently was irreplaceable for three years) and the remainder of my 20 years in the reserves.
In the reserve you’re in the line of duty from the time you depart your house until you return home. If that is within the distance the Navy has established for the limit of a daily commute then you are in the line of duty from the time you depart your house on Saturday and Sunday morning and return home each day.
If it’s beyond that distance and you rate a room on base at the Bachelor Officers’/Enlisted Quarters you’re in the line of duty the entire time you leave home on Friday until you return home on Sunday.
So two guys leave the northern suburbs of L.A, to go to their drill weekend in San Diego. They decide to rob a convenience store and get shot. Not killed. The Navy had to hospitalize them at government expense because they were shot in the line of duty.
But the Navy couldn’t court martial them as reservists are only subject to the UCMJ during the four hour blocks they’re actually drilling. Eight A.M. to noon and one P.M. to five, Saturday and Sunday. But for the entire time they are drilling, they’re in the line of duty.

Sir, you are confusing “reserve” ( direct part time component of the active duty and virtually identical) with National Guard ( a 100% State Organization EXCEPT when on Federal orders)
Like many, I have been both and there are differences and this is one of them. Travel requirements also differ slightly but that’s minutiae.
And in your scenario- they are ONLY “in the line of duty” during the MUTA period (Mutual Uniform Training Assembly- the 4 hour “drill” where a weekend drill is 4 MUTA’s)- “off duty” is still “on orders” and benefits attach but not all and regarding conduct (Reserve regulations- not active component), in cases like that, those “benefits” can be revoked depending on circumstances.)
And yes, I know this from experience having to deal with any number of privates getting into “things” over my career.
If you see SR without the ampersand used in a different context it means “Strategic Reconnaissance.”
In the Navy it’s a mission the SPECWAR types. In the U.S. Navy we speak an entirely different language then the rest of the beings in the known universe. Every other armed force has things like “sergeant.” We have things like CTA1 (Cryptologic Technician, Administrative, First Class) or CTI1, (Cryptologic Technician, Intelligence, First Class). There are no floors in the Navy. Only decks. I didn’t realize how weird it was until I pulled duty at a joint command and an Air Force officer stopped by my desk and noticed a Petty Officer in my department had left a note for me.
“LT, PSM ASAP. V/R, CTT1”
She blurted out, “What the hell is that?”
Of course each of the branches have their own jargon. Tell someone to “secure” a building and you’ll get entirely different reactions.
An Army type will lock the doors and post sentries.
The Navy will tidy up, lock the doors, and go to a bar.
The Air Force will take out a lease with an option to buy.
The Marines will reduce it to rubble with artillery.

See above; the reports I’ve seen were that he and his unit were patrolling along the river bank and he saw the illegals in distress, took off his armor, and dove in.
I’ve heard similar and that was the basis of my post. His actions COULD ( emphasis on could) be violations of mission requirements and orders which could result in the NOK not getting proper or full benefits.
That still doesn’t address who authorized his actions ( CoC), was the situation communicated for instructions and what about the rest of the patrol.
Obviously, since the alleged victims didn’t drown- what was the real level of danger and are we being given all the information?

Drowning people will panic and in their panic try to kill you.

If S&R was not part of the mission, who authorized this soldier to abandon his post and initiate a rescue?
See, I’ve actually done these ops in the real world so I’m not giving you “hypotheticals”- there are very strict “special orders” and emphasis on soldier safety and we don’t allow “freelancing”. Where was everybody else? (commo, medics, leadership?)

SCOTUS said otherwise when they upheld Arizona not enforcing the border; immigration is a Federal responsibility, and Federal law (which FICUS is violating HIS oath of office by not enforcing) controls.

The irony here is that this incident was one of few cases of actual heroism at the border, and Psaki is taking pains to clear up that the federal government did not, in fact, contribute to that heroism in any way.
