Today we will again be covering the Zimmerman Trial live, all day, with streaming video. Continuing commentary will be posted in the Twitter feed of selected contributors below the first video feed, below. This morning is the charging conference, in which the State and defense will argue about the specific charges on which the jury is to be instructed. The options are second degree murder, manslaughter, and aggravated assault. The defense wishes a charge only on second degree murder, the State prefers the latter two charges also be considered. The State is scheduled to begin its closing argument at 1:00PM today, and the defense tomorrow morning. By tomorrow afternoon the jury should have been charged and begun their deliberations. I have a really bad feeling about the Zimmerman verdict. Logically, it should be a slam dunk of "Not Guilty" on all charges, since the evidence clearly shows Zimmerman was acting in justifiable self-defense as he was being beaten by Trayvon Martin. Or at least there...

In my post last night I noted a near shouting match between defense attorney Don West and Judge Debra Nelson over whether text messages on Trayvon Martin's phone regarding fighting were "authenticated." Judge Nelson stated that there was no evidence that Trayvon typed the texts even...

A hearing was held this evening, concluding just before 10 p.m.,  on the attempt of the defense to introduce expert testimony as to text messages regarding fighting found on Trayvon Martin's cell phone. The judge previously had ruled that such social media evidence could not be mentioned in jury selection or opening statements. A large group of texts and photos were released in late May, but only some of them are at issue now. The judge expressed concern (full embed below) about admissibility on ground of authentication, that the defense could prove that the texts were to and from Trayvon's phone, but could not prove that Trayvon was using the phone at the time. "I don't have any identifying marks that these text messages" were sent by or from Martin. "Another person may know that password." The hearing was highly contentious, with defense lawyer Don West vigorously asserting that failure to allow the evidence would violate Zimmerman's constitutional rights, and blaming the prosecution for withholding evidence until early June as to the texts.  West argued that it was unfair to hold the defense to strict authentication standards given the prosecution's tactics. https://twitter.com/renestutzman/status/354782441132654592 The fireworks started about mid-way through this clip:

By far the biggest news of the day came mid-afternoon when defense attorney Mark O'Mara informed Judge Nelson that his next witness, Elouise Dilligard, would be his last of the trial, and that he expected the defense to rest their case tomorrow. Given the expectations...

Yesterday I posted up an analytical piece of Mark O'Mara's request for a judgment of acquittal. O'Mara's motion was well-reasoned and supported by Florida's case law. It was, of course, doomed to peremptory denial by Judge Nelson. Considering the wonderful job Andrew Branca has done covering the George Zimmerman trial, I've been relegated to something approaching potted plant status here. It ain't broke, so I ain't gonna fix that. But I will weigh in with my own thoughts on the case and the...

Today began with the expectation that it would the the day on which the State rested its case. That proved true, and it was. It was also among the most bizarre and disturbing days of a lengthy trial full to the brim with bizarre and disturbing days.

The first State witness of the day was, as anticipated Sybrina Fulton. She had two missions for her appearance: (1) identify the screamer in the background of the Jenna Lauer 911 recording as her son, Trayvon Martin; and (2) avoid saying anything nice about the reputation or character of her son that would open the door to the defense introducing into evidence Martin's history of violence and drug use. She accomplished both.

There was never, of course, any question that she would say exactly that, nor that the defense would fail to point out the suggestive conditions in which the identification initially took place--in the Mayor's office, surrounded by family and family lawyers/advisors, and without any law enforcement officer present. Ms. Fulton's credibility was also substantively damaged when she claimed that she had not known before hearing the tape that it was believed to contain the sound of her son's last, desperate screams. That the persons responsible for playing that tape would not have prepared her beforehand for the shock--to not do so could only be described as monstrous.

Next up was Martin's half-brother, Jahvaris Fulton, also a son of Sybrina Fulton. He testified on the stand that the screamer was Trayvon Martin. On cross-examination, as so often has happened to State witnesses, the credibility of his testimony quickly vanished. Defense counsel O'Mara pointed out that two weeks after first hearing the recording played Jahvaris was still stating to reporters that he wasn't sure that the recorded screams were those of Trayvon. When pressed, his answers became a series of "don't know," "not sure, " can't remember," almost as if he'd been pushed outside the boundaries of the coaching for his testimony.

Trayvon Martin's mother, Sabryna Fulton, is currently on the stand. It is anticipated that the State will finish with the last of its witnesses today and rest its case. At that point I expect the defense will submit a motion for a directed verdict, Judge Nelson will deny the motion, and the defense will begin to present its case.
