Elizabeth Warren Wants to Give CDC the Power to Cancel Rent Whenever They Want

The Centers for Disease Control was widely criticized over the summer when they extended the eviction moratorium. Critics correctly pointed out that the CDC is not an elected body, they’re not lawmakers, and they should not have the power to enact such a policy.
Now Elizabeth Warren wants to give them the power to do this whenever they want.
Warren is teaming up with Rep. Cori Bush of Missouri to do it.

In late August, the Supreme Court struck down the Centers for Disease Control’s so-called “eviction moratorium.” The justices ruled that the federal agency did not have the legal authority to unilaterally extend a prohibition on the eviction of non-paying tenants in many circumstances. This was a win for both the rule of law and for a rental market destroyed by the order—but the victory could prove short-lived, if a new coalition of progressive lawmakers gets its way.
Sen. Elizabeth Warren and Rep. Cori Bush, progressive Democrats, just co-sponsored legislation to revive the eviction moratorium: the “Keeping Renters Safe Act of 2021.”
Their bill would explicitly give the CDC the authority to re-enact the moratorium and compel it to do so. This new moratorium would potentially go even further, applying automatically to all rentals without tenants applying, as previously required. So, too, it would remain in place until 60 days beyond the “conclusion of the public health emergency.”
Warren clearly wants some of the attention from the left that comes with working with a member of the squad.

The Centers for Disease Control and Prevention (CDC) had previously mandated an eviction freeze in September 2020 to help stop the spread of COVID-19. Still, the Supreme Court ruled that the agency couldn’t continue extending the ban without Congress’ approval…
After the initial COVID-19 eviction protections expired in July 2021, the Secretary of the Department of Health and Human Services (HHS) issued another eviction moratorium under the direction of President Joe Biden. But the Supreme Court again ruled that the HHS secretary doesn’t have the authority to implement a ban on residential evictions.
The Keeping Renters Safe Act would grant the HHS secretary permanent authority to implement a residential eviction ban during public health crises to help prevent the spread of communicable diseases, including at homeless shelters. The act would also direct the HHS to implement an eviction moratorium to remain in effect while the COVID-19 pandemic remains a public health emergency.
While some state and local governments have issued guidance on evictions, there’s currently no eviction ban put in place by the federal government.
People like Warren and Cori Bush never want the pandemic to end. It has given them cover to enact policies they would never be able to pass under normal circumstances.

Could the CDC be required to issue mandates regarding homeless encampments first? Let’s see how they do with that and then we can think about expanding it to include tenants.

Suppose for a moment that we the people decided that the federal government should have the power to enact a rent moratorium. Why would we want the Centers for Disease Control and Prevention to exercise that power? What expertise does the CDC have in what is an economic issue?
I have yet to figure out why the CDC thought it had this power in the first place; if we’re going to have rent control I would have thought this would be part of Housing and Urban Development, or perhaps the Treasury.
The CDC should stick to, you know, diseases and health. Just a thought.

Well, if ya gonna get that way about things, try this. If the document were followed as written – you know, according to which they all take the Article VI oath – fedgov would be one-tenth its present size. Frightening, isn’t it, that the oath, and the 10th Amendment, mean nothing?
Totalitarians use heath and safety as justification for control of the people. The CDC is the tool. They do not have the authority (legal basis) under the Constitution but they have the power ( capability to make things happen) from two sources: The puppet POTUS and the submissive people. If the people do not submit, the CDC does not have the power to control us. They may try force is we do not submit like good slaves.
I’m telling you, this is all the result of the government discovering that the citizens will accept “pubic health” as the root password to all their natural and constitutional rights.
It’s like a red-flag law for oppression of your entire life.
Pretty soon, the entire machinery of government will be driven from the CDC.
The concept of “public health” has been expanded to include practically every sort of maladaptive behavior, from gang shootings to drug addiction.
Public health has always been a balance between risk and freedom, and has always covered cases where one person’s exercise of freedom created risks for others (e.g., quarantine).
But with the concept of “disease” expanded to include all sorts of misbehavior from annoying to criminal, public health authorities demand a right to command all sorts of mandatory curbs on freedom in the name of “health.”
So, you think of rent as an owner’s just compensation for allowing someone the use of the owner’s property, but the CDC perhaps thinks of it as a sort of disease organism to be eradicated (or controlled, if it cannot be eradicated).
And when landlords abandon properties that have been appropriated by tenants, well, surely government will have solutions for that as well.
Unless perhaps the Fifth Amendment’s ‘takings’ clause is still enforceable?
Public Health is a basic justification of eugenics. The Jews were blamed for all kinds of disease so the Nazi eugenics was “justified.” Public Health rather than individual health sounds a lot like social justice rather than individual justice (Constitution) or Marxism rather than individual liberty or the 2A applies to “militia” rather than individuals.

Where does Congress get power over charging rent? By its nature it’s almost never interstate commerce.
Neither is growing wheat for your own consumption.
Not engaging in interstate commerce affects interstate commerce, therefore Congress can regulate it.

It shouldn’t be. The (amazingly horrible) argument was that the prior ‘eviction moratorium’ didn’t remove the requirement that the tenant actually pay the rent. It just made it so a landlord can’t evict due to nonpayment.
This is obviously a horrible argument. The agreement between tenant and landlord is that the tenant can live in the house/apartment so long as they pay. If they don’t pay, they don’t get to live in the property. Removing the landlord’s ability to evict removes the incentive for the tenant to actually pay the rent.
They claim they are wanting to help people, but I can guarantee you that the rental market would crater because nobody in their right mind would rent out their house/apartment if their tenant doesn’t have to pay rent. Or, landlords will start dictating that the tenants pay the entire rent up front– i.e., the landlord would require the tenant to pay for the entire year on a one year lease before the tenant moves in.
That’s actually not a bad idea. I would settle for 50% up front, and full payment in 4 more installments.
Adding insult to injury, the property owners were still obligated to maintain the rental property while the renters failed to pay the rent.
Now, the property owners have to force back payment through the courts.
Still won’t work. The tenant can simply refuse to move out when the lease is up. You still can’t get rid of them. In essence, there would no longer be any rentals available for any reason.
I bought a second house two years ago and have been renting it out. That would have to stop and I would be forced to sell. If I can’t get rid of the tenants, then I would simply stop paying the mortgage. Let the bank get them evicted when they foreclose.
