While you were focused on Impeachment, Trump continued to transform the federal judiciary

This seismic shift in the composition of the federal judiciary is getting almost no current mainstream media coverage because all the oxygen is being taken up with Democrats’ impeachment efforts.

Maybe this should be a series.

No matter what the current news cycle obsession, Trump judicial nominees continue to be confirmed and Trump continues to transform the federal judiciary.

And it continues with the media obsessed on Ukraine and Impeachment.

Carrie Severino has the latest action and numbers:

Last week, the Senate Judiciary Committee held nomination hearings on two of President Trump’s nominees to the Ninth Circuit, Lawrence VanDyke and Patrick Bumatay. The Ninth Circuit continues to be transformed: Assuming VanDyke and Bumatay are confirmed, President Trump will have appointed 13 of the 29 active judges on that court.

Senate majority leader Mitch McConnell has filed for cloture (to end debate) on five more of President Trump’s judicial nominees, including Danielle Hunsaker and William Nardini, both nominated to the Second Circuit. This procedural move by McConnell sets up confirmation for all five nominees later this week or next.

Current and known future vacancies: 122

Courts of Appeals: 9

District/Specialty Courts*: 113

Pending nominees for current and known future vacancies: 55

Courts of Appeals: 8

District/Specialty Courts*: 47

* * *

Nominees Confirmed by the Senate since Inauguration Day: 159

Supreme Court: 2

Courts of Appeals: 43

District/Specialty Courts*: 114

This has implications beyond total numbers, Trump is flipping or is on the verge of flipping Circuits:

Of the judges confirmed under Trump, 43 are appeals court judges — a very impressive number. In fact, this is 14 more appeals court judges than George W. Bush, 16 more than Clinton, and 22 more than Obama had confirmed at the same point in their presidencies.

Additionally, Trump has flipped the Third Circuit Court of Appeals (which covers Pennsylvania, New Jersey, Delaware, and the Virgin Islands). For those unfamiliar with the term, “flipping a circuit” means creating a majority of judges on a circuit court who were nominated by presidents from the same party. Trump is also on the cusp of flipping the Second Circuit of Appeals (which covers New York, Vermont, and Connecticut) and the Eleventh Circuit Court of Appeals (which covers Georgia, Florida, and Alabama). Trump has even made notable gains on the notoriously liberal Ninth Circuit Court of Appeals (which covers Alaska, Washington, Idaho, Montana, Oregon, California, Nevada, Arizona, Hawaii, Guam, and the Northern Mariana Islands) where there are now 16 Democrat-appointed judges and 12 Republican-appointed judges with one vacancy.

This seismic shift in the composition of the federal judiciary is getting almost no current mainstream media coverage because all the oxygen is being taken up with Democrats’ impeachment efforts.

Slowly, surely, Trump is creating a legacy that will last a generation.

As I sais a long time ago – Trump will be the most effective conservative president in the last 50 years.

Yep and that just rankles the Never-Trumpers like Bill Kristol. LOL

So be it. They had their chance over the last few decades and they blew it.

and, other than Regan, that’s a *very* low bar.

add into the mix that Ronnie trusted his “allies” in Congress, who F’ed us all over, and it becomes “advantage Trump”.

Oh yeah? Well Jugears had a pen and a phone. So there.

Liberals have used the courts to enforce policies that can’t win at the ballot box. Nobody on the left is focused on this; to them the SCOTUS is all that matters. If/when another appointment on that court (RBG) becomes available, the left will go nuclear to stop it if Trump is in office to fill the appointment. It’s almost as if the Left is now fighting against providence and they are losing.

TheOldZombie in reply to technerd. | November 5, 2019 at 12:18 am

I honestly think this whole impeachment thing is from the fear that Trump will not only get to replace RBG but he will be in a position to replace at least one more justice in the next term.

I think Breyer may retire in the next couple years. There was also a rumor that Thomas may retire if Trump was elected to a second term.

I wonder if the impeachment fervor is part of a strategy to set up removal of judges he appointed through the dishonest talk about him never having be a “real” president.
They have signaled stuffing the Supreme Court, they want to impeach Kavanaugh for the lies they told about him.
The left has RBG to worry about being replaced by Trump, which is yet another earthquake moment they will face and not that I’m wishing her dead, I don’t think she is doing nearly so well as the media would have us believe.
The leftists were always on the wrong track, in my opinion, but they have gone outright nuts in their actions since Obama became president. Masks have dropped, and it’s not pretty.

      dunce1239 in reply to oldgoat36. | November 5, 2019 at 2:55 pm

RBG could have stepped down while obama was still able to appoint another younger evil witch but she thought hillary was a shoo in.Oops.

Intending to be a bit a bit flippant about the RBG’s situation, a second Trump term means that RBG will be mummified if necessary to keep her on the bench.

God help us if President Trump does not win a second term.
These court appointments are not just President Trump’s legacy but one that will sustain We the People and our Republic.

democrats are fantasizing about a president pelosi. Not sure how they got rid of Vice President Mike Pence in this fantasy, but they did. The fantasy script has nancy reversing every piece of legislation, appointment and executive order of President Donald J. Trump. She’s dancing to the Nutcracker Suite in this script, spilling her martini all over the place as she swirls around kicking giant Christmas ornaments with PDJT accomplishments painted on them. At least that’s what I heard was in adam schiffs impeachment screenplay. The democrats are so far into denial and TDS they can’t see the writing on the wall.

“”Not sure how they got rid of Vice President Mike Pence in this fantasy, but they did.””

Same way they get rid of Trump. In their dreams.

Milhouse in reply to CKYoung. | November 5, 2019 at 1:10 am

Also, if it ever got to that, she would have as much trouble “reversing every piece of legislation, appointment and executive order of President Donald J. Trump” as Trump has had reversing those of President Barack H. 0bama.

Barry in reply to Milhouse. | November 5, 2019 at 10:02 am

Right, because the courts are always fair to both sides.

Milhouse in reply to Barry. | November 6, 2019 at 3:34 pm

        1. The courts are usually fair
        2. There are plenty of judges who would be just as happy to spike Pelosi’s agenda, especially if she gained the White House in such a fashion.

Colonel Travis | November 4, 2019 at 11:08 pm

I think the (D) party knows this, which is part of the reason for their absolute freakout.

Looking at RBG’s seat by end of November.

Yet a three judge Circuit panel unanimously ruled against him today.

    txvet2 in reply to MTED. | November 4, 2019 at 11:28 pm

It’ll be appealed to the full circuit, and then in the fullness of time will arrive on SCOTUS’s doorstep. It’s not going to happen anytime soon, if ever. Trump has no legal problem – he gets audited every year. It’s all about the optics.

Milhouse in reply to MTED. | November 5, 2019 at 1:12 am

Sometimes he’s wrong. Even his own nominees will rule against him when that happens.

BriVermonter in reply to Milhouse. | November 5, 2019 at 5:01 am

So, do you think his accountants may face a fine?

      The IRS apparently are satisfied Trump has paid what he owes;
Perhaps we should disband the IRS if it performs no useful function….

      Yaaawwwwnnnnn….

      oldgoat36 in reply to Milhouse. | November 5, 2019 at 6:41 am

The number of years wanted and the look of this being a fishing expedition over something that is not a crime seems weak to me. I would expect a left leaning judiciary to rule against him as they have played that game since his election. I am not so sure they have the case for his taxes to be handed over to an openly hostile prosecutor for the claims they have made regarding why they want them.

Zardoz in reply to Milhouse. | November 5, 2019 at 8:43 am

I really like the fact that President Trump does not put “yes men” in any position. That is a strong character trait that DemonRats just do not have. President Trump 2020!

drednicolson in reply to Milhouse. | November 6, 2019 at 2:27 pm

Obama had lots of his shenanigans shut down by the SCOTUS, and many of those cases were unanimous decisions (no dissenting opinions).

When even the liberal justices on the court are going hell-no, you know you’re doing something wrong.

Shhhhhhhhhhh!!

And yet, any one federal judge can issue a stay on virtually any action of the President and create one months-long delay after another…

    oldgoat36 in reply to clintack. | November 5, 2019 at 6:44 am

This is overstepping the role they have, they know a showdown is coming over this. Even squish Roberts has talked against this. Judges have way overplayed their powers with this, and it is going to have to be addressed.

“*Yawn* Man, that was a good nap. Anything happen while I was asleep?”

“The Revolution.”

President Trump will have appointed 13 of the 29 active judges on that court

That’s all well and good, but supposedly conservative judges are notoriously unreliable. They start looking to their “legacy” and seek accolades rather than doing their job. They like being positively portrayed in the press and no longer being disinvited to the best parties. They know their “legacy” is written by the left.

Also important is the death of the “blue slip” where Republican appointments e.g. in California had to pass muster of two Democrat Senators. Those previously appointed Republicans were often as liberal as Earl Warren.

Maybe not all these nominees will turn out to be “perfect” but the overall difference between them and what HRC would have appointed will still be enormous. That was the number one reason I supported Trump in the 2016 general election even though I had not been an original Trump supporter and still had some doubts about him. I could not understand the waffling of those who claimed to be on the “right”.

After the tweets and the collusion/Ukraine scams are long forgotten this will be a real difference-maker.

Even better instead of siccing the EPA on farmers and ranchers and mines, he is siccing them on California who now needs to actually clean the air, not virtue signal by having the glitterati drive Priuses and Teslas. Oh and clean up their either Dickensian or even Medieval sanitation on the street problems.

And after all, building the wall. Blocking people – they have to stay in Mexico waiting for their Asylum claims, and those entering Mexico are stuck at the southern border.

Jobs have come back, especially at the low end and for minorities (eroding the Dem’s base), We’re stopping China’s Kleptocapitalism at our expense, and fixing Mexico-China.

What is probably most annoying to the #NeverTrump and Cuckservative crowd is that Trump is actually getting things done. Every other candidate talked well but cucked in office.

That is one thing I noted about Trump almost a year before the election. I didn’t like many things but I knew he would try his best to do them – he knows how to drive a bulldozer and piledriver.

Beyond his manner, and tweets, his actually keeping his campaign promises! How gauche! He isn’t supposed to do that!

We need to give POTUS four more years to repair the decades of legal and societal damage wrought by the appointment of self-congratulatory, agenda-advancing Dhimmi-crat zealots and narcissists to the federal bench, partisans who are unable and unwilling to adhere to a jurisprudence of modesty and restraint.
