Online Event: Derek Chauvin Post-Trial Analysis (Wednesday, April 21, 8 p.m. Eastern)

Andrew Branca and William Jacobson will analyze the good, the bad, and the ugly of the case, and what went right and wrong, in the context of threats of violence if there was a ‘not guilty’ verdict.

Now that the trial of Derek Chauvin for the in-custody death of George Floyd is over with conviction on all three counts, including Second Degree Murder, the Legal Insurrection Foundation is holding an online event to analyze the good, the bad, and the ugly of the case, and what went right and wrong.

As he did with the George Zimmerman trial, Attorney Andrew Branca of The Law of Self-Defense covered the Chauvin trial for Legal Insurrection from jury selection through verdict, providing the most in-depth and perceptive analysis anywhere. I’d like to think I also contributed something of value.

Legal Insurrection will hold an online event on Wednesday night, April 21, 2021, at 8 p.m. Eastern, at which Andrew and I will be able to give you our assessments of the facts and the law presented in court, within the broader context of activists demanding a conviction under threat of burning cities.

    The problem is this. For 6 months we had riots and arson (and dozens died) because – we were told – Officer Chauvin was a racist and he’s an example of why the whole system is racist. Society and police had to be upended and “re-imagined”, we were told.

    BUT WAIT. The prosecution did not present one shred of evidence that Chauvin was racist or that any of his actions were motivated by race. And YOU CAN BET that they would have highlighted any piece of race-related evidence – no matter how insignifciant – if they had it.

    I kept watch the trial – waiting for the moment they presented evidence that Chauvin was a racist. All America expected to see the evidence. BLM said he was. CNN, New York Times, MSNBC, ABC, WaPo, all the media outright said he was a racist copy and others implied it. Millions were moved by what they were told was a manifestation of pure evil racism. Some of my friends went so far as to say they hate Chauvin because he’s a MF’ing racist.

    So the trial was instructive for what was NOT presented as much as for what was presented.

    It seems apparent from what we NOW KNOW that Chauvin is NOT a racist and his actions were not motivated by race. So the entire BLM narrative is just built on a foundation of Bull Shit. They HAD to make Chauvin the poster boy for Cop Racism and yet they found nothing. You can be sure, they investigated every aspect of his life. They NEEDED to show Motive to make prove intent (intent is a necessary element of a charge of murder vs a charge of manslaughter which requires no intention). This is not the first time BLM has manipulated the public – but it was the most egregious. As a result of this propaganda, people are falsely calling the USA a “racist country”.

    Remember in July when CNN was talking about Chauvin as an example of white supremacists. Yeah, they stopped that narrative when they discovered he was married to an Asian (for those who are not clear on this – people who think their race is superior don’t go marrying into other races). Even CNN realized that they look stupid trying to sell people on a guy being white supremacist while married to a person of a different race.

    Having pushed for months the idea that Chavin is a racist – it’s too late for BLM to walk that back. And, it worked perfectly for them to raise over $500 million and coerce the City of Minneapolis to pay out $27 million because they were led to believe Chauvin is a racist. That’s why they needed to be sure Chauvin was convicted and sent away a long time. They don’t want reporters or the public to look back and start asking some hard questions (actually, the reporters today will not ask any hard questions). People might say “wait a second, weren’t we told that we have to DEFUND police because Chauvin is an example of racism inside the police ?” And “wasn’t Chauvin the poster child for police racism and white-supremacy inside the police – and therefore a compelling example of why we need to destroy policing as we know it and upend society as we know it?”

    In hindsight, all that BLM told us was lies used to manipulate us. Even AG Ellison said the investigation of Chauvin produced no evidence that RACE played a roll in this event.

    There will be a backlash. As people slowly start to realize the truth. Progressives and BLMers will learn that once people realize they have been lied to by you – FOOLED BY YOU – they NEVER trust you again. BLM undermines black people and sets-back races relations by 20 years. They clearly care about black lives ONLY to the extent such lives can be used by them to manipulate people and to get more $$ for Progressives, Marxists and BLM.

    All Americans should be outraged and angry that they have been so badly deceived. And that this deception is being used as a pretext for even more hard to our society. Changes in the way our kids are taught. Expansion of new-racist dogma that will lead to further race-based division. Forced indoctrination via CRT.

What is there to analyze. The judge believed the magic incantation from twelve jurors that, “Yes your honor, we can be impartial in this case.” and allowed 12 very biased people onto the jury that had already made their minds up as to the guilt of Derek Chauvin.

Now we can only hope the appeals go better than the original trial. But I doubt that. The cards are clearly stacked against anything the defense might say on appeal.

    Ya think Eric Nelson will represent Chauvin on appeal?

      I believe it is usual to have a different lawyer for appeals for a couple of reasons.

      First appeal work and trial work are quite different.

      Second one ground for appeal is that the trial lawyer was incompetent which is best argued by a different lawyer. Even if the trial lawyer did a good job no one is perfect and a different lawyer may see things the trial lawyer missed.

      Ideally the defense would have an appeals lawyer in the background working with the trial lawyer to make sure the appropriate groundwork has been laid at the trial stage for possible appeals if needed. But of course in most cases the defense won’t have the resources for this.

        I read that Chauvin has issues with IRS. Sounds like he has no money.

        How did NOOR go all the way to the US Supreme Court if he had no money either. Pro bono?

        In all honesty, I thought Nelson did a great job in spite of the limitations as a defense. He did let loose on the details during his closing argument.

        Another problem is that it is my understanding that the MN Supreme Court is corrupt and run by the radical left.

        All whites and Asians should leave Minneapolis as soon as they can.

          I don’t believe he has, I think he currently has an appeal pending before the Minnesota Supreme Court (the result of which could affect Chauvin’s third degree murder conviction).

          The police unions generally pay the legal bills for police officers who are charged with crimes. An indemnification of sorts. That is the case here with Chauvin.

I could accept a manslaughter conviction. But 2nd and 3rd degree murder are unacceptable. This jury made up their minds before opening arguments.

As for analysis, I think perhaps people here gave too much weight to Floyd’s drug use and other medical issues. If I were a juror and the prosecution had convinced me that Chauvin’s actions were both unlawful and dangerous to Floyd (and that Chauvin should have known this) I would not be that receptive to defense arguments (whatever their technical legal merit) that nevertheless the prosecution had failed to prove beyond a reasonable doubt that Chauvin’s actions albeit dangerous had actually killed Floyd.

So I think the main thrust of the defense should have been that nothing Chauvin did to Floyd was especially dangerous under normal circumstances. Which made his actions a relatively minor use of force that was reasonable and therefore lawful given the situation. So the defense medical evidence should have been presented to support this. That is that Chauvin’s actions were not something that one would reasonably expect to cause serious harm, and to the extent if any that they did in this case it was because of Floyd’s drug use and other serious medical issues that Chauvin didn’t know about and wasn’t trained to deal with.

Of course given the speed of the verdict and the conviction on all counts it appears to me that there were likely no defense friendly jurors on the panel. So the defense may have been doomed from the start.

        Yes, they need a judicial order for a search warrant to review medical history. Or, they can wait for a Democrat administration or em-pathetic party to provide that information through an extra-legal channel.       The wellbeing of Louisiana parolees isn’t Mpls’s problem.

      Given he decided to relocate here as well, GF had a job and was doing relatively well relative his history.

      The Bleskachek ideology meets the hard wall of reality.
      The young firefighter was right, MFD should’ve been on scene in seconds.
      Turning vital services into ideological statements first, and whatever service they are supposed to provide a distant second is problem #3.

      The optics of DCs actions are clear here. He deals with meth/crack damaged heart mopes all day. We all take pains to ensure there’s no APPEARANCE of impropriety in our affairs. GF died of a heart attack because it just couldn’t take it. DC essentially threw rocks at the prison gates by kneeling on a dead man, while people clearly told him he was dead.
      It was a perfect storm of having two new cops who were not about to speak up, and Tou who is clearly part of problem #3, which is clear after watching his FBI/BCA interview.
      For a couple decades officers were taught to yell “Stop resisting!” anytime they applied significant force- purely for optics.
      That’s problem#4

      The last problem doesn’t need to be defined. Its the tolerance for lawlessness and the rest of it. The State was down with dealing drugs, counterfeiting, DUI, and excusing assault during the trial. There’s a carjacking or two everyday. It’s the willingness of the populace to accept all this. Can you start your own autonomous zone, ala 38th & Chicago? I’m serious-Really, why not? #5 the willingness of the populace to accept and engage in self destructive ideology.

      The press is a given- the press is, and always has been garbage.

      Appeals aren’t going to solve anything. They will find endless outrages with which to rip the city apart, and people will stand by as it happens.

    The jury was convinced of guilt before the trial. The defense merely had to say some words, however implausible.

It’s interesting that they’re not applying this same standard to the shooting of that knife-wielding girl in Ohio.

America is heading towards a very bleak future. When families can get paid millions from a city after the death of a family member who attempts to resist arrest an incentive is created to resist arrest. Some people who have bleak futures where they will never earn that kind of money over their entire lives will at some point, see being killed while resisting arrest as the ultimate sacrifice to take care of their family.

To me it’s obvious that GF is primarily responsible for his own death, but that’s not saying that Chauvin is without fault. Chauvin (and police officers in general) are first responders and they have a duty of care. Obviously the jury didn’t think he attended to this. I do think that the academy and police training in general needs to be updated to emphasize this duty of care. They might also look for ways to better manage crowds/onlookers. As this dragged on many people showed up especially around the time GF lost consciousness. Many people were filming. Why not ask them for assistance of some/any kind. Why not engage with them a bit? Explain the circumstances a bit so misunderstandings aren’t minimized. I can’t blame officers for distrusting the crowd, but strategically, it seems they’d have been better served by engaging the crowd positively and trying to help them understand what they’re doing. No?

I’m commenting from Poland.
Chauvin only has two knees and has been found guilty of three homicide / murder with one man’s knee (GF) and in two different ways (intentionally and unintentionally). It seems a little strange to me. But it’s probably because I don’t know Minnesota law

You guys have done a spectacular job of covering this. I was glued to the live blogging for periods of the day and then come back and catch up later. That really worked well in spite of the double posting bugs whenever I’d comment or have a second tab open watching comments/live blog. Glad to have witnessed the best coverage and expert analysis there is on this trial.

The live form factor video just doesn’t work for me, so it’s something I catch up on after the event.

I do notice that Rumble has emerged as an alternative to youtube…. would love to see content showing up there.

I don’t think there remains any doubt that the local police forces are under direct attack today, primarily because they are under local government control. The agenda has become clear, i.e. eliminate local control of all law enforcement, thereby facilitating the federal government’s control under the premise that it will be more uniformly applied and thus more fair.

However, think about that (false) premise. Has the FBI or DOJ shown themselves to be worthy of our trust? The federal system has been a disgrace, and worse, they appear to be accountable to no one. Once they are allowed full control of law enforcement, we can readily see a full-blown police state on the near horizon.

It’s imperative that law enforcement be preserved at the local level, our very freedom and liberty absolutely depend on it.

    Why are certain groups or communities prone to high rates of crime? We can fix everything around this but when the core is not/can not/will not cooperate how will it change? Changing all the laws of the land to satisfy some group, changing everything they demand will not change some groups…WHY?

      In the end, if the proportion of our country that is unproductive and/or lawless becomes too large, not only will law enforcement issues be unresolvable, but our entire form of government and way of life will have to end. Essentially, we have been rotting from the inside out for a long time and it is time to pay the piper. I just hope we can find someplace safe.

I expect less police action going forward and more resisting arrest. If I were a cop I’d move to a red state ASAP or find another line of work. Let the liberals have what they want. No police only social workers in the utopia. Red states can have law and order and citizens that follow the laws or go to jail.

I know it’s irresistible but I wish all of this would go away and reasonable voices would talk about important issues. Instead we get Mad Max and others on TV. It doesn’t help. I think about MLKs speeches and compare that to today’s activists.

It must be letdown for BLM to not have an excuse for rioting!

    I doubt bLM is too upset. They’re enjoying their win, and they know there will be other chances to riot and loot soon. If nothing else, they can riot in support of their POC brethren the next time one of them gets inspired by Trump to beat an Asian.

    Yes, it’s happening – 8pm was start time. Perhaps you can’t register because it’s already started. Dr. Jacobson sent out emails on how to join the meeting prior to it commencing – think you’re too late.

I keep seeing the comments made by politicians mentioned in articles about an appeal. What I’m not seeing is mention of the prosecutorial misconduct. When are we going to see this brought up? Also how long before the appeals can be filed?
