Prosecutor Who Went After the McCloskeys Pulls No-Show for Murder Trial Forcing Judge to Free Killer

“Judge Jason Sengheiser wrote a scathing order dropping the murder charges. The accused killer, Brandon Campbell, was released from jail and is still at large.”

Kim Gardner, the left-wing circuit attorney in Missouri who aggressively went after the McCloskeys for defending their home from a BLM mob, failed to have anyone from her office appear in court for a recent murder trial.

The judge let the killer go. Why are people putting up with this?

St. Louis Circuit Attorney Kim Gardner is under fire after a judge drops murder charges against an accused killer.

The unusual move came after the prosecutor from Gardner’s office, who was assigned the case, didn’t show up to court. Now the chairman of the St. Louis Aldermanic Public Safety committee wants to call Gardner in front of his committee to explain the incident.

Judge Jason Sengheiser wrote a scathing order dropping the murder charges. The accused killer, Brandon Campbell, was released from jail and is still at large.

The judge noted in his order that the prosecutor who was assigned to the case was on maternity leave for three months and said the office hadn’t replaced her.

The judge sharply criticized Gardner’s office for the mix up saying, “The Circuit Attorney’s Office has essentially abandoned its duty to prosecute those it charges with crimes.”

A spokeswoman for Kim Gardner admitted a big mistake was made saying in a statement: “Upon review of our internal policies and procedures regarding Family Medical Leave, we have determined that corrective measures are needed to further prevent any future repeat occurrence of the incident in question.”

As you can probably imagine, the family of the murder victim is pretty upset.

Family members said they haven’t heard anything about the case from anyone other than homicide detectives.

Moore’s sisters say Gardner’s inaction on their brother’s case is inexcusable and they learned the suspect was free from the I-Team even though state statute requires prosecutors to keep victims’ families informed of the developments in their loved ones’ cases.

“Why was it so hard to pick up the phone to call to let us know what was going on?” asked Cierra Moore, Randy Moore’s oldest sister.

Our investigation also found the number of cases getting dismissed since Gardner took office just five years ago has doubled.

And re-filing the charges in this case offers little comfort to Brandy Veasley, another one of Randy Moore’s sisters.

“Kim Gardner is a poor excuse for a prosecutor,” she said. “It’s not fair.

2016 was also the year the city elected Kim Gardner as circuit attorney for St. Louis, the first black top prosecutor for the city. Gardner’s campaign was heavily financed by left-wing billionaire George Soros as part of his broader strategy of placing Democrats who vow to reverse “tough on crime” policies in top law enforcement positions.

Every progressive DA with those fingerprints on their campaign should be voted out of office, ASAP.

      The Dems don’t play by the Marquess of Queensberry Rules, why should we? The Ds are evil, having no qualms in pounding us with kidney punches and with punches below the belt.

      For too long we’ve been entirely too decent in what is a fight-to-the-death. Pols like Mittens Romney don’t have fire-in-the-belly; there are far too many Rs who are just useless.

        As I have explained to my children: Ad hominem attacks do not add to the conversation. They are often employed as a distraction technique by people who either have nothing of value to add, or who are attempting to derail or distract from the valid points being made in an arguement. When people do this, you should always treat them with disdain and suspicion because they are trying to distract you. Just because “they call us names” doesn’t make it okay. Not taking part in meaningless name-calling makes you better than those that do it.

        That’s not true. There have been some notorious cases of fraud by Republicans. There was the congressional election in NC that was actually overturned because the Republican was caught red-handed. And just last month it appears there was major fraud in the R primary on Staten Island, which may result in a similar outcome.

        Neither side is doing it, I support election integrity measures hopefully they will assuage your fears but that is what those are a solution to.

        2020 Republicans won nearly every swing district and in GA won a plurality of the vote while narrowly winning a set of swing state despite the fact that the popular vote favored Biden by 7 million votes.

        Following the election when Trump decided not to accept defeat and his message to the people of Georgia was the state election was rigged (which means don’t vote) Republicans reacted to that message by refusing to vote turning over control of the senate to Joe Biden who is appointing judges at a higher rate than Trump did.

        Want to hand them future elections to empower them more keep beating the fraud claims.

Call me George, ’cause I am kinda curious as to WHY someone would do that.

    Supposedly the Attorney who was on maternity leave had her electronic signature forged onto 28 cases all while she was on leave. She is said to have resigned this morning.

      There’s a lot of questions there.

      Did she “have” her signature forged? That is, did she tell someone in the office to apply her signature? If so, had she read the documents (have to do something in-between nursing the baby) and was okay with this? If she didn’t read them then why apply her signature in abstentia?

      Or did she not “have” her signature forged, and thus these are real forgeries? In which case, why is SHE resigning?

    What I’m curious about is why whomever it was that went through the trouble of forging her signature because she wasn’t around, didn’t also take steps to scare up a replacement for the trial because she still wasn’t going to be around. Talk about doing a half-assed job.

      The signature applied was a password coded electronic one to be used only by the
      signatory.
      Did she process the signature off site, as so many are working off site? or Was it authorized by the owner to be shared in her absence? Or was it like so many other things going on in todays tech world, hacked and used by someone else in her department? So many unknowns at this time, but her resignation might mean there is knowing knowledge by someone as to what actually took place during the “Leave of Absence”.

    Actually other stories are saying that they forged her digital signature on 20 DIFFERENT cases that she was ‘assigned’ to.

    As to the why? Because the person doing it is a total moron and is too stupid to actually anticipate what would happen. The lead prosecutor effectively bought her position with Soros money, and from all appearances she’s frighteningly stupid and incompetent. She probably just assumed that the court would just push everything back when the maternity one didn’t show up and nobody would ever know.

    I mean dim bulbs have been doing similar things for a while. We had somebody punch their brother’s time card while just left on a vacation without telling anybody. They were both stupid enough to think nobody would actually notice that they were paying a guy that hadn’t shown up for a week. So yes, people this stupid DO exist.

Gateway Pundit reported yesterday that the prosecutor who was on maternity leave resigned because her leave actually started before she was assigned to this case. Someone allegedly forged her digital signatures on court documents submitted in 20 cases while she was on leave.

    I’m not following this. The woman was put on leave; they some yutz in her office assigned her a case; then some yutz (possible the same yutz) forged her name on case documents, then some yutz didn’t bother to reassign the case to an active prosecutor for trial purposes… and she resigns?

      The only thing I can think of is that she doesn’t want to be associated with an office so corrupt that they would forge her name on court documents. From the article:

Christmas says the judge didn’t have to release the accused killer back on the streets, but instead could have just continued the case.

Mr. Christmas, sir, I don’t it works that way. The defendant, even an odious gang-banger jugged for murder, is entitled to a speedy trial and to due process at each step of such trial. If the state can’t be bothered to show up, it’s a demonstrable harm both to the defendant and to the rule of law simply to continue the case.

I don’t like releasing suspected murderers, but I like even less violating due process.

    It’s not just that the state didn’t bother showing up. It’s that the state ignored repeated court orders for discovery. It’s like nobody was reading the judge’s email messages; but he sent a deputy to hand-deliver his latest order and it was still ignored.

Can charges be refiled? This is described as a no-show for a trial, not a preliminary hearing or voir dire. I thought that once the trial starts jeopardy attaches.

So, it looks like everything is proceeding according to the plan.

Well it actually says she failed to show up in court. Other stories say that she didn’t show up for ‘hearings’, which I assume are pre-trial.

It sounds like the defense was filing motions that required pre-trial hearings, and the prosecutor simply didn’t show up to those hearings, and the court was sick of their shit.

Theoretically they CAN re-file charges, but the defense will obviously raise the very reasonable objection that they have been denied their right to a speedy trial.

The vile and callous Dhimmi-crat apparatchiks simply don’t care about the safety of law-abiding, taxpaying citizens. Their attitude perennially is that it will be someone else’s father or mother, sister or brother, son or daughter, who will bear the consequences of criminal violence; thus, no need to evince any concern.
