U. Texas Profs Opposed to Campus Carry Take Fight to Appeals Court

The battle over guns on campus continues. Some people just refuse to accept it.

Appeals court hears UT professors’ challenge to Texas campus carry law

Attorneys for three University of Texas professors asked a federal appeals court Wednesday to revive their challenge of a law allowing people with concealed-handgun licenses to carry weapons on public university campuses. Two of the professors, Lisa Moore and Mia Carter, were on the front row as a three-judge panel of the 5th U.S. Circuit Court of Appeals in New Orleans heard the arguments.

Last year, a federal judge in Texas dismissed the suit. U.S. District Judge Lee Yeakel said Moore, Carter and Jennifer Glass offered “no concrete evidence” to substantiate concerns that having armed students in their classroom would have a “chilling effect” on the free exchange of ideas.

Yeakel said that, because they failed to clearly show they were harmed by the law, they had no legal standing to pursue the suit.

Jason LaFond, arguing for the Texas Solicitor General’s Office, said Yeakel’s ruling should stand. He argued that the subjective fear of a student bringing a gun to the classroom doesn’t give them standing to challenge the law, he said.

“Lots of people fear flying,” LaFond told the panel. “That doesn’t mean it’s reasonable to think that a plane is going to crash.”

    It is interesting that they appear to fear only law-abiding people. Criminals carry at will everywhere today as laws only apply to criminals after an act and only if caught. They really do think like children.

    Yup, UT profs, let’s trust Sheriff Scott Israel with our safety. What could go wrong?

I don’t know how to link to the specific page but, if you look up the Branco cartoon of 2/22/2018, he sums up this ‘controversy’ quite nicely.

Oh, how I wish Judge Don Willett had been part of that 3 judge panel!

Pretty safe guess: these profs will lose. If I were one of the judges, I’d ask them, “Using your own line of thinking, students shouldn’t even be allowed to drive on the UT campus since you have a statistically better chance of getting hit by some kid while crossing the street than of getting shot.”

If I were the judge, I’d tell the profs, “Considering the oath you took to defend the Constitution then you were hired and your arguments in this case, I can’t take your arguments seriously, since you haven’t resigned from your positions.”
