Confirmed: No Criminal Charges Against Trump Campaign Manager

Fields floats filing a civil complaint

As Professor Jacobson blogged yesterday, reports suggested the Florida prosecutor would not be filing charges against Donald Trump’s campaign manager, Corey Lewandowski, for the alleged assault of former Breitbart News reporter, Michelle Fields. The backstory on that dramatic saga here.

In a press conference Thursday, prosecutors confirmed they would not charge Lewandowski.

The legal battles are far from over though. Michelle Fields has suggested she may file a civil complaint against Trump and Lewandowksi for defamation.

The incident ballooned when Trump’s campaign opted to attack Fields rather than apologize for the incident:

Remember that Trump’s campaign publicly lashed out at Fields, calling her “delusional”.

    Actually it did not. It simply said that while he did it, he has a legal argument as to a legitimate reason why he did it.

    One will get you prosecuted for battery, the other is a legal defense that only appeared later when it was shown Lewandowski lied.

    The vitriol directed toward Trump has far exceeded any other candidate, including Obama who promised redistributive change, and a pro-choice religious/legal/social/etc. establishment. The only explanation is that while Obama promised to remold the nation in his image, Trump poses a direct threat to the Parties, their parties, and special and peculiar interests. The perception of a common threat reveals their overlapping and convergent interests.

          Yup. An interesting study, on a news program showed the net worth of our Senators and Representatives, before and then after they took office. It was staggering. Not a D or an R thing, as you mentioned.

All she needs is to file a suit against either the police or Trump for defamation. Because she still has the “minor” detail of filing a false police report hanging over her head.

The saddest thing, for me, is not the lengths to which politically biased “journalists” will go to bring down Trump. It is how usually responsible, principled human beings like the bloggers on this site allow their biases to drag them down into the mud with the slime denizens.

What happened to due process? What happened to waiting for evidence? Or has this site joined the mob baying that if a female makes an accusation of assault, we have to believe her, based on her word alone?

    She didn’t file a false police report however. He did in fact grab her and pull her out of the way. In the process bruising her. Depending on mens rea that could or could not be a crime. The prosecutor decided that Fields motives were innocent. She didn’t make up the incident.

      If you heard the press conference, they dont believe those bruises were from Lewandowski. In fact, after looking at photos she provided them, they found no bruising at all. It’s obvious they don’t believe a single thing she said..including the “bruises.”

That was very clear. Did they go out and say “this Michelle Fields woman is a jerk?” No but they showed you they didn’t believe her story at all.

        Actually, it was just that since the initial and later images were so far apart, it could be argued that it was fake, not that they were fake.

        When prosecuting someone, you have to look at all the evidence. If the defense can give reasonable doubt to your evidence, your case is weak.

        The prosecutor is explaining the weaknesses in a case, not saying he believes they were faked.

Why has no one asked Ms. Fields why she disobeyed the orders for the press to stay in the rear? I haven’t heard one so-called journalist ask that question. She started this whole debacle. Mr. Lewandowski isn’t off the hook, either. He should not have grabbed her and he should not have lied when he said he didn’t touch her. There has been too much time, manpower, and tax payer money spent on this ridiculous incident. Give it up, Ms. Fields, you were the instigator and you were wrong.

    If that is such a big deal why wasn’t the reporter that Trump talked to just before this incident taken down? She wasn’t the first reporter to ask questions while Trump was exiting and from my understanding that is SOP for Trump and reporters while he exits. I believed at first that Corey just needed to apologize but I am not even sure that was even needed now. If they would have acknowledged the contact at the time nothing would have come of this incident. Instead they attacked her and elevated her to news.

Fields wants to have it both ways. She’s going to break the rules by leaving the press area after the press conference is over and pursuing Trump to try to get a question she feels entitled to ask. She gets between him and his protection, and she’s willing to put a hand on him when asking her questions. Pretty aggressive behavior for a reporter.

Trump, having had more beautiful women than Fields try the “I’ll establish intimacy by touching you when I shouldn’t because I’m pretty” thing doesn’t buy it so he pulls away.

Lewandowski then pulls _her_ away, and instead of shrugging it off it as what happens when you’re being an aggressive reporter, she goes “you huuuurt me. I’m just a pretty girl and you huuurt me. You’re meeeean.”

Now she’s threatening to sue.

I’ve watched several of the videos since the beginning, and it struck me that Lewandowski was behaving very much like one of the security team. It’s come out since then that it’s often the case for campaign insiders to take on that role. According to the prosecutor’s statement, Lewandowski had a defensible claim that he was acting to protect Trump, not that this would settle the matter, but the reasonable doubt it would introduce would make it all but impossible to get a conviction.

        I agree with this. The prosecutor’s comments go beyond, “We’re not charging. No further comment”. They more or less said that they couldn’t get a conviction, and, given all the evidence, they’re not sure that a crime was committed (by CL). That’s not exactly an exoneration, but it’s close.

          This is incorrect. He did do something that could be characterized as wrong. However there are defenses to that act which he could put forward which would exonerate him.

          Either A: he did it for no reason or spite, that is a crime.
          or B: he was acting as a member of security, that is not a crime.

          The prosecutor said that he has a good argument for b, but not completely solid (actual security was not concerned and he initially lied about it). His defense is however plausable enough that they wont bring it to the court to decide.

          It absolutely in no way means that he did not do A and the prosecutor was not saying he did do B.

    If Lewandoski had a defensible claim he was acting to defend Trump, then that tweet accusing Fields of being delusional and asserting he had never touched her was false and defamatory.

    Not that Trumptards have a problem believing two contradictory stories at the same time. Why not? There’s plenty of room in their empty heads for “A” and “opposite of A” to roam around in at the same time. So depending on the circumstances they can go back and forth between “the lying bitch made the whole thing up he never touched her” to “he had to pull the evil bitch away from Trump she wasn’t obeying orders to stay to the rear” without it ever crossing what little passes for their minds that one of those stories must be a lie.

Actually her public statements do agree with her perception. Go get on a bus or train with other buses or trains stopped next to you. While you are stopped have one start moving. Your brain will try to compensate for movement believing you are moving. The same thing happened to Michelle. When Corey pulled on her arm Trump started walking off at the same time. Her brain took it as she was yanked backwards to create the space between her and Trump.

As far as declining to prosecute I am not surprised at all. It was a fairly minimal contact that would have been difficult to get a conviction on. The real issue is why did they feel the need to attempt to cover up the incident? Without the cover up attempt this issue would have never gained any traction. In fact they wouldn’t have even needed to issue an apology. All they needed to say was as we were leaving the event a reporter was jostled as we were making our way to the exit. Instead they created a beast that will eventually sink his ship before he can reach the White House.

Let us take inspiration from patriotic Colorado citizens who have banded together in protest. Let us make Colorado a rallying cry on behalf of all the forgotten people whose desperate pleas have for decades fallen on the deaf ears and closed eyes of our rulers in Washington, D.C.

The political insiders have had their way for a long time. Let 2016 be remembered as the year the American people finally got theirs.

Man, this post was like blood in the water. The rabid fanboyism is truly a wonder to behold.

Such desperation to clean up all the messes Trump makes. It has to be exhausting.

Trump, Kasich, and Cruz all spoke tonight, in that order, at New York GOP party gathering. At first I was confused by the order normally Trump goes last because TV likes to save the best and most popular draw for last. I watched Trump speak, and he was personable and persuasive and very well received. I skipped Kasich but went back to check out Cruz. It was then I realized why Cruz was speaking last.

This was a dinner gathering and Cruz was assigned the dinner service speaking slot. LOL. So while Cruz was speaking the entire audience was eating, having dinner conversation, not paying attention, clanking plates around, waiters running around, etc etc. Top that off with Cruz having mysterious television microphone problems making his own audio at least on TV horrible.

It was hilarious and obviously planned by New York GOP to give Cruz the sucks the big one speaking slot.

I guess even the New York GOP establishment didn’t take kindly to the unlikable Texans New York Values attacks. Not to mention one or two union audio techs also being offended.

Revenge is a dish best served cold. LOL !!

This latest FOX poll shows Cruz has slipped down 11 points during the last 30 days relative to Trump and only leads Kasich by 2 points at 27-25.

The downward trajectory shows Cruz supporters are leaving Cruz and switching to Trump and Kasich.

Prosecutors also noted how Fields lied to police including telling police and prosecutors she never touched Trump.

Ellis said Fields told her office that she had never touched Trump, but added: ‘That’s not what we see captured on the video.’

        Cruz hasn’t even won as many states as did Santorum against Romney in 2012.

          How stupid are you? Colorado doesn’t have a vote because the state of Colorado won’t support it. They caucus because the parties have to pay for there primaries. Yes even the Democrats caucus and had about 110,000 voters compared to 65,000 Republicans. Think about that for a minute. Approximately 175,000 Coloradans decided how the state would vote in the primary out of about 3,500,000 voters. Appears to me that the voters that wanted to vote, voted. Oh and by the way 2012 had approximately the same turnout.

      Volunteers at the Colorado Republican Assembly are coming forward with evidence to indicate that their state’s delegate selection process was riddled with errors that disadvantaged some Donald Trump supporters who were running to become national delegates.

      The errors could have violated state bylaws significantly enough that some of the results could be contested, according to the volunteers.

Turns out Fields never called him back. Probably because she couldn’t actually speak to Lewandowski and go forward with her conspiracy to slander the Trump campaign.

    You do realize that the only reason Fields had a knife to attack Lewandowski was because he stuck it in her back. If Lewandowski hadn’t went full Billy Clinton over this incident nothing would have ever come of this. So who is to blame for the damage to his family then? My vote goes to Lewandowski.

Interesting factoid:

Cruz has won fewer state primaries than Santorum against Romney.

Cruz is not a national candidate. He has very limited regional appeal and only in states that are reliably republican for any GOP candidate. He is not a factor in the battleground states.

    I didn’t know Idaho and Wisconsin were in the same region as Texas and Oklahoma. I didn’t know Wisconsin wasn’t a battleground state.

      Yes, Oklahoma and Texas are basically the same Region being contiguous states and all.

      Cruz has NO CHANCE to win any battleground state against Clinton. Wisconsin has gone democrat since 1992 I believe if not longer. The only republican who might make Wisconsin in play is Trump.

Should the Republican nomination be awarded to Cruz or John Kasich, it would be wildly out of step with the tradition of letting primary voters decide in practice who their candidate should be. Moreover, explaining this outcome would be enormously difficult to explain to the already dwindling number of voters willing to register Republican.

Trump’s argument, in this scenario, will be simple, clean, and easy to understand: I won the most delegates, the most votes, the most contests, and they stole the nomination from me.

The argument from the other side will be much more complicated and obtuse: You may not have known this, but the guy who wins the most of everything is ultimately at the mercy of a faceless mass of delegates, some of whom can be essentially bribed, and therefore giving the nomination to another candidate is fair game.Millions of Republicans will be told that their vote did not matter, and that the GOP, in its wisdom, has settled on a candidate that has been rejected by its electorate.

Clock Winds Down on Cruz Campaign: 10 Days Until Elimination

Ted Cruz is currently polling in third place in all these states except Pennsylvania.

As we noted on the 2nd, “Even if Cruz wins a third of the delegates in Rhode Island or Connecticut or any of these states, it will not be enough to keep him mathematically in the race.”

Now it looks like Cruz will not only be mathematically eliminated from obtaining enough delegates to win the election outright by April 26th, he may also have fallen to third place in the polls by the end of April, too.

    Donald Trump is a monumental incompetent. There is no kinder way of putting it. His name, in business is associated with an excess of hype followed by abject failure and bankruptcy. He is the poster child for the small-handed rich kid, who, being born on third base, trips over his own shoelaces, does a faceplant, and then demands to be given credit for a home run because he really could have done it if things had gone the way he wanted.

    His campaign is in crisis. He has divided his campaign staff into warring tribes that spend more time fighting each other for butt-kissing festivals with Trump than they do trying to run a national primary campaign. He is at the point where he needs a run of amazing luck to win the nomination on the first ballot and he has proved singularly inept a wrangling delegates to achieve that goal.

    A planned vote had been canceled. And one million Republicans in Colorado were sidelined. End T-rump.

    This is a lie that would have made Goebbels blush. Colorado Republicans were afforded the opportunity to vote on a candidate. They just couldn’t do it in the way that Donald Trump prefers. Nominating the GOP candidate is something that GOP voters are supposed to do. Trump brings in what can only be called carpetbaggers, that is, Democrats and independents, to vote in what is supposed to be a GOP event. The only people denied the opportunity to vote for the GOP nominees where people who were not Republicans and Republicans who had so little interest in the process that they couldn’t be bothered to participate. In other words, the quintessential Trump voter. As my colleague, Sara Gonzalez, points out, these rules were established last year and were, or should have been, well known to any serious candidate. Which is why Donald Trump was blissfully unaware of them.
