The New York Times reports that the administrative review of the Department of Justice investigation of the Trump campaign has shifted from an administrative review to a criminal investigation.

The Times makes sure, in the sub-headline. to try to taint the criminal investigation as leaving Attorney General William Barr “open … to accusations that he is trying to deliver a political victory for President Trump.”

For more than two years, President Trump has repeatedly attacked the Russia investigation, portraying it as a hoax and illegal even months after the special counsel closed it. Now, Mr. Trump’s own Justice Department has opened a criminal investigation into how it all began.

Justice Department officials have shifted an administrative review of the Russia investigation closely overseen by Attorney General William P. Barr to a criminal inquiry, according to two people familiar with the matter. The move gives the prosecutor running it, John H. Durham, the power to subpoena for witness testimony and documents, to impanel a grand jury and to file criminal charges.

The opening of a criminal investigation is likely to raise alarms that Mr. Trump is using the Justice Department to go after his perceived enemies. Mr. Trump fired James B. Comey, the F.B.I. director under whose watch agents opened the Russia inquiry, and has long assailed other top former law enforcement and intelligence officials as partisans who sought to block his election.

This could be hugely significant, or the Times going out on a limb again.

The possibility that William Barr and others working for him would expose criminal conduct among key players who tried to take down Trump explains why Democrats have tried so hard to demonize Barr.

Regardless, people are freaking out, including many of the people who build names for themselves and huge Twitter followings by pushing the Russian collusion hoax.

      I realize that when they say “We haven’t even seen the predicate for the investigation yet!” what they’re really saying is that they’re pissed off that Durham’s information hasn’t been leaked to them, and that Durham & Barr are doing a very good job at managing their operational security.

      No, a prosecutor is not supposed to let the opposition rifle through his files before he even files charges. Doesn’t work that way. But Washington is outraged that they aren’t being allowed to do so.

    The DOJ cannot afford to make mistakes. This is almost certainly the worst criminal conspiracy ever so they have to get it right with an airtight case.

    The guilty are trapped with nowhere to run. It’s the key part of their corrupt bureaucracy, the one they are trapped in and dependent on to get out of this, that is facing doom as the steamroller slowly approaches. They have to stay put and continue to conspire while the it slowly gets closer and closer.

    Unless the steamroller runs out of fuel or gets otherwise derailed, the rats getting crushed is inevitable. It will be very ugly when that happens. We can already feel the sense of panic. It’s a war of nerves at the moment. The rats will soon turn on each other and it will be game on.

      I wish I could share in your optimism, however the media will label any misdoings as a conspiracy theory and my money is on Barr doing a Comey impersonation and decide that “no reasonable…..Blah blah blah!

        I don’t have any more information than anyone else so I am just stating what I believe must happen if the DOJ is doing its job. I’m as frustrated as anyone so far, especially with the congressional GOP polymorphs and the endless hold on IG Horowitz’ report so I don’t know if I am particularly optimistic. But I can easily understand Barr being extremely deliberate in getting this right and winning right out of the gate.

        These cases will not be won in the media but in court. By winning right from the start with key cases, the DOJ would immediately put the rats on their heels. It won’t be long before the smug sanctimony and confident smirks get wiped off of their faces. I am not hearing confidence among them these days, just desperation.

Look, in any case where the CIA director reports “We have evidence that a presidential candidate is being influenced by Russia”, a *good* president would do certain things:
1) Establish a NEUTRAL group with no other ties who would have one and only one task: Analyze the intelligence and report *only* to two people, the FBI director and the President.
2) Put bloodthirsty and iron controls over that group. No leaks.
3) Document every action, every decision, classified like above.

A bad president will… do none of that.

    How would a good president do any of the things you listed if he didn’t know there was an investigation? Comey told Trump specifically that he was NOT under investigation for collusion. If the POTUS was under investigation why would the CIA and the FBI report to him? Your whole comment makes no sense.

    I realize your speaking about the previous administration. However, there had better be ironclad evidence of criminal conduct for the president to get involved at all. Being “influenced” is not criminal. Monitoring a candidate for president because you think he’s being “influenced” is a big No No.

    Of course what really happened is they just wished to destroy the candidate and broke every law possible in attempting to do so.

Blah blah blah. Wake me up when a few of those treasonous pricks swing by the neck. Until then it’s all just Kabuki.

OK, no excitement until something is actually seen. Based on the last decade or two, it is fairly obvious that most of the government has no loyalty to the Constitution, with especial emphasis on the DOJ. I will consider believing it after seeing it AND checking it out independently.

Here’s the bottom line. Durham would not have made it a criminal investigation unless he had some very strong evidence that cannot be explained away by slick lawyers. He has a reputation of hard-nosed tactics and I do not believe he would take this step without a major find. Now whether or not it leads to any convictions I can’t say but I believe that his professionalism says that he is on to something big. A grand jury will make his job a lot easier and more threatening than just asking questions as has been doing since Barr took over.

Will Durham and Barr go after 0bama? It is clear that 0bama knew and approved all of the abuse of power, corruption and illegal acts by those in the 0bama admin regarding the Russia Hoax which should now be call 0bamaGate. Also, will they include the injustice that was done to General Michael Flynn and how 0bama admin went after Flynn based on lies and false accusations?

    With respect to Flynn, Sidney Powell is taking care of the injustice there. I suspect it will be wrapped up in a few weeks with a favorable conclusion for the General.

    Obama is dirty, of course. Get everyone leading up to him, get those bastards Brennan and Comey, Clapper, Lynch, and we’ll have a good start. Get the underlings that carried out all the dirty business. We’re talking probably fifty to a hundred top level people.

When discovered, this lead to the furious coverup lead by US alphabet agencies, paul combetta’s panicked plea for help on reddit, deletions of emails under subpoena, bleachbit/acid wash, fbi approved destruction of Blackberries, simcards, laptops, grants of immunity to multiple obama admin personnel and much more. comey, brennan, clapper et al were not so much covering for hillary, they were covering for RENEGADE. They rigged the election for hrc so they could continue this coverup, BUT SHE LOST. A few months ago this post would have been flat out dismissed as conspiracy theory, and some will do so this very day. But it is all going to come out. Much of our government and ‘get you six ways from Sunday IC was/is corrupt to the core.

A bit of caution. It is well to remember that likely 100% of the FBI and CIA are corrupt, as well as 95% of the DOJ. And there are more than a few Federal Judges that use their bench to propagate the political deconstruction of the Constitution and the rule of actual law.

    I’d like to point out, I’m not a lawyer, and this is amazingly readable for me. I really suspect part of it will wind up in an upcoming book, and more power to it. Hopefully, the prosecutors in this case will get exactly what they deserve in court, and Flynn will wind up with damages AND a best-selling book.

I wish to register my deep disappointment in our “Intelligence” community. Good grief, with the tools at hand, they couldn’t steal an election without leaving their greasy thumbprints all over everywhere?

    The sloppy operations to gain access to the Trump campaign are easily understood, if you realize that they were not really panned, but were a reaction to unforeseen circumstances in late 2015 and early 2016.

    In late 2015, Servergate, which had been quietly shelved by the FBI, resurfaced and began to gain traction. And, as Trump gained momentum, HRC was placed at risk of criminal indictment, if he won. At the beginning of 2016, Adm, Rogers cuts off outside NSA/FISA 702 access to the NSA servers, denying the Obama administration unfettered access to their contents. They are now blind, with regard to the Trump campaign. A mole is inserted to provide information and the IC community begins establishing a predicate to open a counterintelligence operation and gain a FISA title 1 warrant to give them access to the campaign. This is rather slap dash operation involving the CIA, State, FBI, and foreign government IC assets. When the “intelligence” generated by these activities fails to provide enough traction to procure the desired FISA warrant, the Steele Dossier, largely designed as a public oppo research weapon, is utilized, possibly along with a highly sympathetic FISA court judge, to procure the desired warrant, not against the original targets but against Carter Page, an FBI asset who recently left the campaign. And, the FBI, in the person of James Comey states that HRC will not be prosecuted after laying out a prima facia case for her indictment over Servergate. Unfortunately, HRC loses the election. In an effort to continue to protect HRC and now themselves from criminal indictment, the operation switches to finding grounds for impeachment.

    It was never a carefully planned operation with cut-outs installed, but a hurriedly slapped together series of operations designed to allow the election of HRC, after which it would all be forgotten.

Let’s not do a victory dance just yet.

      I think I prefer to be a pessimist here — less risk of disappointment and I’ll be delighted to be wrong.

      When Strzok and Page are in handcuffs, I’ll join you for a few steps. (Try to remember that you asked for it, I’m a terrible dancer.) When Comey is wearing orange, I’ll apologize for my skepticism and gladly buy the first round of drinks.

If I was low on the corruption totem pole I might start worrying about an unplanned suicide or being thrown under the bus to cover for higher-ups.

Well, that’s soft-pedaling it. If these rats had been content to confine their nefarious activities to the election, they would probably have evaded the present scrutiny. But they’ve continued their attempts to torpedo the Trump administration long after the election and inauguration, practically forcing it to do something about these crimes.

BTW, will this investigation include today’s shocking revelation that the Professor studied in Russia in 1980? That can’t be good.

The next Democrat President will pardon all of them.

I have a different take on what we are seeing, than most. I do not think that this development weans that any prosecutions will come of this investigation. My present theory is that we are watching a three way internecine civil war between Establishment factions and President Trump. I’ll provide a quick explanation.

Following Trump’s election, you essentially had a two way conflict, the Establishment v Trump. The Establishment strategy was to remove Trump, largely through impeachment. After a year and a half, this strategy was a failure. And, not only was it a failure, but it was becoming a real danger to certain Establishment interests as it continued to expose the improprieties and illegalities engaged in by the Obama Administration. So, a new Establishment faction appeared, the Lay-Off Trump faction. Its goal was to get the Get Trump faction to abandon its impeach Trump strategy.

To understand what is going on in DC, you have to remember, and accept, the fact that, with the exception of DJT, there is no one in that city who is not a member of, a supporter of or otherwise beholding to the Establishment. There are no independent white hats. Following the 2018 elections, which gave the Dems control of the House, the LOT faction inserts a fixer, Wm. Barr, into the office of the AG. The evidence that Barr is a member of the Establishment is the ease in which he was confirmed in the Senate. He has three jobs. The first is to control Trump’s retaliatory attacks on his enemies. The second is to bring pressure to bear oin the Get Trump [GT] faction to lay-off. And the third is to control damaging information. After all, the whole purpose of the LOT faction is to keep the GT faction from burning the house down to get Trump. To accomplish this, an alliance is formed between Barr and Trump. Then Barr, ends the Mueller SC and, at the same time, protects Rosenstein and the others involved. He then goes before Congress and pointedly warns them that Trump was spied on, the inference being illegally, and that it may have too be looked into. The Horowitz IG investigation, already in progress, begins to be leaked. And, the Durham investigation gets started. Durham is assigned this investigation by Barr. When this does not stop the impeachment juggernaut, Epstein, a highly protected asset of the Establishment, is mysteriously arrested. This is a threat which puts pressure on the GT faction, including the Clintons. Epstein mysteriously “hangs” himself while in custody. It is interesting to note that Huber’s “investigation” into surveillance abuses and the handling of the Clinton investigations by the FBI/DOJ has totally disappeared from the radar. Almost as though it never existed at all. The GT faction doubles down by dropping all of the GT investigations in the House and puts Schiff in charge of manufacturing an impeachment charge against Trump. The counter move, by the LOT faction is the leaking of information that Barr and Durham are in Europe “investigating” the CI predicate for the Crossfire Huurricane op in the FBI. The GT faction continues. The Republicans in the Congress sit on the bench and do nothing. Now, in the last week four significant things have happened. The first is that Trump is now unleashed and is going full on junkyard attack dog on his opponents. The second is that noted Establishment lapdog, Lindsey Graham has done a 180 from harshly criticizing Trump’s tactical withdrawal from Syria to praising it. The third is that the Republicans, in the House, got off the bench and stormed Schiff’s Bastille in a show of mini-solidarity with Trump. The fourth is that the DOJ leaks that the Durham investigation is now a criminal investigation and identifies specific targets. On the last point, the Durham investigation was always an criminal investigation. There was no predicate for it to be a counter intelligence operation and the DOJ can only open an investigation when there is reasonable suspicion of criminal activity. Everyone in DC knew this already. And, we have known who was going to be in the cross hairs of any investigation for two years. Where this goes now depends upon two things. The first is how the GT faction responds. Being as deeply invested in the Trump impeachment strategy as they are, it would be extremely difficult for them to withdraw until after first of the year. The second is how far the LOT faction is willing to go to stop them. Will the GT faction burn down the house to protect themselves? Will the LOT damage the house significantly to stop them, in the hope of salvaging some of it? One other factor is how will the populous react to all of this. We are currently on the brink of a public shooting civil war. What is the tipping points on that?

    You have put together in a very coherent form a lot of thoughts that have been rolling around my head, and several others that I didn’t think of that have some bearing on the overall concept.

    I have been trying to reconcile two contrary thoughts in my head: the crimes of the Obama Administration Justice Dept, FBI and intelligence officials seem obvious, and must be prosecuted if the republic is to survive, but the only people who could possibly be in a position to do that job are already captive within the system.

    A wild card…I don’t know if this matters in the “big game”, and I don’t know if it will have any practical effect, but what if the SDNY, working with Manhattan DA Vance and New York State Attorney General Laetitia James, drum up some criminal charges against President Trump and indict him. I know the Justice Dept’s prior position prevents a federal indictment before impeachment, but what if they aid the city and state in obtaining state charges against. And if they do, what if the House uses those charges as a predicate for impeachment?

    Maybe my thinking on this is weak, but I fear a surprise attack from this unexpected direction, giving the Republicans in the Senate a fig leaf to vote for removal after the impeachment.

    All this reminds of the ABC miniseries from the late 70’s “Washington Behind Closed Doors”. Jason Robards plays Richard M. Monkton, an obvious copy of Nixon. His underlings create a Watergate-style conspiracy, and also send the FBI after the CIA, while at the same time the president asks for a top secret report that will expose massive wrongdoing by the ersatz-Kennedy character, who defeated Monkton for election. Monkton wants to avenge his prior loss and expose the Kennedy knockoff (even though he’s long dead) and take the CIA down. But the CIA head a supporter of that former president and starts his own top secret investigation into all of Monkton’s actions. He winds up trying to blackmail Monkton. Monkton tries to tough it out, but his crimes are exposed and he’s forced to resign.

    All this impeachment vs. Barr-Durham reminds me of that, only a lot of this real crisis is out in the open. Of course, even a well-designed fictional crisis is just a tip of the iceberg compared to all the wrongdoing in this instance, but the race is really on to see who can score a decisive blow first, and who can convince the public that their charges are “real”, and those of the other side are “fraudulent”.

      The NY state investigations of Trump are very likely part of the Get Trump Establishment program. And, it does present a potential danger to Trump. However, none of this action is happening in a vacuum. The Establishment controls most, if not all of the major political machines in this country. They have been working at it foe over a century. So, some prosecutor in Manhattan is not going after Trump if someone in authority in the Establishment tells him not to. And, the LOT faction will bring pressure to bear to slow or stop that. Also, remember that the Jeffrey Epstein arrest, which made NO sense at all, came out of the SDNY, which was working against Trump just months ago. The Establishment influence in government, at all levels, is pervasive. How these various investigations and prosecutions go, both state and national, will depend which Establishment faction has the most influence with that particular prosecutor.

      Now, what is so crushingly disheartening, is the realization that the American public has almost no real control over their government. And, as that fact sinks in in a growing number of people, what will the people do? The people elected Trump. And an unelected Establishment is deciding if he remains in office. Disturbing stuff.

    I believe that Graham is poking around to find solid ground to stand on. His relationship with McCain has soured most of us permanently on him. I will never trust him. He made a great speech at the end of the Kavanaugh hearings but so what? So did Susan Collins. Did that change our minds about her? No!

    Graham sees all of his long-time allies in the Senate either retiring or in trouble in the polls and can’t find traction himself. He is always right there with Romney and the other “pearl clutchers” criticizing Trump over his tone, “inappropriate” tweets or other picayune details. He chairs a very powerful Senate committee and could be issuing a lot of subpeonaes of his own but all he ever does is issue comments or make speeches.

    I wish he would retire.

      I don’t know enough about the man, Phil. It’s just that I have some hope for him after lighting up the Dems during the Kavanaugh hearing. There’s fire in him – was it just for Kavanaugh and that evil the Dems tried to foist on him, or is it a present indication that he’s keeping his righteous indignation in check for the bigger picture? I just hope when the call goes out, he musters. All I got anymore is hope.
