Democratic presidential candidate Sen. Elizabeth Warren (D-MA) proposed the Refund Equality Act in order to provide past tax refunds to LGBTQ couples. From NBC News:

“The federal government forced legally married same-sex couples in Massachusetts to file as individuals and pay more in taxes for almost a decade,” Warren said in a statement. “We need to call out that discrimination and to make it right — Congress should pass the Refund Equality Act immediately.”

A report by the Joint Committee on Taxation released Tuesday estimated that taxpayers who were in same-sex marriages prior to the repeal of the Defense of Marriage Act in 2013 would be eligible for up to $57 million in refunds. Warren introduced a version of the bill in 2017.

The Supreme Court “struck down the Defense of Marriage Act” in 2013, which then allowed gay couples “to file joint federal tax returns.” Then in 2015, the Court legalized same-sex marriage in America.

Warren first proposed this idea back in 2017, but it never went anywhere in Congress. Two House of Representatives introduced a similar act this year:

Warren’s new version of the bill complements the Promoting Respect for Individuals’ Dignity and Equality (PRIDE) Act of 2019 that was introduced to Congress on June 18 by Representatives Judy Chu and Andy Levin. If approved, this legislation would also allow same-sex couples married in states that recognized gay marriage before DOMA was overturned to file for refunds with the IRS. Both the PRIDE Act and Refund Equality Act aim to readjust the systematic discrimination by the U.S. government against LGBTQ+ people in terms of taxation.

“This bill will correct an older injustice against same-sex couples and put money directly back into the pockets of families who have earned it,” Chu said in a statement. “For too long, discriminatory laws penalized same-sex married couples by denying them the ability to file jointly and claim tax refunds they were entitled… Because of IRS restrictions, these couples cannot amend their returns to claim reimbursement credits for many prior tax years. The PRIDE Act solves this problem.”

The government owes them $50 million?! Um, no, Sen. Warren. The government has money due to us taxpayers so you’re basically saying that us taxpayers owe them $50 million. We do not owe anyone anything.

I have a better idea. How about the government stop spending and overhaul the tax code? Everyone seems to complain about these loopholes and exemptions. Why not get rid of them?

Injustice? Did we not cure that injustice when the Supreme Court finally decided that gay couples should receive the same benefits as straight couples?

You know what else I love? No one mentions which administration implemented the Defense of Marriage Act. It happened in 1996. Gee, who was president then? DEMOCRAT Bill Clinton.

But where does this all end? Who will pay for all of this? The government has no money so will it have to raise or implement new taxes? Is it not enough that gay couples finally have the ability to marry under federal law like everyone else?

When you give anyone in the government an inch they go a mile. They will not stop with this.

No Democrat has won the white Presidential vote since the 60’s so they know that’s hopeless. Their only hope is to carve up into the country into small enough groups that they can throw money at each group and keep them alienated from normal voters.

It needs to be called what it truly is, and penalties need to be paid by these politicians who call for such tripe. It is a bribe for votes.

They are threatening to use our tax dollars to bribe groups of people to give them power.

Bribes are illegal, yet nothing is ever done when it’s politicians using public funding to pay for bribing the dolt voters who would give them power.

It is frightening. It is selling away our country all so the left can gain power.

The idea that a small unelected group (or, even worse, a single person) can determine national policy—or, on their own, arbitrarily redefine words in the English language, thus destroying our primary tool of communication—should be anathema in any Republic worthy of the name. This pernicious trend must be reversed before something even more ridiculous is inflicted on us all.

When speed limits on a stretch of road are raised, everybody who got a ticket there gets a refund. What about when Republicans lowered income tax rates? Does everybody get a refund for the previous difference?

2020 is going to be a race to see who can give away the most free stuff. Republicans aren’t immune to that either.

I was going to suggest to Sen. Warren that her next step should be to give reparations to native Americans who didn’t get employment because some Faux native Americans took their job instead, but OMG, she has already proposed that!!

I want reparations because I was unpopular in high school.

Elizabeth Warren is obviously unfamiliar with the tax code.

There is a huge marriage tax penalty. The overall tax paid by married couples where both couples work is significantly higher than the tax that would be paid if they filed as single individuals.

    That is so true, but the worst part is that that tax policy drives the lower-paid spouse, who pays taxes near the maximum rate, to drop out of the workforce and stay home speaking only baby-talk, losing all society and work experience. Of course, singles and non-breeders are usually treated worse by the tax tables, as well.

    Would you agree that all Amerikans should face only the “single” tax category, thus eliminating all marriage penalty or privilege?

    Yes. The code flipped years ago. In fact families with large amounts of children get unfair benefit from the code. Those families are largely Hispanic, black , Muslim or Filipino. Perhaps those families that have 2-3 need reparations.

    Was this so? I always thought, and by my calculation, it came out about the same. I earned 4x my spouse and we had no children at the time. That being said, singles are relatively highly taxed, especially if you compare to families with one wage earner, and then with children. I paid the most tax when I was single without children, less when married, and lowest with children.

Mattmuson – that’s the ultimate objective, more for ME. Good job figuring that out.

I’m curious how this would work…. We are told that people *should* go out with people of th same sex, or transgendered people otherwise we’re bigoted. We are also told that gender, biological sex, and gender preferences are simply choices.

Why would there be reparations for choices? I’m not trying to do a ‘gottcha’ here. These are the common arguments I see from SJWs. There seems to be a push today where folks can freely define, or *choose*, their pronouns and other facets about their gender and sexuality.

So, I don’t know how this would work. How would you give reparations for choices? I mean, someone could “choose” to be… say a transgender male who’s with a biological female. That would define the union as visually heterosexual since the trans person is male presenting, but in his mind it’s a lesbian couple. Although they might have a marriage certificate, they’re still a minority couple…

I’m just playing the game with the SJW rules that are written.

They always had that ability. In fact, the exact same abilty as everyone else. They didn’t have the legal right to marry just anybody they felt like. For that matter, they still don’t.

    I wonder what percentage of gay people were against the whole marriage thing. Talk about messing up a perfect situation. “Gee honey, I’d like to get married, but the law won’t allow it.” I bet 98% of heyerosexual men wold love to have that excuse in play. 😉 Now the gays have no excuse, and like heteros, face the 50/50 odds of giving half of there stuff to someone they can no longer stand the site of. I always suspected that same-sex marriage was being pushed by divorce lawyers who wanted to increase the victim pool. To me, any extra taxes paid to be in a relationship, but not legally bound, should be looked upon as an acceptable cost of “doin business.”

      I have no idea who runs off with the loot in a gay divorce. Normally in American divorce it’s easy; except in rare cases, the man automatically gets reamed and the woman wins all the prizes. But which gay divorcee is chosen as the winner, and which as the loser? We need standards, dammit! Or at least a flurry of law reviews.

I think any group that has been discriminated against should receive reparations!

As someone of Irish ancestry, I should qualify!

A close friend of Italian ancestry should qualify.

Native Americans, even folks who are 1/1250 native Americans, should qualify too!

I think Christians in the Middle East should qualify. (After all, if borders aren’t important, why not include them?)

And so it begins…

Soon, every perpetually-aggrieved faux minority will be demanding “reparations” for perceived past “oppression”. How about reparations for the only true minority in this country – the hard-working American taxpayer.

All singles and the child-free are certainly entitled to reparations for all the extra taxes we have paid to support married people and other people’s children, almost since the beginning of time.

My wife and I resided together 2 years before we got married, yet do not qualify under her platform. Obviously Shrieking Crow is far less an attorney than her reputation suggest. Someone paid $700K per year for her opinion?

Why should we treat this “tiny, less than 3% of the population” group any better than any other “tiny, less than 3% of the population” group that exists? It’s not like any of these LMNOP people can vote more than once. Unless they’re dead. Then all bets on the number of times they can vote are off.

This seems improbable, as a married couple in which both earn about the same income usually pay in more, not less, federal income tax.

But in any case, it seems certain that at least some of these couples paid less than they would have, had they filed as married.

If those who would have paid less are to receive refunds then shouldn’t those who would have paid more be required to make up the difference?

The marriage tax is just as often a marriage advantage. The problem is that the only way tax law can be made indifferent to marriage is to have a flat income tax. Otherwise you’re stuck mathematically between contradictory requirements:

1. Families with the same total income should pay the same tax;

2. The income tax should be indifferent to whether couples are married or not.

You can’t follow (2) and (1) with one earner earning all the income, without a flat tax.

It used to be that the married tax rates flipped back and forth every decade or so as either one or the other unfairness came up in public debate.

Polygamists and other not politically congruent (“=”) groups.

You could claim that before gay marriage there was no legal claim of the one on the income of the other, so there was no question that traditional married couples were different from gay living-togethers.

Reparations for everybody!

Each of us pay ourselves $500 and declare the matter closed. Everybody goes away happy. Well, almost everybody.

Well, consider the 2020 field. The Dems have a huge flock of absolute nobodies, all trying to run against a veritable force of nature. Every one of them needs a gimmick or they’re toast. Worse, utterly invisible toast. They need airtime & news coverage, and they’ll need votes . . . and fortunately for them, the traditional Dem “divide and conquer” tactic is all about generating votes.

Bernie is trying to suck up to voters with crushing school loans.

Faucahontas is now obviously trying to pander aggressively to the gay axis.

Spartacus is trying to appeal to . . . I haven’t the foggiest idea. Ditto for Horizontal Harris, or Mr South Bend. Guillibrand is going after the incredibly stupid vote, but she’s just warming up; I expect great things when she really gets going.

But of course they’re all lying suckass Democrats. Nothing they say is intended to be taken seriously, and nothing constitutes an actual promise for the future. And really, we all know it.

As a conservative I’m constantly being discriminated against, especially in Education and by the MSM. Where do I sign up for my reparations?

Speaking of righting past wrongs, there is no one alive today who voted for the people who voted to give us an income tax.

The income tax exists today because of inertia, not because of a debate about it where those who have to pay it had any say in having to pay it.

REFUND EVERYONE! Don’t discriminate!
