Elizabeth Warren Wants to Give CDC the Power to Cancel Rent Whenever They Want

The Centers for Disease Control was widely criticized over the summer when they extended the eviction moratorium. Critics correctly pointed out that the CDC is not an elected body, they’re not lawmakers, and they should not have the power to enact such a policy.

Now Elizabeth Warren wants to give them the power to do this whenever they want.

Warren is teaming up with Rep. Cori Bush of Missouri to do it.

Brad Polumbo writes at the Foundation for Economic Education:

Elizabeth Warren Introduces Bill to Bring Back One of the Federal Government’s Worst Pandemic Policies

In late August, the Supreme Court struck down the Centers for Disease Control’s so-called “eviction moratorium.” The justices ruled that the federal agency did not have the legal authority to unilaterally extend a prohibition on the eviction of non-paying tenants in many circumstances. This was a win for both the rule of law and for a rental market destroyed by the order—but the victory could prove short-lived, if a new coalition of progressive lawmakers gets its way.

Sen. Elizabeth Warren and Rep. Cori Bush, progressive Democrats, just co-sponsored legislation to revive the eviction moratorium: the “Keeping Renters Safe Act of 2021.”

Their bill would explicitly give the CDC the authority to re-enact the moratorium and compel it to do so. This new moratorium would potentially go even further, applying automatically to all rentals without tenants applying, as previously required. So, too, it would remain in place until 60 days beyond the “conclusion of the public health emergency.”

Warren clearly wants some of the attention from the left that comes with working with a member of the squad.

And Cori Bush clearly appreciates their partnership as well.

The FOX Business Network has more background on this:

The Centers for Disease Control and Prevention (CDC) had previously mandated an eviction freeze in September 2020 to help stop the spread of COVID-19. Still, the Supreme Court ruled that the agency couldn’t continue extending the ban without Congress’ approval…

After the initial COVID-19 eviction protections expired in July 2021, the Secretary of the Department of Health and Human Services (HHS) issued another eviction moratorium under the direction of President Joe Biden. But the Supreme Court again ruled that the HHS secretary doesn’t have the authority to implement a ban on residential evictions.

The Keeping Renters Safe Act would grant the HHS secretary permanent authority to implement a residential eviction ban during public health crises to help prevent the spread of communicable diseases, including at homeless shelters. The act would also direct the HHS to implement an eviction moratorium to remain in effect while the COVID-19 pandemic remains a public health emergency.

While some state and local governments have issued guidance on evictions, there’s currently no eviction ban put in place by the federal government.

People like Warren and Cori Bush never want the pandemic to end. It has given them cover to enact policies they would never be able to pass under normal circumstances.

Could the CDC be required to issue mandates regarding homeless encampments first? Let’s see how they do with that and then we can think about expanding it to include tenants.

As long as it’s not her and hers? Americans’ prize the right to life, liberty, and the pursuit of happiness that includes property rights.

I think the 10th amendment applies here. I know, stop laughing. I don’t actually expect anyone in Congress to care what the Constitution says, least of all a loon like Fauxcahontas Warren! It was just an observation.

The 10th Amendment was deprecated under the Twilight Amendment (e.g. planned parent/hood a.k.a. wicked solution a.k.a. social progress).

Lieawatha getting her Marxism on, Karl would be proud

Suppose for a moment that we the people decided that the federal government should have the power to enact a rent moratorium. Why would we want the Centers for Disease Control and Prevention to exercise that power? What expertise does the CDC have in what is an economic issue?

I have yet to figure out why the CDC thought it had this power in the first place; if we’re going to have rent control I would have thought this would be part of Housing and Urban Development, or perhaps the Treasury.

The CDC should stick to, you know, diseases and health. Just a thought.

The CDC hasn’t exactly proven their expertise on, you know, diseases and health.

Maybe enacting socialist policies as a bureaucratic proxy for an out-of-control government is something within their skillset.

Where in the Constitution is there provision for the CDC in the first place.

Totalitarians use heath and safety as justification for control of the people. The CDC is the tool. They do not have the authority (legal basis) under the Constitution but they have the power ( capability to make things happen) from two sources: The puppet POTUS and the submissive people. If the people do not submit, the CDC does not have the power to control us. They may try force is we do not submit like good slaves.

I’m telling you, this is all the result of the government discovering that the citizens will accept “pubic health” as the root password to all their natural and constitutional rights.
It’s like a red-flag law for oppression of your entire life.
Pretty soon, the entire machinery of government will be driven from the CDC.

The concept of “public health” has been expanded to include practically every sort of maladaptive behavior, from gang shootings to drug addiction.

Public health has always been a balance between risk and freedom, and has always covered cases where one person’s exercise of freedom created risks for others (e.g., quarantine).

But with the concept of “disease” expanded to include all sorts of misbehavior from annoying to criminal, public health authorities demand a right to command all sorts of mandatory curbs on freedom in the name of “health.”

So, you think of rent as an owner’s just compensation for allowing someone the use of the owner’s property, but the CDC perhaps thinks of it as a sort of disease organism to be eradicated (or controlled, if it cannot be eradicated).

And when landlords abandon properties that have been appropriated by tenants, well, surely government will have solutions for that as well.

Unless perhaps the Fifth Amendment’s ‘takings’ clause is still enforceable?

Public Health is a basic justification of eugenics. The Jews were blamed for all kinds of disease so the Nazi eugenics was “justified.” Public Health rather than individual health sounds a lot like social justice rather than individual justice (Constitution) or Marxism rather than individual liberty or the 2A applies to “militia” rather than individuals.

What a brilliant plan !
Let’s also give them the power to cancel car and house payments, grocery bills, gasoline costs, and movie admissions.
Nirvana would ensue, and we would all be happy.
They could actually cut tax payments easily.
Somehow, I doubt they will do that.

Where does Congress get power over charging rent? By its nature it’s almost never interstate commerce.

Center for Dictatorial Control

Once the government bankrupts private non-corporate ownership of property then the goal will be reached. Private ownership is the target.

    “Center for Dictatorial Control”

Second only to Fauci the Head Dictator.

While reminiscing recently Fauci explains why he misses Trump. “When Trump was president everything was his fault, but now I have nowhere to hide. becasI mean, hey, you can’t blame a mentally impaired Alzheimer’s patient.

We will be hearing a lot of this kind of screeching from these Marxists as they are being shown the exit. Fauxcahontas has been saying crazy things for as long as I remember. Nothing will come of this.

ultra vires, takings without compensation, impairment of contracts – how is this possibly legal?

Well…. Because our masters said so.

It shouldn’t be. The (amazingly horrible) argument was that the prior ‘eviction moratorium’ didn’t remove the requirement that the tenant actually pay the rent. It just made it so a landlord can’t evict due to nonpayment.

This is obviously a horrible argument. The agreement between tenant and landlord is that the tenant can live in the house/apartment so long as they pay. If they don’t pay, they don’t get to live in the property. Removing the landlord’s ability to evict removes the incentive for the tenant to actually pay the rent.

They claim they are wanting to help people, but I can guarantee you that the rental market would crater because nobody in their right mind would rent out their house/apartment if their tenant doesn’t have to pay rent. Or, landlords will start dictating that the tenants pay the entire rent up front– i.e., the landlord would require the tenant to pay for the entire year on a one year lease before the tenant moves in.

      AF_Chief_Master_Sgt in reply to davey1983. | September 26, 2021 at 3:49 pm

That’s actually not a bad idea. I would settle for 50% up front, and full payment in 4 more installments.

Adding insult to injury, the property owners were still obligated to maintain the rental property while the renters failed to pay the rent.

Now, the property owners have to force back payment through the courts.

      divemedic in reply to davey1983. | September 26, 2021 at 5:19 pm

Still won’t work. The tenant can simply refuse to move out when the lease is up. You still can’t get rid of them. In essence, there would no longer be any rentals available for any reason.
I bought a second house two years ago and have been renting it out. That would have to stop and I would be forced to sell. If I can’t get rid of the tenants, then I would simply stop paying the mortgage. Let the bank get them evicted when they foreclose.

The Federal Government: Fucking things up since 1789.

Perhaps if our esteemed masters would put a clause in that piece of shït bill that would, I don’t know, tell people they can live in their rented homes if they PAY THE DAMNED RENT!!!!!! (h/t Sam Kinnison)

Renters continued to work or received government payouts (of which I never received), yet they couldn’t find it in their greedy hearts to use that to pay their rent.

Lieawatha and the Burning Bush should not be given the powers to make law. They are too stupid to think past their va…

I think it is just a bunch of sabre rattling to keep people “scared”.

If this were the 18th century these people would have been tarred and feathered by now.

We seem to be a nation of comfortable cowards, fearful of media.

Change starts at home. Primary season is coming, time to clean house where we can.

A Nation of Comfortable Cowards… I like that
Going to steal it

It makes sense that the CDC is a front line weapon in this war against the citizens. The Nazi’s used the medical establishment as a key justification of their program. Why not use the medical establishment here? All we need to do is trust them because they are so trustworthy — right, Fauci?

A repeat of LI’s investigation into the frauds of Fauxchaontas should be revivd. And soon.

If this were to occur look for a lot of apartments to be converted to condos and no replacements to be built. Also look for any houses that have been available to rent be sold. In other words look for a sudden and massive reduction in available places to rent.

” other words look for a sudden and massive reduction in available places to rent”

And, naturally, a sudden and massive increase in rental rates.

One thing for sure. Princess Spreading Bull sure as heck didn’t build that apartment building where she now says renters can live rent free.

The expected side effects of maintaining this moratorium are staggering. What bank in their right mind would lend to a sub-A credit debtor when they cannot be removed after foreclosure? Both the rental and sales markets would crash and burn.

It’s an open question as to which crone is the more manifestly miserable, narcissistic, obnoxious, insufferable, utterly worthless misandrist, scold, shrew, nag, harridan and termagant among U.S. Senate Dhimmi-crats — Fauxcahontas, or, the equally vile Mazie Hirono.

The Dhimmi-crat apparatchiks believe in protecting private property rights, but, only when their own property is in question. The don’t give a damn about the peasant rabble. That working-class individual or couple who scrapped and sweated and saved to buy a fixer-upper house, or, an apartment, as a rental income-producing property? The Dhimmi-crats believe that these people don’t have any rights.

What a bunch of miserable, worthless, neo-communist snakes.

Liz Warren is batshit crazy.
Can somebody give this harridan another half dozen cats to keep her occupied?

There’s still a 5th Amendment, Lieawatha. And the contracts clause. (Why is that not enforceable against the federal gov’t? Did our Founders screw that one up?)

EW could bring them home to her reservation and go fund me could supply teepees.

HOW ABOUT NO?

Seriously, this is just getting ridiculous. People are tired of the authoritarianism coming from the administration, and this whackadoodle is just adding to it.

I know at least ONE of my senators will vote “no” if this crap ever came to a vote. I don’t trust Bill Cassidy to do the right thing. He’ll just, “Yes, dear.” and vote “yes”.

Sad the USA has become a nation of majority lazy cowards. Why do you think the Federal Government has been giving out free cell phones for 10 years now. The current population thinks if they have a cell phone they are free. What a bunch of total idiot / fools.

Free cell phones = Gov. can track one’s every movement 24/7.
