Connecticut: High School Athletes File Federal Complaint Over ‘Transgender Women’ Participation in Female Sports Competitions

ADF: The policy violates Title IX by depriving females “opportunities for participation, recruitment, and scholarships”

Back in February, I wrote about two transgender sprinters who placed first and second in the Girls Indoor Track Championship held in Connecticut.  As I noted at the time, the same two transgender athletes had won the top spots the year before, as well.

Three of the girls who competed in the track championship have now filed a federal discrimination complaint against a statewide policy on transgender athletes.

Fox61 reports:

Three Connecticut girls who participate on high school track teams have filed a federal discrimination complaint against a statewide policy on transgender athletes, saying it has cost them top finishes in competitions and possibly college scholarships.

The conservative Christian law firm Alliance Defending Freedom filed the complaint on behalf of Selina Soule and two other minor girls Monday with the U.S. Education Department’s Office for Civil Rights. It seeks an investigation and actions to make competitions fair.

The ADF complaint centers on an alleged violation of Title IX in that the biological girls are being deprived of “opportunities for participation, recruitment, and scholarships.”

The Hartford Courant reports:

The conservative Christian law firm Alliance Defending Freedom filed the complaint on behalf of the girls Monday with the U.S. Education Department’s Office for Civil Rights. It seeks to reverse a Connecticut Interscholastic Athletic Conference rule allowing athletes to compete in sports corresponding with their gender identify.

The CIAC says its policy follows a state anti-discrimination law requiring students to be treated in school according to the gender with which they identify.

In its complaint, the ADF claims that allowing transgender girls to compete in girls sports deprives their cisgender (someone who identifies with their birth sex) peers of “opportunities for participation, recruitment, and scholarships” and therefore violates Title IX, which assures equal rights for male and female athletes.

For its part, the CIAC states that it believes the policy to be in full compliance with Title IX.

The Hartford Courant continues:

CIAC executive director Glenn Lungarini said Tuesday that the governing body had not been contacted by the Office for Civil Rights but would cooperate fully with any investigation. Lungarini defended the CIAC’s gender policy, noting that the organization reviewed the language with the Office of Civil Rights in Boston to ensure Title IX compliance and discussed the policy with Connecticut’s Commission on Human Rights and Opportunities.

“The CIAC is committed to equity in providing opportunities to student athletes in Connecticut,” Lungarini said in a written statement. “We take such matters seriously, and we believe that the current CIAC policy is appropriate under both Connecticut law and Title IX.”

The intersectional left is going to be forced to face a very real quandary: do they support protections for female athletes or don’t they?  No matter how much they want to normalize transgender identity or how loudly they insist that men can become women through surgery, medication, and wishful thinking, the fact remains that men are biologically men.  When they compete with biological women in most endeavors requiring athletic ability, they will win.  They do winAll the time.

Unsurprisingly, all of the 2020 Democrat frontrunners support the Equality Act which includes forcing schools to permit transgenders to compete in sports against biological women.

The Daily Caller reports:

Every Democratic presidential candidate polling above 1% supports a bill that would force schools to include male athletes who identify as transgender girls on female sports teams.

The Equality Act, which passed the House in May with unanimous Democratic support, amends the Civil Rights Act of 1964 to make “sexual orientation and gender identity” protected characteristics under federal anti-discrimination law.

The bill would force public schools to expand female athletic teams to include biological males who identify as transgender girls, as both critics and supporters of the bill have acknowledged. The bill comes as male athletes have racked up victories in female sports.

. . . . The top seven Democratic presidential candidates in RealClearPolitics’ running average of primary polls have all publicly endorsed the legislation.

Former Vice President Joe Biden, the frontrunner, said passing the Equality Act would be his top legislative priority if elected.

Slap the word “equality” on something designed to harm one of their identity groups, and they’re thrilled to support it . . .  without, apparently, giving it any thought at all.

In the world of intersectionality, there are always winners and losers, and it looks like, for the time being at least, women are losing the transgender war on women.

“Transgender” is, for practical matters, too nebulous a concept; it’s essentially meaningless. It’s like saying that Kansas City is between New York and Los Angeles. So it is, but there’s a lot of territory between the two; so, just where is Kansas City in there?

No matter how much they want to normalize transgender identity or how loudly they insist that men can become women through surgery, medication, and wishful thinking, the fact remains that men are biologically men.

“Surgery” and “medication” need not be involved. If the state is defining who’s a boy and who’s a girl solely by how each self-identifies, no physical alteration—successful or otherwise—is needed. “Transgenders” might lie anywhere on the spectrum; they might be loaded with hormones and surgically altered up the wazoo to simulate girls, or they might be medically unaltered, so in every observable or measurable way absolutely identical to boys.

In other words, girl’s sports now consists of girls, and boys wearing girl’s uniforms.

California leftists passed a law to enforce these totalitarian speech codes. For instance, we are not allowed, by law, to identify Bradley Manning as a cross-dressing homosexual male. No. Not allowed. I am lawfully compelled to identify her as Chelsea Manning.

The left claims they never intend to enforce the speech code law in the manner just described. But we all know they will do exactly that. And the ironic thing? The same leftists decriminalized petty theft, property crimes, most drug use and burglary.

And here we are. Lawyers and judges are going to tell us little people, the serfs, what constitutes a male and female. And then they’ll compel us, by force of law, to accept their absurd conclusions.

    The lawsuit is all about sex not gender. If we can speak of sex and not of gender, all this particular craziness goes away. You can call yourself any gender you want and more power to you because nobody else has to care.

    This is a real-life variant of the story of the Emperor’s New Clothes. Despite what the lawyers and judges tell us we must see, we know that the Emperor is in the buff… and we are unimpressed.

Transgender/neo-female with a masculine physiology and chemistry, right? Others in the transgender spectrum (“rainbow”) are separate and politically congruent (“=”), but without physical advantages over others of their sex.

I wonder why “transmen”, i.e., women/girls who “transition” to men/boys, don’t compete athletically against their new gender peers.

A “transgender woman” is not a woman! There, I fixed it for us!

    But in the barnyard some are more equal than others. In our version of Huxley’s brave new world “rights” are no longer what God gave us, but rather what our Black Robed Masters allow us to have.

The man who won the track and field championship this year, identifying as a woman, was ranked in the 900s nationwide, when he competed with his biological peers.

Like the illegal alien issue (I have a beautiful black African wife who came to the US legally), the fundamental injustice of this issue infuriated me.

I have had female students in my classes whose athletic abilities (in basketball and volleyball) have opened up amazing opportunities. Some of them would not be getting their chance at a four-year degree without the athletic scholarships they worked hard for.

Now – in the Holy Name name of Transgender Rights – the opportunities of young women like my students are being stolen by a bunch of guys in dresses and heels.

    If the only way someone can get to a university is on an athletic scholarship, they don’t belong there in the first place.

    Title IX rules are the only reason those scholarships even exist in the first place; even if you assume sports entertainment is a proper function for a university, nobody watches women’s sports and universities only waste money and scholarship seats on them because they’re required to by law.

    So I’m pretty short on sympathy here. Cut all federal funding to post-secondary education, scrap Title IX and let the chips fall where they may.

      Actually, most of my student athletes were very good academically – good enough to go to a four year school. What they lacked was money.

      BTW: it has been my experience that the stereotype of the “dumb jock” is just that – a stereotype. Some fit that description, but in nearly twelve years of teaching at a community college I have found the majority are ambitious, hard working young people with an outstanding work ethic. They have a goal, and will work hard to achieve it. This is the evidence of my own eyes.

      Athletic scholarships existed long before Title IX was a gleam in some Socialist-Democrat bureaucrat’s eye.

The girls don’t think of them as girls, is what the unstated fact is.

    It seems the basis of the complaint isn’t that they’re not girls, but that they’re winning. The ones suing are the ones losing to them.

    Since they’re winning, the ground was found to try to get them out of the sport i.e. that they’re not girls. So the old-type girls can win again.

    The court will decide whether, in this day of gender and redefinitions, that’s still a good ground.

      My guess is that you identify as a 6-year old because you think it’s an accomplishment hitting a ball off a tee farther than the little boys.

The course of this lawsuit should be interesting. It comes down 100% to say that sex matters, and gender identity is irrelevant in interpreting Title IX.

Does this mean that we’ll get rid of the whole “gender” meme and just talk about sex again, what your biology is not what you may feel?

This lawsuit could settle the “sex vs. gender” questions.

    Biological sex. Gender is the summation of sex-correlated mental (e.g. sexual orientation) and physical (e.g. strength, lung capacity) attributes normally distributed. Thus the characterization of male and female; masculine and feminine, respectively; and liberal anomalies in the transgender spectrum.

In a sane world, women would rise up and throw the Dems out!. But alas, it isn’t a sane world. And now we have the Demorat party telling women that they have TOTAL control over their own bodies when it comes to abortion but they have no control over their own bodies when it comes to sports. Never has one group done so much damage in such a short period of time to the softer sex than the modern Demorat party!

Some people don’t understand what Da Rules are for in sports.

Da Rules exist in order to make the games fun. To be fun, the games have to be competitive.

And so, boxing and wrestling have weight classes, most sports for kids have age classes, karate has skill levels in addition to age classes, football has skill levels and school size classes.

But now we have people who want to imports larger, stronger, faster people into a pool of people who will be acting at a disadvantage, all because they are boys pretending to be girls. It is turning out to be no fun at all, for the girls.

    Where’s the short person’s basketball team? Or the baseball team for people with poor vision?

    Why is there women’s chess? Even though there is no physical requirement at all for chess, it’s still a lower easier level in which women can get prizes that they could never get competing in the “open” (including men) competition.

    The very top women chessplayers sort of graduate from the women’s contests and play in men’s (open) events, which is great. So I am not belittling the performance of all the women.

      Male and female sex. Masculine and feminine gender, respectively. A compelling interest to construct a favorable juxtaposition of each. Thus boys in suits, and girls in dresses, etc. It’s for the ducks! That said, when are sex and gender differences relevant? GI Joe and GI Jane, certainly. Athletics, yes. Mental challenges? Perhaps, but not self-evident, other than an interest bias and reconciliation because we are not children anymore.

If Rachel Dolezal is not allowed to hold a job with the NAACP, teach African Studies, or collect certain welfare benefits while self-identifying as a black woman, why should any biological male be allowed to compete on all-female teams while identifying as a woman of any race? It’s not equitable. Live how you want to live, as long as you don’t try to disenfranchise or defraud someone else.

I don’t think those boys would do well in the hood in, say, Chicago. Might run into some non-woke folks who just don’t understand the intersectionality of gender politics. Then you would see how fast they can really run. Zip……….

Up until the last few years, where insanity now rules, the basic qualification for disqualification from participation in an sport having gender requirements was the sexual equipment of the participants. Physical males competed against physical males and physical females competed against physical females. A simple, logical solution. But, that changed. In the feminist universe, women HAD to be allowed to compete against men in men’s sports. And, a large percentage of the female population supported this. In fact, the courts ruled that this had to be allowed. Well, this is what unintended consequences looks like. This is the ultimate EQUALITY of opportunity. That it destroys safeguards which exist to create a level playing field for people of varying natural physical attributes bu creating reasonable classes for the competitors. This is the equivalent of letting high school students play Pop Warner football.

    I didn’t see much push for girls to compete with boys. A few girl wrestlers, typically losing quickly. Billie Jean King did a sort of match against washed-up Bobby Riggs and won, but she didn’t play any current active male players.

    Title IX provides all these separate women’s sports so women don’t HAVE to compete against men, because men are too hard and usually win. But the women get the sports anyway.

      It was court ordered in a few of cases, usually in such positions as field goal kickers and soccer players, positions which are more dependent upon leg strength than upper body strength. Of course, there have not been very many cases where transgender men are actually competing in woman’s sports, either. It only gets the press that it does because it is unfair to women.

      You must be very young if you think the separation of boys and girls sports is due to Title IX. Does it generally mandate equal spending on sports for both sexes, yes it does. As a result are there more schools with girls sports which didn’t make the financial cut before Title IX – unequivocally yes.

      But girls High School and college basketball, track and softball, etc. existed when I was in HS and Dwight Eisenhower was President.

There is no such thing as transgenderism. It’s a scientific impossibility.

An egg or a sperm contains a copy of one of the parents sex-determinative chromosomes. The sperm will contain either an x or a y chromosome. The egg will contain a copy of ONE of the mother’s two x chromosomes.

The x chromosome is far larger than the y chromosome, containing approx. 1100 genes. The y chromosome contains 26. So in addition to determining gender (a Victorian polite way of saying sex) they determine other characteristics. Obviously the x chromosome plays a far larger role.

This is why there are thousands of disorders that are passed from mother to son. These disorders affect both men and women but unless the woman beats the astronomical odds of getting an x chromosome from both mother and father with the genes for genetic disorders such as Hemophilia or Alport’s Syndrome or red-green color blindness they will either only be mildly affected or not at all and simply be carriers. The x chromosome that does not have the gene for these disorders mitigates or blocks the effects.

The y chromosome can’t do that, so these disorders are far more serious in the male offspring (fetus, BTW, is the Latin for offspring or child; spring that on your pro-abort associates when they tell you “it’s not a baby it’s only a fetus”),

The delusional can have all the hormonal treatment and cosmetic surgery they want. They can cut off their wedding tackle and have a surgeon cut a wound between their legs, which their bodies will attempt to heal because it’s not natural. They can have a fish skin installed to prevent that wound from healing.

    What’s crazy is the medical profession stop calling this a disorder. I hear the argument, if the medical profession accepts a man can be a woman who are you a layman to deny it? Over 40% of these unfortunate people kill themselves. Most people who have transgender surgery regret it afterwards. Instead of treating severely mentally ill people we praise and reward them.

This is actually incredibly inspiring to me. Perhaps Virtue Signalling isn’t the greatest cultural force in 2019 as I had once thought.

Let boys/men compete with boys/men and girls/women compete likewise. Let transgendered folk compete with transgendered folk. There may not be many of them early on, but they will still win.

So-called “transgender women” athletes (i.e., males competing against females) reminds me of the Seinfeld episode where Kramer gets into martial arts, and is kicking butt. . . only to be revealed as a 6-foot tall, adult participant enrolled in a children’s karate class.

If some guy wants to pretend he’s a woman, that’s okay with me.
Just don’t tell me that I have to pretend he’s a woman. And don’t tell the rest of us that we have to pretend he’s a woman.
The so-called “transgender” community is trying to force the rest of society to not only ACCEPT their mental illness, but to APPROVE of it.
Sorry. I think people who want to pretend that they are some different sex are mentally ill, and are in need of treatment. And that treatment does not include surgery.

What does it take to be transgender? According to this bill, merely identifying as transgender is enough. This is great for women. Any mediocre male high school athlete can compete against the women and get the available college athletic scholarships.
