Senator Jon Tester (D-MT) — who is “F” rated by Gun Owners of America — is pushing a “hunting” bill that authorizes the Obama administration almost unlimited power to seize private lands for “environmental” purposes.
Anti-gun Majority Leader Harry Reid has scheduled Tester’s bill for a vote, and it will probably take place on Thursday.
ACTION: It is imperative that gun owners contact their Senators and ask them to OPPOSE S. 3525. Click here to tell them that the modest conservation gains allowed in the bill are totally offset by giving unelected bureaucrats the authority to steal land from hunters and private property owners.
BACKGROUND
(1) When the “wetlands” provisions of the Clean Water Act were originally enacted, no one could have foreseen that a landowner would go to prison for applying clean dirt to a junkyard adjacent to a sewer, which was determined to be “wetlands.” But environmentalists have been brilliant in taking seemingly innocuous programs and massively expanding them through fraudulent interpretations or tiny loopholes.
(2) S. 3525 has “sweeteners.” It allows archery bows to be transported through national parks under very limited circumstances, although Obama could do this by administrative fiat. It also allows, but does not mandate, Pittman-Robertson funds to be used for target ranges. But none of these small discretionary provisions offset the potential damage this does to the rights of individual landowners.
(3) THE ISSUE OF LOST OPPORTUNITY: If this is the Democrats’ sop to gun owners, it may make it a lot more difficult to secure national concealed carry reciprocity or to stop anti-gun measures and treaties.
THE CENTRAL PROBLEM WITH S. 3525
The central problem with the bill is that it allows seizure of private lands for “aquatic habitats” [Sections 201(8) and 204 (d) (2)]. The definition of this term is limitless and includes seizure of lands in order to “protec[t] the quality and quantity of water sources” and to “serv[e] as a buffer protecting the aquatic environment.” [Section 201 (2)]
Thus, a factory that “pollutes” can be seized to protect an “aquatic habitat.” The only real limit on seizure in Section 204 is the requirement that the government manage the seized property “in accordance with the purposes of this subtitle.”
WHO ARE THE DECISION MAKERS?
The National Fish Habitat Board consists of 27 members. The initial members (Obama appointees) select the remaining members. Thus while the “commercial fishing industry” supposedly has a representative, you can bet that that fisherman is an Obama-supporter and will support his agenda.
The board then enters into “partnerships” with, inter alia, outside groups. And you can bet that every liberal environmental organization in the country will now be feeding at this pig sty. The outside groups recommend fish habitat programs and plans for seizing private lands.
Bottom line: This will give immense powers to unelected bureaucrats — a clear violation of the Separation of Powers which our Founders implemented as a way of protecting our rights.
WHAT ABOUT SECTION 211 (e) (2)?
This supposedly requires the consent of landowners prior to having their lands seized. But, note the sneaky loophole: Section 211 (e) (2) applies only to property that is being seized with federal funds and, under Section 204 (e), half the funds need to come from non-federal sources.
So while this section is put forward as a “protection,” it actually doesn’t provide total immunity because the government can take a land owner’s property using non-federal funds — and there is no protection in the bill against that.
A small gaggle of reporters awaited one of the rising stars in Washington, and Warren knew it. She leaned into Baldwin and was overheard saying, “Pretend you’re talking to me.”

One of these was bringing together a coalition of various conservative themes—Rick Perry on states rights, Ron Paul on sound money, and so on. Key concepts which could help forge the various disparate conservative-leaning factions into a unified front, by having something for everyone at the table. I think this sort of strategy is worth renewing and exploring.
Another idea Newt raised was that of gearing the GOP into an inclusive American-centered party, that could offer conservative-minded solutions for common problems faced by all Americans regardless of race, gender, or socioeconomic background. I can see that echoed in what Jindal is saying here.

The election news last week wasn’t all bad. Last Tuesday represented the total failure of a multi-year leftist effort to move Evangelical voters left. According to the exit-poll data, not only did Evangelicals turn out for Mitt Romney at percentages that exceeded George W. Bush’s and John McCain’s share of the Evangelical vote, they also constituted a record-high share of the overall electorate. Alas, it wasn’t enough, but this turnout prevented a defeat from becoming a rout.
It’s hard to overstate the extent of the progressive failure here. Ever since the triumph of the “values voter” in 2004, the Left has engaged in a determined effort to liberalize Evangelicals.
As a non-religious person, who comes to the same conclusions on rational grounds as a lot of those bad old “social issues” voters, seems like they are pretty important in the conservative coalition.
For starters, if the Washington Post is to be believed, Mitt Romney received 1.3 million fewer votes than John McCain did in 2008, not 3 million. For the record, Obama received 7.5 million fewer votes in 2012 than he did in 2008.
More than 1.1 million of the Republican votes were “lost” in California. It is not that California Republicans turned against Romney. His percentage of the vote was higher than McCain’s in 2008. It is just they know their votes were in vain in that increasingly absurd state. The same is likely true in New York State where Romney fell more than a half-million votes short of McCain’s totals. Excluding these two states, Romney received 300,000 more votes than McCain.
That much said, the results in several states do raise eyebrows, most notably Ohio and Pennsylvania. Romney received nearly 100,000 fewer votes than McCain in the former and 35,000 fewer votes in the latter. In all the other battleground states, Romney improved both on McCain’s raw numbers and his percentage of the vote. This includes Florida despite the fact that every vote south of Palm Bay down Florida’s I-95 corridor is suspect.
Can’t a Republican publicly say, “We support Barack Obama’s efforts to cut $900 billion plus out of the annual deficit, which with his plan of raising $80 billion plus from those who make over $250,000, is a path to a balanced budget. On Tuesday only one precinct had less than 113% turnout. “The Unofficial vote count is 175,554 registered voters 247,713 vote cards cast (141.10% ). The National SEAL Museum, a St. Lucie county polling place, had 158.85% voter turn out, the highest in the county.”
The Supervisor of Elections, Gertrude Walker, had this to say concerning the 141% voter turnout: “They may have had something like that in Palm Beach County, but we’ve never seen that here.”
IMO, stories like this are extremely harmful. We heard stories about how the Republican consultants were feathering their own nest with campaign contributions a decade ago, but Republicans were winning so I suppose the donors probably dismissed the stories. Now that the stories persist and Republicans are losing, eventually the major donors are going to start closing their wallets. Not good for future Republican presidential campaigns. Considering the horrible return from Karl Rove’s Crossroads endeavors, probably not good for Congressional races either. Alarm bells going off everywhere.

According to this article, the anti-abortion platform that allowed the “war on women” rhetoric is what is primarily responsible for the election results. I suspect that the Tea Party prevailed in 2010 in spite of the anti-abortion platform, and that perhaps the Republican party needs to consider ditching the social issues (which arguably belong at the state level anyway).
(Add: the woman who sent me the link says that it’s the same issue of big government, but on a gender basis, and that the government needs to get out of women’s… same way it needs to get out of the way of regulating everything else.)

I have to level some responsibility about the abortion/birth control issues at the Republican response.
We fell into a trap and never changed opinion.
What was a response to the Obamacare demands about abortion and birth control suddenly morphed into some imagined war on women.
The issue was dreadfully articulated by the campaign and even more so by a few Republican candidates.
Across Philadelphia, GOP poll inspectors were forcibly (and illegally) removed from polling locations. Coincidentally (or not), Mr. Obama received “astronomical” numbers in those very same regions, including locations where he received “over 99%” of the vote.
Ward 4, which also had a poll watcher dressed in Obama attire, went massively for Obama. Mr. Obama received 99.5% of the vote, defeating Mr. Romney 9,955 to 55.
Is it odd that a county that dispelled GOP inspectors and had people openly campaigning for Obama ended with 99.5% for Obama and 9955 votes for him? It’s up to you to decide.
Another problem: “Voter turnout in Philadelphia was around 60 percent, according to state election figures.” In these precincts it was well over 90% according to House Speaker Sam Smith of Pennsylvania.

The election news last week wasn’t all bad. Last Tuesday represented the total failure of a multi-year leftist effort to move Evangelical voters left. According to the exit-poll data, not only did Evangelicals turn out for Mitt Romney at percentages that exceeded George W. Bush’s and John McCain’s share of the Evangelical vote, they also constituted a record-high share of the overall electorate. Alas, it wasn’t enough, but this turnout prevented a defeat from becoming a rout.
It’s hard to overstate the extent of the progressive failure here. Ever since the triumph of the “values voter” in 2004, the Left has engaged in a determined effort to liberalize Evangelicals.

As a non-religious person, who comes to the same conclusions on rational grounds as a lot of those bad old “social issues” voters, seems like they are pretty important in the conservative coalition.
For starters, if the Washington Post is to be believed, Mitt Romney received 1.3 million fewer votes than John McCain did in 2008, not 3 million. For the record, Obama received 7.5 million fewer votes in 2012 than he did in 2008.
More than 1.1 million of the Republican votes were “lost” in California. It is not that California Republicans turned against Romney. His percentage of the vote was higher than McCain’s in 2008. It is just they know their votes were in vain in that increasingly absurd state. The same is likely true in New York State where Romney fell more than a half-million votes short of McCain’s totals. Excluding these two states, Romney received 300,000 more votes than McCain.
That much said, the results in several states do raise eyebrows, most notably Ohio and Pennsylvania. Romney received nearly 100,000 fewer votes than McCain in the former and 35,000 fewer votes in the latter. In all the other battleground states, Romney improved both on McCain’s raw numbers and his percentage of the vote. This includes Florida despite the fact that every vote south of Palm Bay down Florida’s I-95 corridor is suspect.

Cops found the body of David Maxwell in his Staten Island home on Friday after it lay undiscovered for 11 days — with his neighbors thinking he had fled before the storm.
The 66-year-old lived alone with his cat — which also died — in the modest yellow, two-family house on Mapleton Avenue in Midland Beach. The home now stands in a flooded wasteland of trash, ruined furniture, mold and mildew.

On Tuesday only one precinct had less than 113% turnout. “The Unofficial vote count is 175,554 registered voters 247,713 vote cards cast (141.10% ). The National SEAL Museum, a St. Lucie county polling place, had 158.85% voter turn out, the highest in the county.”
The Supervisor of Elections, Gertrude Walker, had this to say concerning the 141% voter turnout: “They may have had something like that in Palm Beach County, but we’ve never seen that here.”

IMO, stories like this are extremely harmful. We heard stories about how the Republican consultants were feathering their own nest with campaign contributions a decade ago, but Republicans were winning so I suppose the donors probably dismissed the stories. Now that the stories persist and Republicans are losing, eventually the major donors are going to start closing their wallets. Not good for future Republican presidential campaigns. Considering the horrible return from Karl Rove’s Crossroads endeavors, probably not good for Congressional races either. Alarm bells going off everywhere.

According to this article, the anti-abortion platform that allowed the “war on women” rhetoric is what is primarily responsible for the election results. I suspect that the Tea Party prevailed in 2010 in spite of the anti-abortion platform, and that perhaps the Republican party needs to consider ditching the social issues (which arguably belong at the state level anyway).
(Add: the woman who sent me the link says that it’s the same issue of big government, but on a gender basis, and that the government needs to get out of women’s… same way it needs to get out of the way of regulating everything else.)

Across Philadelphia, GOP poll inspectors were forcibly (and illegally) removed from polling locations. Coincidentally (or not), Mr. Obama received “astronomical” numbers in those very same regions, including locations where he received “over 99%” of the vote.
Ward 4, which also had a poll watcher dressed in Obama attire, went massively for Obama. Mr. Obama received 99.5% of the vote, defeating Mr. Romney 9,955 to 55.
Is it odd that a county that dispelled GOP inspectors and had people openly campaigning for Obama ended with 99.5% for Obama and 9955 votes for him? It’s up to you to decide.
Another problem: “Voter turnout in Philadelphia was around 60 percent, according to state election figures.” In these precincts it was well over 90% according to House Speaker Sam Smith of Pennsylvania.
