Virginia Election Fallout: Gov. Northam “Working On” Assault Weapon Confiscation

Having survived a myriad of scandals, including his wearing blackface while in med school, Virginia governor Ralph Northam (D) is extremely happy with the results of this week’s election.

He’s so happy, in fact, that he is reportedly “looking into” ways to confiscate guns from Virginia residents.

Northam apparently sees the election results as a mandate.

The Washington Post reports:

Virginia Gov. Ralph Northam (D) used a Cabinet meeting Wednesday to showcase all he expects to get done with a state government under Democratic control for the first time in a generation.

Northam, still buoyant after his party wrested control of the General Assembly from Republicans on Tuesday, assembled his team in a ceremonial meeting room in the State Capitol, instead of the workaday Patrick Henry Building, where they typically meet.

“Virginia spoke and we’re going to listen and we’re going to take action,” said Northam, who is halfway through is four-year term.

Riding high, Northam’s agenda items on which to “take action” not only include gun control, but also include the confiscation of “assault weapons” (whatever those are).

WaPo continues:

Regarding gun control, he referred to eight “common-sense” bills he proposed for the special legislative session he convened in July, in the aftermath of a mass shooting in Virginia Beach on May 31. Republicans who controlled the General Assembly shut down that session after 90 minutes — sending all of the bills to the crime commission and promising to reconvene after the election.

Northam mentioned universal background checks, banning the sale of assault weapons and high-capacity magazines, restoring the law that limits purchases to one gun a month, and a red flag law that would empower a court to temporarily remove a gun from a person deemed to be a risk to himself or others.

“We will at least start with those,” he said.

. . . .  Asked whether he supports confiscating assault weapons from gun owners, Northam demurred.

“That’s something I’m working [on] with our secretary of public safety,” he said. “I’ll work with the gun violence activists, and we’ll work [on] that. I don’t have a definitive plan today.”

It’s important to note here that Northam avoided questions about other issues like right to work and allowing teachers and public sector employees to unionize by dismissing them as “hypotheticals.”

Asked whether he would consider a repeal, he said: “That’s a hypothetical question. I deal with what’s put on my desk. But what I would say is that, while we’re the Number One state in the country in which to do business, I want to do everything that I can to support our workers as well.” He mentioned raising the minimum wage — he could not be pinned down on a dollar amount he’d find reasonable — and bolstering workforce training.

Asked whether he would support allowing teachers or other public-sector workers to unionize, Northam said: “Again, you’re asking hypotheticals, and if something like that gets to my desk, I’ll certainly look at it.”

These are to his credit; however, his failure to similarly call the state’s unconstitutional confiscation of legally-purchased firearms from law-abiding citizens a “hypothetical” is telling.

    The American Revolution started on April 19, 1775. It was not at Concord or Lexington; although they were involved. After being forced to retreat from Concord, the British reached a place called Meriam’s Corner, where the road turned towards Boston. Up till then, it was the local militias of the villages the Brits had attacked who were fighting them. At Meriam’s Corner, the militias of all the surrounding villages which had not been attacked came to the aid of Concord and Lexington. And they chased the British back to Boston and would have wiped them out if Lord Percy had not come out with a relief column. They did besiege Boston, and the war was on.

    The first few armed citizens attacked by the state will lose. They may surrender. They and their families may well be massacred [the most likely outcome]. But the day will come when those armed agents of the State surrounding armed citizens will themselves be surrounded by either an organized or an impromptu militia. And the agents of the State will come off second best.

    And in these days when civilian status no longer protects anyone, those who massacre the women and children of armed citizens may find that their own families will become targets. The Left always assumes that no one will fight back, because they have not yet.

    I reference José Calvo Sotelo and also THE WRATH OF THE AWAKENED SAXON by Rudyard Kipling. I admit that I expected it to start somewhere other than Virginia.

Seems pretty clear. Lots of thorny questions are hanging over the state govt, questions he doesn’t want to deal with. So he’s making a big show of chasing after something he knows he won’t get. That way he’ll actually get through his term without having to do anything. The bureaucratic definition of “success”.

    No, we are getting what 50%+1 of the judicially gerrymandered districts voted for.

    I have voted again and again to reduce the number of gov’t teat-suckers in NorVa. As well as advocating for direct, personal penalties against judges who see themselves as tyrants in robes.

      Gerrymandered districts do not affect state-wide election, except when they discourage voting, because “my vote won’t count”, but I’d blame the Republican Party for those people not being educated to vote anyway.

If what he is hearing is “violate 2nd Amendment rights” because of a Legislative majority then I suggest a red flag hearing is in order for him, because he may be actively hallucinating. Cannot have that one in charge of the commonwealth’s police and militia.

Governor Blackface and his left wing legislature can pass any laws they want, be they legal or illegal, but the question is: How is he going to enforce them? Laws that restrict constitutionally protected rights have a pretty long history of non-compliance. Ask NY how that SAFE act is working out for them.

Well, “Buckwheat,” how do you propose to confiscate “assault weapons” when…

1. You can’t (or won’t) get a handle on the flow of illegals and narcotics crossing VA state borders now.

2. Virginia LEOs already have their hands full with other tasks.

3. Various VA localities (especially rural ones) will inevitably declare themselves firearms sanctuaries or just quietly ignore any legislation you sign.

4. It’ll be ridiculously easy to set up smuggling pipelines since VA is surrounded by five other states (six if you include nearby Pennsylvania).

Get back to me when you get a clue, Ralph.

if what comprises the legislature in VA is really stupid enough to vote ” confiscation measures ” into law then the immediate question is: who are they going to get to enforce it?–to a man(and woman)around here at least, have not met and do not know ANY city/county/state law officers that will comply–would presume a similar sentiment in VA–therefore then, who is going to do it?–will have to be some fed agency and aren’t fed agencies subject to the jurisdiction of the WH?–do these fools really believe that the nat’l guard let alone the US military are going to go door-to-door with impunity merrily confiscating weapons?–this can and should be stopped at the federal level by the WH–literally unconstitutional on its face

those charged with enforcement will likely refuse en masse and then we’ll see what these progressive/fascists are made of and if they’re willing to risk their own personal safety to advance their agenda

    One thing to consider: it’s all well and good that those currently possessing “assault weapons” will keep them because they simply won’t give them up (or won’t be seriously asked to give them up), but the firearms sellers will comply immediately, since they operate at the pleasure of the gov’t. And there goes the ability for anyone to buy a new sporting rifle. Or a used one from someone who thinks they have too many on hand.

    I think there might be a lot of Virginians taking up a second residence in a nearby gun-friendly state if Northam were to pull off legalizing confiscation.

What I *suspect* will happen (although I could be terribly wrong) is that Northam is doing a fake-out. If so, he will continue to talk up firearm confiscation (to keep the base whipped up) while doing absolutely nothing, and waiting for a shooting to ram something fairly trivial through. Perhaps a toothless large capacity magazine ban, something to the effect of “You can’t buy them but if you own them prior to X, that’s OK” or a ban on the sale or importation of vaguely defined assault weapons which won’t be enforced unless they find somebody to properly hate. (Selective enforcement is a wonderful tool of the ruling class)

Northam is a liar. In any event, he doesn’t need to confiscate anything. The text of HB4021 and SB4024 are clear: “it shall be unlawful for any person to import, sell, manufacture, purchase, posses, or transport an assault firearm. A violation of this section shall be punishable as a Class 6 Felony.”

An assault firearm having been re-defined in the same bills as essentially as any semi-automatic pistol or rifle with “the ability to accept a detachable magazine.” Same goes for magazines over 10 rounds, threaded barrels, muzzle brakes, suppressors, you name it.

That and numerous other bills overturning preemption etc., etc., etc.

I cannot afford to be convicted of a felony, therefore most of my power tools will be relocated nearby but out of state.

It’s going to get interesting around here. There are a whole lot of folks that are itching for the party to get started.

I’m still waiting for a logical explanation as to how it is within the purview of a state or local government to restrict the rights granted by our national Constitution. Seems to me our Constitutional rights should be the same everywhere in this country.

    Every single Democrat and those openly farther to the Left assume that the Constitution neither enumerates nor grants any rights to the individual, so the state can do anything and there is nothing to restrict.

    I’ve long wondered how the idea that our rights can vary as we displace ourselves from one jurisdiction to another (even within the same state, never mind when traveling from one state to another) became fixed within our laws. It makes no sense when one considers that our rights are alleged to be beyond the authority of the state and not within the purview of the mob, and that all jurisdictions within the nation are nominally operating under the same republican concepts of natural rights and due (judicial) process.

    The rights are not granted by the Constitution. They preexisted and are enumerated by the Constitution.

    State and local governments have restricted those rights in the past and will continue to do so as none have been punished for it. However, there is a process – U.S. Code 242 Deprivations of Rights Under Color of Law:

    “Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.”
